Rule three. Construction preparation and responsibilities of both parties

1, Party A's responsibility.

(1) Before the commencement of construction, Party A shall coordinate all aspects and complete the mobilization procedures, and Party A shall undertake the mobilization procedures.

(2) Organize design disclosure and the blue prints.the design work.

(3) Being entrusted as the representative of Party A to supervise the quality and progress of the project and handle the daily affairs of the project on behalf of Party A. ..

(4) Before commencement 1 day, Party A shall vacate the decoration site for the commencement of the project.

(5) Supply materials and equipment provided by Party A; Implement the construction funds, declare and pay the project advance payment on schedule, handle the on-site visa and complete the acceptance.

2. Party B's responsibilities.

(1) Provide complete construction drawings and construction technical data.

(2) Organize relevant personnel to be familiar with the construction drawings and design data, prepare the construction drawing budget and construction organization plan, and formulate the overall construction plan.

(3) Prepare for construction and organize mobilization, procurement, supply and management of personnel, materials and facilities.

(4) Carry out the construction in strict accordance with the construction drawings and instructions, ensure the quality of the project, complete the delivery on schedule according to the time stipulated in the contract, and undertake the relevant provisions of the maintenance agreement agreed by both parties. Article 4? Project price and payment

Article 5? Construction quality and design changes

(1) If the design is found to be wrong or seriously unreasonable, after Party B notifies Party A, Party A shall negotiate with the design unit within three days, issue a design modification document, and start work only after both parties sign an agreement.

(2) When the design change exceeds the original design standard or scale, Party A must re-submit it for approval according to the examination and approval procedures, and construction can only start after both parties sign an agreement.

(3) Due to insufficient investment of Party A, the project progress payment cannot be allocated in time, which leads to the project shutdown or delay. Both parties agree to put the project in progress in place safely, and Party A shall bear the economic losses of Party B. ..

2. If Party B encounters important and complicated concealed works, it can notify Party A for acceptance. If Party A can't attend on time, Party B can accept it by itself, and Party A will acknowledge it.

Article 6? Project completion acceptance and settlement

1. Party B shall notify Party A of acceptance in writing or orally before the completion of the project.

2. Party A shall organize the acceptance after receiving the acceptance notice, and issue the project acceptance certificate after passing the acceptance.

3. If Party A uses the project before acceptance, it shall be deemed that Party A has confirmed that the project is qualified. If quality problems are found after use, Party A shall bear the responsibility.

4. After the project is completed, Party B will provide free maintenance service for one year, but it does not include the damage caused by human factors.

Article 7? Project safety production and civilized construction

1. Party A shall make safety disclosure for the project undertaken by Party B, make clear the safety requirements, and conduct supervision and inspection. Both parties shall negotiate related safety production responsibilities and public security fire control matters according to regulations.

2. Party B must conscientiously implement the rules and regulations of safe production and civilized construction, do a good job in safety production and civilized construction education, strictly abide by the safety operation rules and civilized construction requirements, and strictly implement the public security fire control regulations.

3. In the process of project construction, if Party B's personnel suffer from work-related injuries and acute diseases, Party A has the obligation to provide convenience and assist in rescue, and the responsibility and expenses shall be borne by the responsible party.

Article 8? Engineering punishment and arbitration

1. If the construction period is delayed by one day according to the contract of this project, it will be punished according to two thousandths of the total project cost, and the construction period punishment will be settled at one time after the completion of this project. If one party breaches the contract, the breaching party shall bear the penalty of 30% of the contract price.

2. If Party A delays the settlement and payment, it shall be implemented according to the current relevant national regulations.

3. In case of any contract dispute during the execution of this contract, both parties shall settle it through negotiation in time. If the coordination fails, either party shall apply to the superior competent department or the construction competent department for mediation.
