Chapter I General Provisions

Article 1 In order to strengthen the fire safety management of high-rise civil buildings, prevent fires and reduce fire hazards, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and other laws and administrative regulations and the relevant provisions of the State Council.

Article 2 These Provisions shall apply to the fire safety management of high-rise civil buildings (including high-rise residential buildings and high-rise public buildings) built and put into use according to law.

Article 3 The fire safety management of high-rise civil buildings shall implement the policy of putting prevention first and combining prevention with elimination, and implement the responsibility system for fire safety.

High-rise civil buildings with a building height exceeding 100 meters should be subject to stricter fire safety management.

Chapter II Fire Safety Duties

Article 4 The owners and users of high-rise civil buildings are responsible for the fire safety of high-rise civil buildings. If the owner or user of a high-rise civil building is a unit, its legal representative or principal responsible person is the person in charge of fire safety of the unit.

Owners and users of high-rise civil buildings may entrust professional service units (hereinafter referred to as fire service units) such as property service enterprises or fire technical service institutions to provide fire safety services, and stipulate the specific contents of fire safety services in the service contract.

Article 5 If there are more than two owners and users of the same high-rise civil building, each owner and user shall be responsible for the fire safety of its exclusive part and jointly and severally liable for the fire safety of some areas.

If there are more than two owners and users of the same high-rise civil building, it shall entrust a realty service enterprise, or designate one owner and user as a unified manager to implement unified management of some fire safety, coordinate and guide the owners and users to do a good job in fire safety of the whole building, and stipulate the fire safety responsibilities of all parties in writing.

Article 6 Where a high-rise civil building is handed over to a contractor, lessee or manager for use by means of contracting, leasing or entrusted management, the parties concerned shall specify the fire safety responsibilities of all parties when concluding contracts such as contracting, leasing and entrusted management. The entrusting party and the lessor can coordinate and manage the fire safety work of the contractor, lessee and trustee in accordance with the law.

When contracting, leasing or entrusting management, owners shall provide buildings that meet the requirements of fire safety and urge users to strengthen fire safety management.

Article 7 The owners and users of high-rise public buildings shall perform the following fire safety duties:

(a) comply with fire laws and regulations, establish and implement the fire safety management system;

(two) clear fire safety management institutions or fire safety management personnel;

(three) organize fire inspection and patrol, eliminate fire hazards in time;

(four) to ensure that evacuation routes, safety exits, and fire engines are unblocked;

(five) regular inspection and maintenance of building fire facilities and equipment, to ensure that they are in good condition and effective;

(six) to organize fire prevention publicity and education training, formulate fire fighting and emergency evacuation plans, and organize regular fire drills;

(seven) in accordance with the provisions of the establishment of full-time fire brigade, volunteer fire brigade (micro fire station) and other fire organizations;

(eight) other fire safety duties as prescribed by laws and regulations.

Where a realty service enterprise is entrusted or a unified manager is determined to implement fire safety management, the realty service enterprise or unified manager shall perform the duties of fire safety specified in the preceding paragraph in accordance with the agreement, and the owners and users shall urge and cooperate with the realty service enterprise or unified manager to do a good job in fire safety.

Article 8 The owner, user, realty service enterprise or unified manager of a high-rise public building shall designate a special person as the fire safety manager to be responsible for the fire safety management of the whole building, and publicize his name, contact information and fire safety management responsibilities in a prominent position in the building.

The fire safety manager of high-rise public buildings shall perform the following duties of fire safety management:

(a) to formulate the annual fire control work plan and organize the implementation of daily fire safety management;

(two) to organize fire inspection, inspection and rectification of fire hazards;

(three) to organize the implementation of the maintenance of building fire control facilities and equipment;

(four) the management of full-time fire brigade, volunteer fire brigade (micro fire station) and other fire control organizations;

(five) the organization of fire safety publicity, education and training;

(six) to organize the preparation of comprehensive plans for fire fighting and emergency evacuation and conduct drills.

The fire safety manager of high-rise public buildings should have fire safety knowledge and management ability suitable for their duties. For high-rise public buildings with a building height exceeding 100m, relevant units are encouraged to employ registered fire engineers at corresponding levels or professional and technical personnel with intermediate level or above in related engineering as fire safety management personnel.

Article 9 The owners and users of high-rise residential buildings shall perform the following fire safety obligations:

(a) to comply with the fire safety matters agreed in the residential fire safety convention and management regulations;

(two) the use of buildings in accordance with the purposes stated in the certificate of ownership of immovable property;

(three) to cooperate with the fire service units to do a good job in fire safety;

(four) to bear the fire service fees and related expenses for the maintenance, renewal and transformation of building fire protection facilities according to law;

(five) to maintain fire safety, protect fire control facilities, prevent fires, report fires, and adults participate in organized fire fighting work;

(six) other fire safety obligations stipulated by laws and regulations.

