New Provisions on Decoration Deposit 20 19

Article 53 of the Regulations on Property Management in People's Republic of China (PRC) stipulates that if the owner needs to decorate the house, he shall inform the property management enterprise in advance, and the property management enterprise shall inform the owner of the prohibited acts and precautions in the house decoration. This means that the property company only has the obligation to inform, and the law does not give it the right to collect the decoration deposit. In addition, the new provisions of decoration deposit 20 19 also include the following contents:

1, decoration deposit charge subject

The decoration deposit is the building where the house is decorated, and the property management company is responsible for the supervision and maintenance of the public facilities in the community. In order to ensure that there will be no sabotage during the renovation period, it is beneficial to collect a certain deposit for the development of property work.

2, decoration deposit payment subjects

The main body that pays the decoration deposit is the decoration party, but the decoration party also includes the owner and the construction party. Usually, the decoration deposit payer we refer to refers to the decoration owner.

3. Decoration deposit agreement

The law does not clearly stipulate the standard of paying the decoration deposit, so when the owner and the property management company sign the decoration management service agreement, they should make a clear agreement on the payment, use and deduction of the fee content to avoid the lack of basis for future disputes.
