Measures of Shenzhen Municipality on the Administration of Public Mobile Communication Base Stations

Chapter I General Provisions Article 1 In order to strengthen the management of public mobile communication base stations, promote the development of public mobile communication, safeguard public interests and promote the construction of smart Shenzhen, these measures are formulated in accordance with the provisions of the Regulations on Radio Management of Shenzhen Special Economic Zone and in light of the actual situation of this Municipality. Article 2 The term "public mobile communication base station" as mentioned in these Measures refers to the radio stations (stations) set up by public mobile communication operators in a certain area for transmitting information between mobile communication switching centers and terminal equipment, including independent Hong Jizhan, affiliated Hong Jizhan and indoor distribution systems.

The term "public mobile communication operators" as mentioned in these Measures refers to the units that have obtained the basic telecommunications business license according to law and provided mobile phones, data services and other value-added telecommunications services to the public.

The term "supporting conditions for base stations" as mentioned in these Measures refers to the conditions for setting up base stations in the sky, computer rooms and pipelines existing in buildings (structures). Article 3 These Measures shall apply to the planning, site selection, installation, use, supervision and management activities of base stations within the administrative area of this Municipality. Article 4 The management of base stations shall follow the principles of unified planning, rational layout, resource sharing and environmental protection. Article 5 A base station is an important infrastructure for safeguarding national security and the safety of people's lives and property. No organization or individual may destroy the base station or interfere with its work. Article 6 The municipal radio management organization is the competent department of base station management in this Municipality, and is responsible for the supervision and management of base stations in this Municipality.

City, district government planning, land, transportation, living environment and other departments (including new district management agencies), urban management departments and other relevant departments shall assist in the management of base stations according to their respective responsibilities. Article 7 Operating enterprises shall set up base stations in a timely, reasonable and legal manner according to the progress of mobile communication technology and urban development, so as to ensure the consumption demand of mobile communication in this Municipality. Chapter II Planning of Base Stations Article 8 The special planning of base stations shall be compiled by the municipal radio management organization in conjunction with the municipal planning and land departments in accordance with the requirements of the overall urban planning and other related planning of this Municipality, and shall be promulgated and implemented after being approved according to the prescribed procedures.

The municipal radio management institution may, according to the needs of urban construction and the development of communication technology, modify the special planning of base stations every year in accordance with the planning modification procedure. Article 9 The statutory planning shall be connected with the special planning for site selection of base stations. The planning of urban renewal units shall be based on statutory plans and relevant regulations, and the site selection of base stations shall be implemented. Tenth base station location planning shall solicit the opinions of urban management, transportation and other departments, operating enterprises and the public.

The operating enterprise shall provide basic planning information related to the base station. Eleventh planning base station location, should consider the following factors:

Network coverage requirements;

(4) network optimization requirements;

Provisions of laws, regulations, rules and relevant technical standards. The operating enterprise shall cooperate with the construction unit, design unit, construction unit or supervision unit to complete the design, construction and supervision of Hong Jizhan. Thirteenth new construction or renovation and expansion of large buildings (structures) should be in accordance with the technical standards and norms of base stations, design and construction of indoor distribution system base station facilities to meet the requirements of multiple sets of public mobile communication systems.

Operating enterprises and construction units can build indoor distribution systems in other buildings. Fourteenth base station location planning and site selection, should give priority to the city, district government and its subordinate units of buildings, facilities, green belts or other places (hereinafter referred to as government property).

The owner or management unit of the building, facility or site shall cooperate with the construction of the base station in accordance with the requirements of the relevant planning of the base station site. Fifteenth operating enterprises should open the site resources to achieve resource sharing.

The operating enterprise shall sign a site resource sharing agreement, specifying the obligations such as cost sharing, base station construction management and maintenance, and other rights and obligations enjoyed by the site resources.

When applying for a radio station license, an operating enterprise shall promise to enjoy the site resources to the municipal radio management organization.

If there is any dispute over the performance of the agreement or commitment of the operating enterprise to enjoy the site resources, it may be submitted to the municipal radio management institution for coordination and settlement, and the municipal radio management institution shall make a decision within one month from the date of receiving the application. Article 16 The municipal radio management organization and the market supervision and management department shall, jointly with the departments of planning, land, living environment, urban management and transportation, formulate and improve the relevant technical specifications of base station technology, appearance and supporting conditions in accordance with the principles of science, rationality and practicality.

The technical specifications of base stations should absorb the achievements of radio communication technology and promote the innovation and development of radio technology. Chapter III Establishment of Base Stations Article 17 An operating enterprise shall select a base station site according to the relevant planning of the base station site, combined with the needs of the construction and development of mobile communication networks and the characteristics of regional buildings, and inform the municipal radio management organization of the site selection in time.

City radio management institutions shall, according to the special planning of base station location, support the construction of base station location of operating enterprises, coordinate the problems existing in the site selection of operating enterprises in a timely manner in conjunction with the management departments of land planning, urban management, transportation and human settlements, and implement the requirements of the special planning of base station location.