Tenth entrusted high-rise residential property service enterprises shall perform the following fire safety duties according to law:

(a) the implementation of fire safety responsibility, formulate fire safety system, formulate annual fire safety work plan and organizational guarantee plan;

(two) clear specific departments or personnel responsible for fire safety management;

(three) regular inspection and maintenance of fire control facilities, equipment and fire signs in the management area to ensure that they are in good condition and effective;

(four) the organization of fire inspection and patrol, eliminate fire hazards in a timely manner;

(five) to ensure the smooth flow of evacuation passages, safety exits and fire truck passages, and to stop illegal acts such as encroachment, blockage and closure of evacuation passages, safety exits and fire truck passages; Stop invalid, timely report to the fire rescue agencies and other relevant administrative departments in accordance with the law;

(six) to urge the owners and users to fulfill their fire safety obligations;

(seven) regularly inform the owners' committee and the owners and users of the residential area, and remind them of the fire safety risks;

(eight) organize regular publicity and education on fire prevention;

(nine) to formulate fire fighting and emergency evacuation plans, and organize regular drills;

(ten) other fire safety responsibilities stipulated by laws and regulations and agreed in the contract.

Eleventh fire rescue agencies and other institutions responsible for fire supervision and inspection shall conduct fire supervision and inspection of high-rise civil buildings according to law, and urge owners, users and entrusted fire service units to implement fire safety responsibilities; Notify the relevant units or individuals to take immediate measures to eliminate the fire hazards found in the supervision and inspection.

Fire rescue agencies should strengthen the publicity of fire safety laws and regulations of high-rise civil buildings, supervise and guide relevant units to do a good job in fire safety publicity and education of high-rise civil buildings.

Twelfth villagers' committees and residents' committees shall organize the formulation of fire safety conventions according to law, conduct fire safety inspections on high-rise civil buildings, and assist the people's governments and relevant departments to strengthen fire prevention publicity and education; Carry out targeted fire prevention publicity and education for the elderly, minors and the disabled, and strengthen fire safety assistance.

Thirteenth water supply, power supply, gas supply, heating, communications, cable television and other professional operating units shall be responsible for the fire safety of the facilities and equipment in the high-rise civil buildings under their management, and conduct regular inspections and maintenance.

Chapter III Fire Safety Management

Article 14 During the construction of high-rise civil buildings, the construction unit shall clarify the fire safety responsibility of the construction site with the construction unit. During the construction period, the on-site preventive measures shall be strictly implemented, the fire-fighting equipment shall be equipped, and the fire-fighting isolation measures shall be taken, which shall not affect the safe evacuation of personnel in other areas and the normal use of building fire-fighting facilities.

The owners and users of high-rise civil buildings shall not change the use function of the building, change the fire prevention and smoke prevention zones without authorization, and use flammable and combustible decoration materials in violation of fire control technical standards.

Fifteenth high-rise civil building owners, users or property services companies, unified managers should implement strict fire safety management for the use of open fire operations, and shall not use open fire in places with fire and explosion hazards; If it is necessary to carry out open flame operations such as electric welding and gas welding due to special circumstances such as construction, it shall go through the formalities for examination and approval of hot work in accordance with the regulations, implement the on-site guardian, equip with fire-fighting equipment, and make an announcement in a prominent position at the main entrance of the building and the job site. Operators shall hold relevant certificates according to law, strictly abide by fire safety regulations, remove flammable and combustible substances around and below, and take fire prevention and isolation measures. After the operation is completed, a comprehensive inspection should be conducted to eliminate the residual fire.

Shopping malls and public entertainment places in high-rise public buildings are not allowed to carry out hot work during business hours.

In high-rise public buildings, no-fire areas and no-smoking areas should be determined, and obvious signs should be set up.

Article 16 The installation and use of electrical equipment in high-rise civil buildings, as well as the laying, maintenance and testing of its lines, shall conform to the technical standards and regulations on fire control.

The owners, users or fire service units of high-rise civil buildings shall arrange professional institutions or electricians to regularly inspect the electrical equipment and lines in their management areas; Do not meet the safety requirements, it should be repaired and replaced in time.

Article 17 The installation and use of gas appliances and the laying, maintenance and testing of pipelines in high-rise civil buildings shall conform to the technical standards and management regulations for fire control. It is forbidden to install, modify or dismantle gas equipment and appliances without authorization in violation of the provisions on safe use of gas.

The use of gas in high-rise civil buildings should use pipeline gas supply. It is forbidden to use liquefied petroleum gas in the underground part of high-rise civil buildings.

Article 18 It is forbidden to produce, store and deal in Class A and Class B fire dangerous goods in high-rise civil buildings in violation of state regulations.

Nineteenth high-rise civil buildings with external insulation system, the management unit shall set up tips and warning signs at the main entrance and its surrounding relevant prominent positions, indicating the combustion performance and fire prevention requirements of external insulation materials. If the external thermal insulation system of the external wall of a high-rise civil building is damaged, cracked or falls off, it shall be repaired in time. During the construction of the external wall thermal insulation system of high-rise civil buildings, the construction unit shall take necessary fire prevention and isolation measures and measures to limit occupation and use to ensure the safety of personnel in the building.

