There are two situations when the property contract expires. One is that the owners' committee has not been established in the community, and the residents have no objection to the property management, so the property contract naturally continues to meet the requirements. There is an owners' committee in the community. If the property contract expires, the extension of the contract period must be approved by the owners' committee. The owners' committee can decide whether to continue to use the property company on behalf of the owners. If it is replaced, the contract cannot be extended.

According to the different stages of service provision, it can be divided into prophase realty service contract and realty service contract. The former refers to the contract signed by the construction unit and the property service enterprise it selects before the property sales.

The latter refers to the contract signed by the owners' committee and the property company selected by the owners' congress when the property sold and delivered by the construction unit reaches a certain amount. When the realty service contract signed by the owners' committee and the realty service enterprise takes effect, the prophase realty service contract is terminated.

Article 949 of the Civil Code: If the property service contract is terminated, the original property service provider shall withdraw from the property service area within the agreed time limit or within a reasonable time limit, return the property service premises, related facilities and relevant materials necessary for the property service to the owners' committee, the owners who decide to manage themselves or their designated persons, cooperate with the new property service provider to do a good job of handover, and truthfully inform the use and management of the property.

If the original property service provider violates the provisions of the preceding paragraph, the owner shall not be required to pay the property fee after the termination of the property service contract; If losses are caused to the owner, it shall compensate for the losses.

Article 950 of the Civil Code: After the termination of the property service contract, the original property service provider continues to handle the property service matters, and may require the owners to pay the property fees for the period before the owners' congress or the new property service provider selected by the owners' congress or the owners who decide to manage themselves take over.
