Article 1 In order to give full play to the publicity role of housing ownership registration, ensure the safety of housing transactions, maintain the order of housing transactions, and protect the legitimate rights and interests of housing owners and related parties, these Measures are formulated in accordance with the People's Republic of China (PRC) Urban Real Estate Management Law, the People's Republic of China (PRC) Archives Law and other relevant provisions.
Article 2 These Measures shall apply to the inquiry of housing ownership registration information registered by urban housing ownership registration institutions.
Article 3 The term "housing ownership registration information" as mentioned in these Measures includes the original registration certificate and the housing rights information recorded by the housing ownership registration agency.
Article 6 Housing ownership registration institutions and housing ownership archives management institutions (hereinafter referred to as inquiry institutions) shall properly keep the housing ownership registration materials, update the relevant information recorded on housing rights in time, and ensure the completeness, accuracy and safety of the information.
The inquiry institution shall establish a housing ownership registration information inquiry system to facilitate the parties to inquire about relevant information.
Seventh housing rights information recorded by the housing ownership registration agency, units and individuals can be publicly inquired.
Tenth housing ownership registration information, units and individuals can inquire by themselves, or entrust others to inquire.
Article 11 To inquire about the registration information of house ownership, an application form for inquiring about the registration information of house ownership shall be filled in, indicating the location of the house (house number and location) or the number of the ownership certificate and the inquiry items, and the identity certificate of the inquirer or the qualification certificate of the unit as a legal person shall be issued.
To inquire about the original registration certificate of the house, in addition to the materials specified in the preceding paragraph, relevant supporting documents shall be submitted in accordance with the following provisions:
(a) the owner of the house shall submit his right certificate;
(2) Heirs, donees and legatees shall submit proof of the fact of inheritance, gift and bequest;
(3) State security organs, public security organs, procuratorial organs, judicial organs, discipline inspection and supervision departments and securities supervision departments shall submit the inquiry certificate issued by their own units and the work permit of the staff performing the inquiry task;
(4) The notarization institution and arbitration institution shall submit the inquiry certificate issued by their own units, the certificate of the parties applying for notarization or arbitration, and the work certificate of the staff performing the inquiry task;
(five) the parties to an arbitration or litigation case shall submit a certificate that the arbitration institution or judicial organ has accepted it, and the accepted case shall be directly related to the matters applied by the parties;
(6) In case of any of the circumstances specified in Article 9 of this Law, the certificate that the state security organ, military organ and other organs agree to the investigation shall be submitted.
Where the inquiry is entrusted, in addition to the materials submitted in accordance with the above provisions, the trustee shall also submit the power of attorney specifying the inquiry matters and its identity certificate.
