The new property law stipulates that shops in residential areas cannot open restaurants, so which department is responsible for the implementation?

This should not be stipulated in the new property law. However, restaurants are usually not allowed in residential shops. See the following legal provisions for reasons:

2. Article 81 of the Law on the Prevention and Control of Air Pollution stipulates that catering service operators who discharge lampblack shall install lampblack purification facilities and keep them in normal use, or take other lampblack purification measures to discharge lampblack up to the standard and prevent pollution to the normal living environment of nearby residents.

3. Article 77 of the Property Law stipulates that the owner shall not change the house into a business house in violation of laws, regulations and management regulations. Owners who change their houses into business houses shall obtain the consent of interested owners in addition to observing laws, regulations and management regulations.