It is forbidden to use flammable and combustible materials as external thermal insulation materials for external walls of high-rise civil buildings. It is forbidden to set off fireworks and firecrackers in its buildings and surrounding forbidden areas; It is forbidden to pile combustible materials around its external wall. For high-rise civil buildings that use flame-retardant external thermal insulation materials or external thermal insulation systems with cavities between the main wall and the decorative layer, it is forbidden to use electricity when the external wall is in fire.

Twentieth high-rise civil buildings, such as cable wells, tube wells and other vertical tube wells and cable bridges should be blocked by fire on each floor, and tube well inspection doors should be fire doors.

It is forbidden to occupy cable wells and tube wells, or pile up sundries in vertical tube wells such as cable wells and tube wells.

Twenty-first outdoor billboards and exterior decoration of high-rise civil buildings shall not use flammable and combustible materials, shall not interfere with smoke control, fire fighting and rescue, and shall not change or destroy the fire prevention structure of the building facade.

It is forbidden to set obstacles that affect escape and fire fighting and rescue in the external windows of high-rise civil buildings.

Decorations and billboards on the external walls of high-rise civil buildings with a building height of more than 50 meters shall be made of non-combustible materials and easy to dismantle.

Twenty-second it is forbidden to set up structures, parking berths, fixed isolation piles and other obstacles in the fire truck passage and fire truck climbing operation site.

It is forbidden to set overhead pipelines, billboards, decorations and other obstacles that hinder the operation of fire engines above the passage of fire engines and on the working surface of climbing.

Twenty-third high-rise public buildings catering business units shall timely clean the kitchen stoves and fume hoods, and check and clean the smoke exhaust pipes at least once every quarter.

High-rise residential buildings and public smoke exhaust pipes should be inspected regularly and fire prevention measures should be taken.

Twenty-fourth in order to meet the use function of high-rise civil buildings, it is forbidden to set up warehouses other than temporary warehouses, archives and reference rooms for personal use in high-rise civil buildings.

The affiliated storerooms of high-rise civil buildings shall take corresponding fire separation measures and strictly abide by the relevant fire safety management regulations.

Twenty-fifth boiler room, power distribution room, air conditioning room, self-provided generator room, oil storage room, fire pump room, fire water tank room, smoke exhaust fan room and other equipment rooms. In high-rise civil buildings, it should be set according to the technical standards for fire control, identified as the key parts of fire safety, set up obvious fire signs, and strictly manage them, and shall not occupy or pile up sundries.

Twenty-sixth high-rise civil building fire control room should be implemented by the management unit 24-hour duty system, each class should not be less than 2 people on duty.

The operator on duty in the fire control room shall obtain the corresponding professional qualification certificate for special jobs in the fire protection industry according to law, master the fire alarm processing procedures and requirements, and check the operation of automatic fire control facilities and linkage control equipment in accordance with relevant regulations to ensure that they are in normal working condition.

The fire control room shall keep high-rise civil construction site plan, floor plan, fire control facilities system diagram and control logic description, building fire control facilities maintenance records and test reports.

Article 27 The relevant units in high-rise public buildings, community neighborhood committees where high-rise residential buildings are located or property service enterprises shall set up full-time fire brigades, volunteer fire brigades (mini-fire stations) and other fire-fighting organizations in accordance with regulations, which shall be equipped with necessary personnel, places, equipment and equipment, conduct regular fire-fighting skills training and drills, carry out fire-fighting inspection and fire-fighting publicity, and timely handle and put out initial fires.

Twenty-eighth high-rise civil buildings, evacuation routes and safety exits should be kept clear, and it is forbidden to pile up articles, block exits and set obstacles. Evacuation doors that need to control people's access or have access control system at ordinary times should be easy to open in case of fire, and eye-catching tips and use signs should be set at prominent positions on the site.

Normally closed fire doors in high-rise civil buildings should be kept normally closed, and components such as door closers and sequencers should be intact and effective; Normally open fire doors should ensure that they automatically close in case of fire and feedback signals.

It is forbidden to occupy or block fire hydrants, to pile up sundries in fire hydrant box, and to pile up articles under fire shutters.

Twenty-ninth high-rise civil buildings should indicate the location of the refuge floor (room) in a prominent position.

It is forbidden to occupy the refuge floor (room) and refuge floor walkway of high-rise civil buildings or pile up sundries, and it is forbidden to lock the entrances and exits of refuge floor (room) and refuge floor walkway.

Article 30 The owners and users of high-rise public buildings shall be equipped with fire fighting equipment, self-rescue breathing apparatus, escape descent device, escape rope and other escape and evacuation facilities and equipment in accordance with national standards and industry standards.

High-rise residential buildings should be placed in a prominent position in public areas, and equipped with self-help breathing apparatus, escape ropes, rescue columns, evacuation flashlights and other escape and evacuation facilities and equipment.
