Under what circumstances can the property supply water and power to the owner?

Legal analysis: Generally speaking, property management companies can't take measures to stop water and power supply for owners. Even if the owner does not pay the property fees and utilities, it is not the property that can decide to cut off water and electricity. But in practice, in fact, in some cases, it is necessary for the property management to take measures to cut off water and electricity. According to the regulations, the property management company has the right to stop water supply and power supply, as follows:

1. When the owner fails to pay the water and electricity charges and authorizes the property management company to collect and remit them, the water and electricity can be cut off.

2. In case of catastrophic accident, the property management company has the right to cut off water and electricity.

For example, in case of fire, the property has the right to cut off the power supply according to the specific situation; The owner's house is empty, the water pipe bursts, and the property can stop water supply.

3. The property has the right to stop the water supply and power outage according to the relevant administrative orders or the notice of the water supply and power supply department. For example, the power supply department should guarantee the power supply line, and when the power outage notice is issued to the public, the property can be blacked out within the specified time.

Of course, if the property management company doesn't stop supplying water and power to the owner under special circumstances after receiving the notice of water and power cut, then it will compensate the owner for the related losses.

Legal basis: Article 44 of the Regulations of People's Republic of China (PRC) Municipality on Property Management. Within the property management area, water supply, power supply, gas supply, heating, communication, cable TV and other units shall charge relevant fees to the end users. The realty service enterprise shall not charge additional fees such as handling fees to the owners if it accepts the entrusted collection of money. The water supply and power supply company entrusts the property company to collect water and electricity charges, but it has no right to cut off water and electricity at will.
