According to the Urban and Rural Planning Law of People's Republic of China (PRC)

Article 3 Cities and towns shall formulate city plans and town plans in accordance with this Law. Construction activities within a planned urban area shall conform to the planning requirements.

The local people's governments at or above the county level shall, according to the local rural economic and social development level and the principle of adapting measures to local conditions and being practical, determine the areas where township planning and village planning should be formulated. Townships and villages in designated areas shall make plans in accordance with this law, and the construction of townships and villages in the planned areas shall meet the planning requirements.

Article 35 Railways, highways, ports, airports, roads, green spaces, power transmission and distribution facilities, transmission line corridors, communication facilities, radio and television facilities, pipeline facilities, rivers, reservoirs, water sources, nature reserves, flood control passages, fire exits, nuclear power plants, landfills and incinerators, sewage treatment plants, public service facilities and other land that needs to be protected according to law shall not be changed without authorization.

Article 41 For the construction of township enterprises, rural public facilities and public welfare undertakings in township and village planning areas, the construction unit or individual shall apply to the township and town people's government, which shall report to the competent department of urban and rural planning of the people's government of the city or county to issue a rural construction planning permit.

Measures for the planning and management of using the original homestead to build rural villagers' houses in township and village planning areas shall be formulated by provinces, autonomous regions and municipalities directly under the central government.

The construction of township enterprises, rural public facilities, public welfare undertakings and rural villagers' houses in township and village planning areas shall not occupy agricultural land; If it is really necessary to occupy agricultural land, the competent department of urban and rural planning of the people's government of the city or county shall, in accordance with the relevant provisions of the Land Administration Law of the People's Republic of China, go through the examination and approval procedures for the conversion of agricultural land and issue a rural construction planning permit.

The construction unit or individual can only go through the formalities of examination and approval of land use after obtaining the rural construction planning permit.
