Sichuan Provincial Communications Administration issued the Measures for the Administration of Communication Facilities of Residential Buildings in Sichuan Province (for Trial Implementation) (hereinafter referred to as the Measures).
The Measures defines the scope of communication facilities in residential buildings, including communication pipes and wiring equipment within the red line of planned land for residential buildings, pipe troughs, communication cables and wiring equipment in residential buildings, household junction boxes, indoor pipes and various communication business information sockets, as well as installation space reserved for equipment such as computer rooms and telecommunications rooms. According to the relevant national policies, regulations and construction specifications, the right to use communication facilities in residential buildings in our province is put forward according to the time point, and it is clear that FTTH facilities in residential buildings that started construction in June 12 and communication facilities in residential buildings that started construction on June 15, 2007 belong to all owners of residential buildings and are used free of charge by all telecom business enterprises; Before these two time points, the corresponding communication facilities and FTTH facilities invested in the renovation of residential buildings are owned by investors, but they should be open to enterprises in need and used by enterprises in need for compensation, and telecom service enterprises are encouraged to implement FTTH renovation of residential buildings without FTTH facilities except new residential buildings. At the same time, the Measures also put forward the procedures for the use and withdrawal of communication facilities in existing residential buildings and renovated residential buildings, and stipulated the behavior of basic telecom operators and broadband user residential network operators to use communication facilities in residential buildings.
The "Measures" point out that no enterprise or individual may interfere with or influence users' free choice of telecom service enterprise business, and no enterprise or individual may interfere with or influence telecom service enterprises' access to communication facilities in residential buildings, and may not sign exclusive agreements with residential building developers, property management enterprises and owners' committees.
The promulgation of the "Measures" is conducive to standardizing the construction and use of communication facilities in residential buildings in our province, ensuring the rights and interests of users to freely choose telecom services, ensuring equal access rights for basic telecom operators and broadband users' resident network operators, and standardizing the market order of communication construction.
