Notice on Standardizing Housing Occupancy Fee

In recent years, with the development of the real estate industry in our province, the level of residential consumption has been greatly improved. However, when residents check in, some development and construction units and property service enterprises in some areas charge or collect part of the construction supporting fees in addition to the sales price of commercial housing, and charge property fees without legal procedures, which has aroused great repercussions from the masses. In order to further standardize the behavior of commercial housing occupancy charges, safeguard the legitimate rights and interests of buyers, and promote the healthy development of the real estate industry, according to the spirit of the Work Plan for Special Renovation of Real Estate Transaction Order (J.J. [2006] No.216) issued by the Ministry of Construction, the National Development and Reform Commission and the State Administration for Industry and Commerce, the relevant policies on housing occupancy charges in our province are hereby clarified as follows:
The first is to standardize the charges for construction projects. Construction project fees (including administrative fees and operating service fees) shall be subject to examination and approval at the central and provincial levels (excluding cities with separate plans). Construction projects that have not been approved by legal procedures shall not be charged to development enterprises. All construction project costs paid by the commercial housing development and construction unit to the relevant departments in accordance with the regulations shall be included in the cost of commercial housing, and it is strictly forbidden to charge buyers outside the sales price of commercial housing.
Two, standardize the construction costs of commercial housing ancillary facilities. The construction cost of ancillary facilities is an integral part of the construction cost of commercial housing and must be included in the sales price of commercial housing. It is strictly forbidden to charge the buyer the fees for monitoring facilities such as intercom doors and intercom systems, security doors, price difference between doors and windows, gas alarm fees, leakage protector fees, communication facilities fees, electricity meter fees, water meter fees, gas meter fees, heat meter fees, corridor lights fees, mailbox fees and other supporting facilities construction fees.
Third, regulate the charging behavior of monopoly enterprises. Standardize the charging behavior of monopoly enterprises such as gas, tap water, electricity, telephone, cable or cable TV (referred to as "two pipes and three lines") in housing development and construction. The installation cost of "two pipes and three lines" should be included in the cost of commercial housing development and construction, and shall not be charged to the buyers separately from the sales price of commercial housing.
Fourth, standardize the special requirements of property buyers. According to the special requirements of property buyers, the development enterprise and the property buyers have agreed in the house purchase and sale agreement that additional supporting facilities and other engineering quantities can be charged in addition to the sales price of commercial housing.
Five, standardize the property charges. Property management companies in the process of housing occupancy, must be strictly in accordance with the relevant provisions of the local price department to collect property service fees, shall not be charged without authorization.
Six, standardize the price tag and charge publicity system. Real estate development and business units shall publicize or inform the relevant information about the price of a single set of housing in a conspicuous position at the sales site, and implement "one suite, one price". When handling the house occupancy, the charging unit must publicize the approved charging items, charging standards, service contents, service standards and the document basis for approving the charging, and accept social supervision.
Seven, strengthen the management of license fees. The charging device should reach the same level as required.
The price department shall handle the license fee, produce the fee voucher and conduct the annual inspection.
Eight, strengthen price supervision and inspection. Price departments at all levels should strengthen the supervision and inspection of housing occupation fees, and strictly investigate and deal with charging behaviors that violate price policies and regulations. Our province will organize special forces to conduct special inspections on the charging behavior other than the sales price of commercial housing, and effectively protect the legitimate rights and interests of housing consumers.
