Measures of Guizhou Province on Elevator Safety Management (revised 20 19)

Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent and reduce accidents, reduce elevator failure rate, and ensure personal and property safety, these measures are formulated in accordance with the relevant provisions of the People's Republic of China (PRC) Law on Safety in Production, the Law of the People's Republic of China on Safety of Special Equipment, the Regulations on Safety Supervision of Special Equipment, and in combination with the actual situation of this province. Article 2 These Measures shall be observed in elevator selection and configuration, production (including design, manufacture, installation, renovation and maintenance), operation, use, maintenance, inspection and related supervision and management activities within the administrative region of this province.

The range of elevators is determined according to the Catalogue of Special Equipment approved by the State Council, including manned (cargo) elevators, escalators and moving sidewalks.

These measures are not applicable to elevators installed in non-public places and used only by a single family. Article 3 People's governments at or above the county level shall strengthen their leadership over elevator safety, urge and support relevant departments to perform their duties of elevator safety supervision and management according to law, coordinate and solve major problems in elevator safety supervision and management, and organize the establishment of an emergency rescue system for elevator accidents within their respective administrative areas.

The agencies of local people's governments, such as township people's governments, subdistrict offices, development zone management agencies, etc., shall assist relevant departments to do a good job in the safety supervision and management of elevators within their respective administrative areas, and coordinate and solve problems in elevator use. Fourth special equipment safety supervision and management departments shall supervise and manage the elevator safety within their respective administrative areas according to law.

The housing and urban-rural construction department is responsible for the elevator engineering design review of construction projects and the quality supervision of civil engineering such as elevator machine room, shaft and pit, and cooperates with the special equipment safety supervision and management department to guide the property service enterprises undertaking elevator use management to strengthen the supervision and related services of elevator use management and maintenance activities.

The public security department shall investigate and deal with illegal acts such as destroying elevator safety facilities and endangering public safety according to law, and the public security fire control institutions shall be responsible for cooperating with relevant units to implement emergency rescue for elevator emergencies.

The safety supervision department is responsible for the comprehensive supervision and management of elevator safety and participates in the investigation and handling of elevator safety accidents.

The communication management department is responsible for coordinating the basic telecom operators to strengthen the comprehensive information communication network coverage of elevator cars and shafts.

The insurance supervision department is responsible for the supervision and management of the insurance institutions underwriting elevator safety liability insurance, and guiding the insurance institutions to do a good job in underwriting claims.

Development and reform, ecological environment, culture and tourism, education, health, transportation, commerce and other departments shall, according to their respective responsibilities, do a good job in elevator safety supervision and management. Fifth people's governments at or above the county level special equipment safety supervision and management departments and relevant departments should strengthen the publicity and popularization of special equipment laws and regulations and elevator safety knowledge, advocate civilized elevator ride, and enhance public safety awareness. Article 6 The province promotes elevator safety liability insurance, and encourages and supports elevator production, use, maintenance and other units to insure elevator safety liability insurance in accordance with the provisions of relevant laws and regulations, so as to improve the ability of accident compensation. Article 7 This province encourages the use of advanced technologies and information means such as the Internet of Things and big data to improve the safety performance and management level of elevators and enhance the ability of accident prevention and emergency rescue. Eighth elevator industry associations should strengthen industry self-discipline, promote the construction of industry credit system, and organize public welfare activities such as elevator safety publicity and training.

This province encourages elevator industry associations to formulate and promote the use of elevator maintenance contract model, announce the reference price of elevator maintenance, create a fair, high-quality and standardized market environment, and improve the quality and safety management level of elevator maintenance. Ninth any unit or individual has the right to complain and report elevator safety violations to the special equipment safety supervision and management departments and relevant departments. Chapter II Selection, Configuration, Production and Operation of Elevators Article 10 The engineering design, selection, configuration and communication devices of elevators shall meet the requirements of building structure and use, meet the technical specifications for elevator safety and the standards stipulated by the state, and ensure the needs of safety, first aid, fire fighting, communication and barrier-free access. Eleventh construction units or property units shall select, configure and purchase elevators in accordance with relevant safety technical specifications and standards, as well as elevator engineering design documents and contract requirements. Twelfth schools, kindergartens, hospitals, airports, stations, passenger terminals, shopping malls, stadiums, exhibition halls, parks and other public gathering places and residential newly installed (relocated) passenger elevators, the power supply system is not equipped with dual-loop power supply, it should be equipped with standby power supply or install elevator emergency leveling device.

Elevator used in public gathering places shall be equipped with elevator video operation monitoring system, and the video information shall be kept for at least 1 month, unless otherwise stipulated by laws and regulations. Thirteenth construction supervision units shall, in accordance with laws, regulations and relevant technical standards, design documents and construction contracts, supervise the construction quality of elevator engineering in construction projects on behalf of the construction units, and bear the supervision responsibility for the construction quality.

The construction unit of the construction project must carry out the construction in accordance with the elevator engineering design drawings and construction technical standards in the construction project, and shall not modify the engineering design without authorization or cut corners.
