This Convention is formulated to safeguard the legitimate rights and interests of all owners and users of _ _ _ _ _ _ _ _ (hereinafter referred to as "the Property"), maintain public environment and order, and ensure the safe and rational use of the Property.

This temporary management statute is binding on all owners and users in the property management area.

Article 1 (Rights and Obligations of the Owner)

Owners enjoy corresponding rights and perform corresponding obligations in property management activities in accordance with the State Council's "Regulations on Property Management" and relevant laws and regulations.

Article 2 (Neighborhood Relations)

The owner agrees to abide by the laws, regulations and systems of property management, and correctly handle the adjacent relations of water supply, drainage, transportation, ventilation, lighting, maintenance, decoration, environmental sanitation and environmental protection in accordance with the principle of being conducive to the use and safety of the property.

Article 3 (Use of Property)

The owner and user agree to use the property in accordance with the following provisions:

(1) Use the property according to the purpose approved by the planning administrative department or the purpose specified in the real estate certificate, and shall not change the nature of the use of the property without authorization.

Article 4 (Prohibition of Use of Property)

Article 5 (Property Maintenance)

The owner and user agree to maintain the property in accordance with the following provisions:

(a) the maintenance of the exclusive part of the property does not infringe upon the legitimate rights and interests of other owners.

(2) When it is really necessary to enter the exclusive part of the property of the relevant owners due to property maintenance, the owners or property management enterprises shall inform the relevant owners in advance, and the relevant owners shall give necessary cooperation. If the relevant owners obstruct the maintenance and cause property losses, they shall be responsible for the repair and bear the liability for compensation.

(three) because of the maintenance of property or public interests, it is really necessary to temporarily occupy or dig roads and sites, it shall apply to the property management enterprise, and it can be implemented only after written consent, and it shall be restored to its original state within the agreed time limit; If losses are caused, compensation shall be made;

(four) there are security risks in the use of the property, which have endangered or will endanger the interests of the public and others, and the responsible person shall carry out emergency maintenance in time; If the responsible person fails to perform or is unable to perform the emergency maintenance obligation and needs to enter the occupied part of the property for emergency maintenance, the property management enterprise may carry out emergency maintenance under the witness of the public security organ or the neighborhood committee, and the expenses incurred in maintenance shall be borne by the responsible person.

(five) the construction unit shall undertake the warranty responsibility of the property in accordance with the warranty period and scope stipulated by the state. In case of quality problems during the warranty period, the construction unit shall solve them in time.

If the construction unit refuses to repair or delays the repair, the owner may repair it by himself or entrust others to repair it, and the repair cost and other losses caused during the repair period shall be borne by the construction unit.

Article 6 (Collection and Use of Maintenance Funds)

The owner shall raise and use maintenance funds in accordance with the following provisions:

(a) to pay special maintenance funds in accordance with the provisions;

(two) the special maintenance fund account is managed by the property management enterprise;

(three) the use and management of special maintenance funds in accordance with the relevant provisions of the government;

(4) When the owner transfers or mortgages his property, the special maintenance funds paid will continue to be used for the maintenance and update of * * * parts and * * * equipment and facilities of the property.

Article 7 (Matters relating to Property Transfer and Lease)

When the owners transfer or lease the property, they must take this Convention as an annex to the property transfer contract or lease contract. After the owner transfers or leases the property, the parties concerned shall inform the property management enterprise in writing of the transfer or lease of the property and the communication method. And shall meet the following requirements:

(a) the rental of residential houses shall abide by the laws, regulations and policies of the state and this Municipality concerning the rental of houses, respect social morality, and shall not endanger the safety of residential properties or harm the legitimate rights and interests of other owners. Whether renting or subletting, the owners should bear the corresponding responsibilities.
