Regulations of Nanyang Municipality on the Administration of Fire Safety in Residential Areas

Chapter I General Provisions Article 1 In order to standardize the fire safety management in residential areas, prevent fires and reduce fire hazards, protect personal and property safety, and maintain public safety, these Regulations are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC), the Regulations on Fire Protection in Henan Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the fire safety management of residential areas within the administrative area of this Municipality.

"Residential areas" as mentioned in these Regulations refers to buildings and supporting facilities, equipment and related sites that provide family residence, including urban residential areas and rural residential areas. Article 3 The fire safety management of residential areas shall implement the policy of putting prevention first and combining prevention with elimination, implement the responsibility system for fire safety, establish and improve the socialized fire network and improve the fire prevention and control ability of residential areas in accordance with the principles of unified leadership of the government, legal supervision of departments, overall responsibility of units and active participation of residents. Fourth people's governments at all levels are responsible for the fire safety work in residential areas within their respective administrative areas.

The emergency management departments of the people's governments of cities and counties (cities, districts) shall supervise and manage the fire safety work in residential areas within their respective administrative areas, and the fire rescue institutions of the people's governments at the corresponding levels shall be responsible for the implementation.

City, county (city, district) people's government public security, housing and urban construction, natural resources and planning, urban management, market supervision, agriculture and rural areas, education, civil affairs, water administration, big data management and other departments in accordance with the division of responsibilities, * * * do a good job in fire safety in residential areas. Fifth residents should learn the necessary knowledge of fire control, master the common sense of safe use of fire, electricity and gas, and the skills of fire prevention, fire fighting and escape, so as to enhance the ability of self-prevention and self-help.

Encourage residents' families to formulate fire evacuation and escape plans and configure necessary fire fighting and evacuation and escape equipment. Sixth primary and secondary schools and kindergartens should incorporate fire knowledge into education and teaching content, so that students can enhance their awareness of fire control and master fire control knowledge and skills. Seventh to encourage and support the news media and the public to supervise by public opinion on the fire hazards and renovation of residential areas. Article 8 All units and individuals have the obligation to maintain fire control safety, protect fire control facilities, prevent fires and report fire accidents according to law, and have the right to stop and report acts endangering fire control safety. Article 9 The people's governments of cities and counties (cities, districts) shall commend and reward the units and individuals that have made outstanding contributions to the fire safety work in residential areas according to law. Chapter II Fire Control Responsibility Article 10 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over fire control safety in residential areas, bring them into the grass-roots social governance and grid-based comprehensive management system, and urge the relevant departments of the people's governments at the same level and the people's governments at lower levels to perform their management duties. Article 11 Township People's governments and sub-district offices shall establish and improve fire safety organizations, implement grid management measures for fire safety, improve public fire control facilities, regularly inspect, guide and help village (neighborhood) committees to carry out mass fire control work, do a good job in fire prevention publicity, inspection, hidden danger investigation and rectification in residential areas, and assist in fire accident investigation and aftermath.

The fire safety committees of township people's governments and sub-district offices are responsible for researching, supervising and guiding the fire safety work in their respective jurisdictions, and coordinating and solving major fire safety problems. Twelfth city and county (city, district) people's government emergency management departments should strengthen the publicity of fire laws and regulations, supervise and guide the relevant units to do a good job in fire safety.

The emergency management department of the people's government of the city or county (city, district) shall report the key units of fire safety determined by the fire rescue agencies to the people's government at the corresponding level for the record, and report the major fire hazards found by the fire rescue agencies in the fire supervision and inspection to the people's government at the corresponding level in writing. Thirteenth city and county (city, district) people's government fire rescue agencies shall perform the following duties:

(a) to strengthen the publicity of fire laws and regulations, supervise, guide and assist the relevant units to do a good job in fire publicity and education;

(two) to guide the Township People's governments, street offices and departments responsible for fire safety supervision and management to perform their duties of fire safety;

(three) the implementation of fire supervision and inspection of key fire safety units in residential areas with important nature, complex functions, large scale and high technical requirements for fire safety, and the handling of fire safety violations;

(4) Other duties as prescribed by laws and regulations. Fourteenth city and county (city, district) people's government housing and urban construction departments shall perform the following duties:

(a) responsible for the fire design review and fire acceptance of residential buildings;

(two) responsible for the supervision and management of residential exterior wall insulation materials;

(three) to guide and urge the property service providers to perform their fire safety duties in accordance with the contract;

(four) to guide the owners to use special maintenance funds to repair, update and transform the fire-fighting facilities used by * * * in accordance with relevant regulations;

(five) to investigate and deal with fire safety violations in residential areas under construction according to law;

(six) other duties as prescribed by laws and regulations. Fifteenth public security organs shall perform the following duties:

(a) to investigate and deal with fire safety violations transferred by fire rescue agencies according to law;

(two) to assist in the fire fighting and emergency rescue operations, parking and other security work of fire fighting vehicles and other rescue vehicles;

(three) responsible for fire fighting and emergency rescue site and the surrounding road traffic control, command and guidance.

The police station shall perform the following duties:

(a) to carry out fire safety publicity and education, guide and urge the village (neighborhood) committees, property services and other relevant units and individuals to implement fire safety measures;

(two) to carry out daily fire supervision and inspection, and deal with fire safety violations in accordance with relevant regulations;

(three) to assist the fire rescue agencies to carry out fire fighting, emergency rescue and fire accident investigation;

(4) Other duties as prescribed by laws and regulations.
