Interim Provisions of Fushun Municipality on Property Management of Urban Residential Quarters
The term "property management" as mentioned in these Provisions refers to the maintenance, repair and management of all kinds of houses and supporting public facilities, equipment, venues, greening, roads, environmental sanitation and public order in residential areas by property management enterprises.
The term "household" as mentioned in these Provisions refers to the owners and users of all kinds of houses in residential areas. Fourth new residential areas in the city must implement property management, and residential areas that have been delivered for use should create conditions to gradually implement property management. The fifth municipal people's government real estate administrative departments in charge of urban residential property management, the main responsibilities are:
(a) to formulate the relevant provisions on the property management of residential quarters;
(two) to organize, coordinate and guide the property management of residential quarters from a macro perspective;
(three) to supervise and inspect the management services of residential area management committees and property management enterprises;
(four) to be responsible for the qualification examination, rating, issuance and annual inspection of property management qualification certificates of property management enterprises;
(five) to participate in the comprehensive acceptance of residential quarters, and be responsible for organizing the takeover of new residential quarters;
(six) to organize the activities of creating excellence in residential areas;
(seven) responsible for the training of residential property management personnel. Article 6 The District People's Government and the administrative departments of planning, urban construction, transportation, health, post and telecommunications, power supply, industry and commerce, price, public security, fire protection, water supply, heat supply and gas (hereinafter referred to as professional administrative departments) shall cooperate with the real estate administrative departments to do a good job in the property management of residential quarters. Article 7 Residents of residential areas have the right to participate in the property management of residential areas, and have the obligation to rationally use houses and public facilities and maintain and observe public order in residential areas. Chapter II Construction and Handover of Residential Quarters Article 8 The planning and design of residential quarters shall conform to the Code for Planning and Design of Urban Residential Quarters in People's Republic of China (PRC) and relevant regulations, and municipal public infrastructure and supporting facilities such as roads, pipelines, public green spaces, kindergartens, parking lots, culture and sports, commercial services, health and fire fighting shall be planned and designed in accordance with its regulations. Its allocation and construction level should correspond to the size of the permanent population, and it should be planned, built and put into use at the same time as the residence. Ninth residential planning and design, must be approved by the municipal planning administrative department in conjunction with the relevant departments. Residential quarters must be built in accordance with the approved planning and design scheme. Tenth municipal construction administrative departments, municipal development office and municipal planning administrative departments shall manage and supervise the construction of residential quarters. Eleventh real estate development and construction units in the construction of residential areas, should be strictly in accordance with the design standards, and shall not arbitrarily change the planning and design. If it is really necessary to make some changes, it must be approved by the municipal planning administrative department, and the opinions of the relevant departments shall be sought during the examination and approval. Twelfth after the completion of residential areas, the Municipal Development Office shall organize relevant departments to conduct comprehensive acceptance in accordance with relevant national, provincial and municipal standards. The completion and acceptance of residential quarters must meet the following requirements:
(a) the construction project is completed in accordance with the approved residential planning and relevant professional management requirements, and meets the use requirements;
(two) residential and municipal public infrastructure, public facilities and individual projects all passed the acceptance, and the acceptance information is complete;
(three) the plane position, facade shape and decorative color of all kinds of buildings meet the approved planning and design requirements;
(4) All construction machines and tools, temporary works, residual soil and components of buildings have been dismantled and transported away, and the site has been cleared and leveled.
Residents can only be allocated after the comprehensive acceptance of residential areas. Thirteenth residential development and construction units shall, six months before the residents move in, entrust property management companies to carry out preliminary management of residential areas, and the management expenses shall be borne by the development and construction units. Fourteenth residential areas after the completion of comprehensive acceptance, the construction unit with residential acceptance procedures, to the real estate administrative departments to apply for transfer management procedures.
When two or more construction units jointly build a residential community to handle the handover management procedures, the larger units in the community shall take the lead in handling the handover management procedures. Fifteenth residential transfer management, the construction unit shall hand over the following information related to residential construction to the CMC or the early management unit:
(a) residential area plan, the completion of the general plan;
(two) the completion of housing equipment and supporting facilities;
(3) Underground pipe network diagram;
(4) List of various houses in residential quarters;
(five) the property ownership and cost accounting list of the house for sale;
(6) List of public facilities, equipment and sites in residential quarters;
(seven) other information that needs to be provided.
