Chapter VI of Anhui Property Management Regulations

One of the following acts shall be punished in accordance with the Regulations of the State Council Municipality on the Administration of Municipal Property:

(a) the residential property construction unit fails to select the prophase realty service enterprise through bidding or employs the prophase realty service enterprise through agreement without approval;

(two) to dispose of the ownership or use right of the property parts, facilities and equipment belonging to the owners without authorization;

(3) Failing to hand over relevant information;

(four) engaged in property services without obtaining the qualification certificate;

(five) the construction unit in the property management area is not in accordance with the provisions of the allocation of property services;

(six) the realty service enterprise employs persons who have not obtained the professional qualification certificate of realty management to engage in realty management activities;

(seven) misappropriation of special maintenance funds;

(eight) without the consent of the owners' meeting, the property service enterprise changes the purpose of the property service house without authorization.

In violation of the provisions of the second and eighth items of the preceding paragraph, if there is income, the income will be used for the maintenance of facilities and equipment in the * * * part of the property and the property management area, and the rest will be used according to the decision of the owners' meeting. In violation of the provisions of Item 1 and Item 2 of Paragraph 1 of Article 68 of this Ordinance, if the property owner or user commits one of the following acts, the real estate administrative department of the people's government at or above the county level shall order it to make corrections within a time limit, restore to the original state, and may be punished in accordance with the following provisions; If losses are caused to others, the responsible person shall compensate according to law:

(a) the demolition of housing load-bearing structure, punishable by a fine of fifty thousand yuan and one hundred thousand yuan;

(two) occupy the * * * part of the house and the public * * * site, and impose a fine of 5000 yuan to 50000 yuan for individuals and 50000 yuan to 0/00000 yuan for units; If the circumstances are serious, the individual shall be fined more than 5,000 yuan 1 10,000 yuan, and the unit shall be fined more than110,000 yuan150,000 yuan;

(three) damage to facilities and equipment, punishable by a fine of ten thousand yuan.

In violation of the provisions of the fourth paragraph of article sixty-eighth, the owners' committee shall coordinate the handling of the house without authorization; If the coordination fails, the real estate administrative department of the people's government at or above the county level shall, jointly with the relevant administrative departments of planning, industry and commerce, environmental protection and city appearance, order it to make corrections within a time limit and restore to its original state; If the circumstances are serious, the real estate administrative department of the people's government at or above the county level shall impose a fine of more than 5,000 yuan and less than 20,000 yuan. In violation of the provisions of this Ordinance, the people's governments at or above the county level real estate administrative departments, street offices, Township People's governments or other relevant administrative departments and their staff in any of the following circumstances, the relevant administrative organs shall order them to make corrections; The directly responsible person in charge and other directly responsible personnel shall be punished according to law:

(1) illegally interfering with the establishment of the owners' assembly or owners' committee by the owners;

(two) failing to prepare and organize the owners' meeting in accordance with the provisions of these regulations;

(three) the illegal implementation of property management administrative license;

(four) in violation of the provisions of the property management complaint handling;

(5) Failing to deal with violations in time after discovering them or receiving reports of violations;

(six) there are other acts such as abuse of power, favoritism, dereliction of duty.
