Regulations of Guigang Municipality on the Administration of Fireworks and Firecrackers

Article 1 In order to reduce environmental pollution and ensure the safety of the public, people and property, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and related supervision and management within the administrative area of this Municipality. Article 3 The supervision and management of fireworks and firecrackers shall follow the principles of education and guidance, strict control, safety and environmental protection. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership over the management of fireworks and firecrackers, establish a coordination mechanism for the management of fireworks and firecrackers, and solve major problems in the management of fireworks and firecrackers.

Township people's governments and sub-district offices shall, in light of the actual situation in their respective jurisdictions, organize and carry out relevant work on the management of fireworks and firecrackers.

Residents' committees, villagers' committees, industrial park management agencies, property service enterprises, etc. shall assist in the management of fireworks and firecrackers in this management service area. Fifth public security organs are responsible for the management of fireworks and firecrackers, and undertake related coordination work.

Emergency management, ecological environment, housing and urban and rural construction, urban management and supervision, civil affairs, education, market supervision and management, meteorology and other competent departments shall, in accordance with their respective responsibilities, do a good job in the management of fireworks and firecrackers. Article 6 People's governments at all levels and relevant departments shall strengthen the publicity and education of fireworks and firecrackers according to law, and guide the public not to set off or set off less fireworks and firecrackers in other areas and places other than those where fireworks and firecrackers are prohibited.

State organs, social organizations, enterprises, institutions and other organizations shall conduct publicity and education on the discharge of fireworks and firecrackers according to law for their own staff.

Radio, television, newspapers, internet and other media should carry out public welfare propaganda of setting off fireworks and firecrackers according to law.

Schools and guardians of minors shall publicize and educate minors about setting off fireworks and firecrackers according to law.

Encourage social organizations and volunteers such as environmental protection to participate in volunteer service activities of fireworks and firecrackers. Seventh any unit or individual has the right to report the illegal discharge and operation of fireworks and firecrackers to the public security organs and emergency management departments, and the departments that accept the reports shall deal with them in time; If it is not within the scope of duties, it shall be handed over to the competent department in a timely manner. Article 8 Fireworks and firecrackers are prohibited in the areas within the East Ring Road, South Ring Road, West Ring Road and North Ring Road of this Municipality.

The areas where fireworks and firecrackers are prohibited in Guiping City and Pingnan County shall be determined and announced by the local people's governments at the county level.

City, county (city) people's government may, according to the needs of fireworks management, adjust the area where fireworks are prohibited, and make an announcement to the public. Article 9 Fireworks and firecrackers are prohibited in the following places outside the areas specified in Article 8 of these Regulations:

(a) cultural relics protection units;

(2) Transportation hubs such as stations, docks and airports and railway line safety protection zones;

(3) Units producing and storing inflammable and explosive articles and oil and natural gas pipeline safety protection zones;

(4) Within the safety protection zone of power transmission and transformation facilities;

(5) Medical institutions, kindergartens, schools and nursing homes;

(six) key fire prevention areas such as mountains and grasslands;

(seven) office areas, industrial parks and grain warehouses of state organs and institutions;

(eight) public cultural sites, religious activities and other crowded places;

(nine) other places where fireworks and firecrackers are prohibited as prescribed by the people's government of the city or county (city or district).

The public security organ shall set up obvious warning signs prohibiting the discharge of fireworks and firecrackers in the places prohibited by the preceding paragraph. Tenth during the period of heavy pollution, it is forbidden to set off fireworks and firecrackers within the administrative area of this Municipality.

The Municipal People's Government shall timely release early warning information on heavy polluted weather to remind the public not to set off fireworks and firecrackers during this period.

This Ordinance does not stipulate the areas and places where fireworks and firecrackers are prohibited. If it is necessary to prohibit the discharge of fireworks and firecrackers during moderately polluted weather, it shall be decided and announced by the Municipal People's Government. Eleventh in areas and places where fireworks are prohibited, the following provisions shall be observed:

(a) shall not throw fireworks to pedestrians, vehicles, buildings and structures;

(two) shall not hinder the safe passage of pedestrians and vehicles and affect traffic order;

(three) without administrative permission, no professional fireworks shall be set off;

(four) shall not endanger public safety and personal and property safety by other means. Twelfth in the area where fireworks are prohibited, fireworks business activities are not allowed. Thirteenth operators engaged in the sale of fireworks and firecrackers should inform buyers not to set off fireworks and firecrackers in areas, places and time periods where fireworks and firecrackers are prohibited during the sales process. Article 14 In areas where fireworks and firecrackers are prohibited, operators engaged in wedding, funeral and festive etiquette services shall inform customers of the relevant provisions prohibiting fireworks and firecrackers, and shall not provide them with fireworks and firecrackers services. Article 15 In areas where fireworks and firecrackers are prohibited, operators providing banquet services shall inform banquet organizers of the relevant provisions prohibiting fireworks and firecrackers before providing services, and discourage illegal fireworks and firecrackers in banquet activities; If dissuasion is ineffective, it shall report to the public security organ in time.
