When buying a house, I chose the first floor without hesitation. Because there are old people at home, it is inconvenient to walk and feet. Although there are elevators now, the first floor is always more convenient than the top floor. At least old people don't have to squeeze elevators with young people during rush hours.

But I didn't expect that soon after I moved in, when I paid the property management fee, I clearly saw one item and actually charged my elevator fee. I'm so angry to see this. Although everyone has a share in the same building, I will never enjoy the elevator. It's unreasonable to charge my elevator fee. Similarly, in addition to the residents on the first floor, neighbors on the second and third floors also raised questions.

Personally, I think it should be analyzed in detail. For example, friends on the ground floor, the first floor and the second floor, when collecting elevator maintenance fees and use fees, should consider them reasonably according to the specific situation and give exemptions or concessions to these groups. But when I went to the property management office, they gave me a different story. They said that according to the existing laws and regulations, Article 6 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Specific Application of Laws in the Trial of Property Service Disputes stipulates that property service enterprises have provided services in accordance with the contract and relevant regulations, and the people's courts will not support the owners only because they do not enjoy or need to accept relevant property services.

In other words, if there is such a dispute, the court will not support the low-rise residents to reduce the elevator fee. After all, we can't guarantee that 100% people don't use the elevator, so for owners like us, we can only pay for it ourselves.

In this regard, some professionals have given their own views: elevators are public facilities shared by all owners of buildings and enjoyed by all owners. At the same time, both owners have the obligation of maintenance and management. The cost of the elevator belongs to the public service, which should be borne by both owners regardless of the floor, so it should be shared equally.
