Regulations of Shanwei Municipality on the Classification and Management of Urban and Rural Domestic Waste

Article 1 In order to standardize the classified management of urban and rural domestic waste, protect and improve the urban and rural environment, and promote the construction of ecological civilization and social civilization, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of Urban Appearance and Environmental Sanitation and other laws and regulations, and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the classified delivery, collection, transportation, treatment, supervision and management of urban and rural domestic waste within the administrative area of this Municipality. Article 3 The classified management of urban and rural domestic waste shall follow the principles of government promotion, overall planning of urban and rural areas, territorial management, participation of the whole people, suiting measures to local conditions and simplicity, and implement the reduction, recycling and harmless control and management of domestic waste. Article 4 The municipal and county people's governments shall incorporate the classified management of urban and rural domestic waste into the national economic and social development plan, strengthen and co-ordinate the capacity building of classified management of domestic waste, coordinate and solve major problems in classified management of domestic waste, ensure capital investment, and incorporate the required funds into the fiscal budget at the corresponding level.

The Town People's Government and sub-district offices shall be responsible for the daily management of domestic waste classification within their respective jurisdictions, and guide villagers' committees and residents' committees to organize the delivery and collection of domestic waste classification. Article 5 The municipal and county-level city appearance and environmental sanitation departments shall be responsible for the comprehensive coordination, inspection, guidance, supervision and management of domestic waste classification, innovate the management methods of domestic waste classification, strengthen the skills training of domestic waste classification staff, and promote the intelligent and professional development of domestic waste classification.

The competent department of housing and urban and rural construction is responsible for urging the property service enterprises to fulfill the responsibility of domestic waste classification management, and incorporate the requirements of domestic waste classification management in residential quarters into the preliminary property service contract and the model text of the property service contract.

The competent department of ecological environment shall be responsible for the guidance and supervision of pollution prevention and control of domestic garbage disposal, and supervise and manage the collection, utilization and disposal units of hazardous wastes.

The competent agricultural and rural authorities are responsible for guiding the classification of rural domestic waste and the construction of a long-term mechanism for village cleaning, and bringing the classification management of rural domestic waste into the improvement of rural living environment.

The competent department of commerce shall be responsible for the construction of the recycling system of renewable resources, and guide and manage the recycling of renewable resources.

Development and reform, education, finance, natural resources, market supervision, culture, radio, film and television, tourism, sports, health, government service data management, transportation, supply and marketing and other relevant departments, coordinate and do a good job in the classified management of urban and rural domestic waste according to the division of responsibilities, and guide and supervise the units in this industry to do a good job in the classified management of domestic waste. Sixth villagers' committees and residents' committees shall assist the government and its relevant departments to do a good job in the management of domestic waste classification, and mobilize, guide and urge the units and individuals within their respective jurisdictions to carry out domestic waste classification activities in accordance with the provisions.

Encourage villagers' committees and residents' committees to incorporate the classification requirements of domestic waste into village regulations and residents' conventions. Seventh domestic waste classification management should rely on Shanwei map of people's feelings, implement the responsibility of territorial management, and realize comprehensive dynamic control and accurate comprehensive management.

Town People's Government and subdistrict offices shall incorporate the classified management of urban and rural domestic waste into the grass-roots social governance system and implement grid management. Article 8 The municipal and county people's governments and their relevant functional departments, the town people's governments and sub-district offices shall popularize the knowledge of domestic waste classification to the public, enhance the public's awareness of classification, and advocate a green and healthy lifestyle.

Radio, television, newspapers, periodicals, internet and other media should publicize the classification of domestic waste for public welfare, and strengthen the guidance and supervision of public opinion. Ninth units, families and individuals should establish awareness of environmental protection, consciously abide by the provisions of reducing domestic garbage, classified into domestic garbage, and bear the responsibility of domestic garbage producers.

State organs, institutions, state-owned enterprises, social organizations, etc. It should play a leading role in the classification of domestic waste.

Environmental sanitation, property management, e-commerce, recycling of renewable resources, tourism, catering, hotels, express logistics and other industry associations. Domestic waste classification requirements should be incorporated into industry self-discipline norms, and member units should be guided and urged to do a good job in domestic waste classification.

Encourage units and individuals to participate in the classification, recycling and harmless treatment of domestic waste through donations and voluntary services. Article 10 The people's governments at the municipal and county levels shall make overall plans for the actual development of urban and rural areas, formulate differentiated charging methods for domestic garbage disposal, and announce them to the public.

Units, families and individuals that produce domestic garbage shall pay the domestic garbage disposal fee in accordance with the regulations. Eleventh people's governments at the city and county levels can implement market-oriented services according to the actual situation, and encourage and guide social capital to participate in the construction and operation of classified delivery, collection, transportation, treatment and recycling of urban and rural domestic waste. Twelfth city and county people's governments shall make outstanding contributions to the classification of domestic waste units and individuals, in accordance with the provisions of the reward.

The Town People's Government and the subdistrict offices shall establish an incentive mechanism for the classified delivery of domestic garbage, and mobilize the enthusiasm of units and individuals within their jurisdiction to deliver domestic garbage in accordance with the provisions through gift exchange and material rewards. Thirteenth domestic garbage should be divided into four categories: recyclable garbage, kitchen garbage, harmful waste and other garbage.

The Municipal People's Government shall, according to the classification standards of domestic waste, formulate and publish the guiding catalogue of domestic waste classification, and make timely adjustments according to the level of economic and social development, the characteristics of domestic waste and the treatment needs.
