Chapter I General Provisions
Article 1 In order to standardize the property management behavior, safeguard the legitimate rights and interests of owners, users and property management enterprises, ensure the rational use of property, and create a safe, clean, civilized and comfortable living environment for residents, these Regulations are formulated in accordance with the relevant national laws and regulations and combined with the actual situation of this province.
Article 2 The term "property" as mentioned in these Regulations refers to houses and their ancillary facilities, equipment and related sites in residential areas. The term "property management" as mentioned in these Regulations refers to the activities that the owners (owners' committee) entrust the property management enterprises to repair, conserve and manage the property and provide related services. The term "owner" as mentioned in these Regulations refers to the owner of the property. The term "user" as mentioned in these Regulations refers to the user who is not the owner. The term "property management enterprise" as mentioned in these Regulations refers to an organization established according to law, which can independently bear civil liability and engage in property management and services.
Article 3 These Regulations shall apply to the property management of urban residential areas within the administrative area of this province. Encourage the implementation of property management in new residential areas and old urban residential areas with relatively complete supporting facilities. Old residential areas with incomplete supporting facilities shall be rectified by the local people's government to create conditions for the gradual implementation of property management. Article 4 Property management can adopt various management modes such as property company management and owner self-management. Encourage property management to develop in the direction of socialization, specialization and marketization, and improve the level of property management.
Fifth provincial people's government construction administrative department is the administrative department of property management in the province. City, county (city, district) property management departments determined by the people's government at the same level. The relevant departments of the people's governments at all levels shall, in accordance with their respective responsibilities, be responsible for the relevant work within the property management area.
Chapter II Owners, Owners' Congress and Owners' Committee
Article 6 Rights of the Owner:
(a) to participate in the owners' meeting and enjoy the right to vote;
(two) the right to vote and be elected as a member of the owners' committee;
(three) to supervise the work of the owners' committee and the service activities of the property management enterprise, and have the right to express opinions on the service activities;
(four) according to the requirements of the contract to obtain the corresponding services and other rights;
(five) other rights stipulated by laws, regulations and rules.
Article 7 Obligations of the Owner:
(a) abide by the laws, regulations and rules of property management;
(two) the implementation of the owners' convention and the relevant resolutions and decisions of the owners' congress and the owners' committee.
(three) in accordance with the property management contract to pay the property management service fee on time;
(four) correctly handle the adjacent relations of water supply, drainage, transportation, communication, ventilation, lighting, maintenance, decoration, environmental sanitation and so on;
(five) other obligations stipulated by laws, regulations and rules.
Article 8 The owners' congress is composed of all owners in the property management area. If there are a large number of owners, the owners' representatives can be elected in proportion to form the owners' congress (hereinafter referred to as the owners' congress and the owners' congress). The regional scope of property management in each residential area shall be delineated by the municipal or county (city, district) property management department in accordance with the relevant provisions of the provincial property management department.
Article 9 The owners' congress shall perform the following duties:
(1) Electing or replacing members of the owners' committee;
(two) to review and approve or amend the owners' convention and the articles of association of the owners' committee;
(three) to supervise the work of the owners' committee, listen to and consider the work report and budget implementation report of the owners' committee, and change or cancel the inappropriate decisions of the owners' committee;
(four) discuss and decide on the property management contract;
(five) to decide on the hiring and dismissal of property management enterprises in the property management area and other major property management matters;
(six) to discuss and decide the positions and remuneration of full-time and part-time staff of the owners' committee.
Tenth residential property management, the owners' committee shall be established. City, county (city, district) property departments should guide the owners to hold the first owners' meeting.
Eleventh owners' meeting held at least once a year. More than half of the owners shall attend the owners' meeting. The decision of the owners' meeting shall be passed by more than two-thirds of the owners present at the meeting.
Twelfth owners can entrust an agent to attend the owners' meeting in writing. The owners' meeting after the first meeting shall be convened by the owners' committee. The owners' committee deems it necessary, or upon the proposal of more than 10% of the owners, it shall convene a owners' meeting to discuss matters within the scope of authority of the owners' meeting.
Thirteenth owners' committee is an autonomous organization of owners, which represents and safeguards the legitimate rights and interests of all owners in property management activities and is responsible to the owners' meeting. The civil liability of the owners' committee within the scope authorized by the owners' congress shall be borne by all owners.
Article 14 The owners' committee shall safeguard the rights and interests of owners and perform the following duties:
(a) to convene and preside over the owners' meeting and report on the implementation of property management;
(two) to draft the owners' convention, the articles of association of the owners' committee and the property management contract and report them to the owners' congress for examination and approval;
(3) Proposing plans for hiring or dismissing property management enterprises;
(four) in accordance with the relevant provisions of the state and the province, put forward the renewal plan of the maintenance fund for residential parts and facilities, and supervise the use of the maintenance fund by property management enterprises;
(five) to consider the major measures for the annual property management plan and management services formulated by the property management enterprise;
(six) to collect and reflect the opinions and suggestions put forward by the owners and users on property management, and to supervise and support the management service activities of property management enterprises;
(seven) the implementation of the relevant resolutions and decisions of the owners' congress;
(eight) to supervise and inspect the implementation of the owners' convention and the property management system;
(nine) other duties entrusted by the owners' congress.
Fifteenth a property management area can only set up a owners' committee. Members of the owners' committee shall generally be held by the owners within the property management area. According to the size of the property management area, the number of members of the owners' committee is generally composed of odd owners with more than 5 people. The chairman and deputy directors of the owners' committee shall be elected by the owners' committee. Members of the owners' committee shall serve for a term of two years and may be re-elected.
Article 16 The owners' committee shall convene a meeting according to the decisions and articles of association of the owners' congress. The meeting must be attended by more than half of the members, and the decision must be passed by two-thirds of all the members.
Seventeenth owners' committee to carry out activities required expenses, approved by the owners' congress, shall be borne by all owners.
Eighteenth owners' convention and the decisions made by the owners' congress shall be published in a timely manner and shall be binding on all owners and users. When the owners transfer or lease the property, they should regard the owners' convention as an annex to the transfer contract or lease contract, which is equally binding on the transferee or lessee. The new owner shall inform the owners' committee and the property management enterprise within 30 days after handling the handover procedures.
