Provisions of Guiyang Municipality on the Management of Maintenance Funds for Building Facilities and Equipment * * *

Article 1 In order to strengthen the management of maintenance funds for * * * parts and facilities of houses, ensure the maintenance, renewal and transformation of * * * parts and facilities after the expiration of the warranty period, and safeguard the legitimate rights and interests of owners and users, these Provisions are formulated in accordance with the Regulations on Property Management and the Regulations on Property Management of Guiyang City, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the management of maintenance funds for houses, facilities and equipment in Yunyan District, Nanming District and xiaohe district City (hereinafter referred to as maintenance funds).

The maintenance fund management in Huaxi District, Wudang District, Baiyun District, qingzhen city, Xifeng County, Kaiyang County and xiuwen county shall be implemented with reference to these regulations. Article 3 The real estate administrative department of the Municipal People's Government shall, jointly with the financial department of the municipal government, be responsible for supervising and guiding the management and use of maintenance funds in this Municipality; District, county (city) people's government real estate administrative departments in conjunction with the financial department of the government at the same level is responsible for supervision, guidance and coordination of the management and use of maintenance funds in this area. Article 4 Maintenance funds shall be deposited in the bank accounts designated by the real estate administrative departments and the financial departments, and accounts shall be set up according to buildings, with household accounting and special funds for special purposes. Fifth commodity archives maintenance funds shall be collected in accordance with the following provisions:

(a) when the house is sold, the purchaser shall pay the maintenance fund in accordance with the following provisions while paying the purchase price:

1. residence: 2% of the purchase price;

2. Non-residential, 65438+ 0% of the purchase price;

(two) the maintenance funds for houses sold with special funds shall be paid by the construction unit in accordance with the average selling price of real estate and the standards stipulated in the preceding paragraph;

(three) the house has been put into use, and the purchaser has not paid the house maintenance fund;

1. Houses that have established owners' committees and implemented property management shall be collected and remitted by owners' committees or property management enterprises entrusted by owners' committees;

2, the owners' committee has not been established, and the houses that have been managed by animal husbandry are collected and remitted by the property management enterprises;

3, did not set up the owners' committee, nor the implementation of property management houses, by selling units withheld;

4. If the original selling unit does not exist, it shall be collected and remitted by the real estate administrative department where the house is located;

With the consent of the owners' committee, the operating income of the * * * site, * * facilities and equipment and * * site of the house is mainly used to supplement maintenance funds.

Before the implementation of these Provisions, if the maintenance funds have not been established or the payment standard of maintenance funds is lower than these Provisions, the owners' committee or the property management enterprise entrusted by the owners' committee shall collect and deposit them in a special account in accordance with these Provisions.

The collection of public housing maintenance funds shall be handled in accordance with the relevant provisions of the state. Article 6 The maintenance funds for newly-built commercial housing shall be collected by the construction unit, and the maintenance funds collected and remitted shall be deposited into the bank account designated by the real estate administrative department and the financial department when handling the registration certificate of commercial housing, and the relevant procedures for the custody of maintenance funds shall be handled. Seventh before the establishment of the owners' committee, the maintenance funds shall be managed by the real estate administrative department.

After the establishment of the owners' committee, with the consent of the owners' committee, the real estate administrative department will transfer the maintenance funds to the property management enterprise for escrow. Animal husbandry enterprises shall, jointly with the owners' committee and the real estate administrative department, go through the maintenance fund escrow and supervision procedures at the maintenance fund bank. Eighth maintenance funds should be used for overhaul, medium repair, renewal and transformation of housing parts and facilities.

In the event of an emergency that endangers the safety of the house and requires immediate use of maintenance funds, animal husbandry enterprises or maintenance management units may pay in advance. After the final accounts of maintenance expenses are audited according to the prescribed procedures, they will be returned from the housing maintenance funds.

Where the parts, facilities and equipment of the house are damaged artificially, maintenance funds shall not be used. Article 9 If the personal book balance of maintenance funds after use is lower than 10% of the total amount collected for the first time, the owners' committee shall be responsible for organizing the owners to continue to raise funds according to the renewal plan adopted by the owners' meeting; If the owners' committee is not established, the property management enterprise shall organize the owners to continue to raise funds. Tenth maintenance funds shall be used in accordance with the following provisions:

(a) the damaged parts and facilities of the house need to be repaired with maintenance funds, and the maintenance plan and budget shall be put forward by the owners' committee or the property management enterprise entrusted by the owners' committee;

(two) the property management enterprise shall sign a maintenance contract with the maintenance construction unit, and handle the supervision and use procedures of maintenance funds according to the contract;

(3) For houses without owners' committee or property management, with the consent of all the owners of the parts or facilities that need maintenance, the house selling unit or the management unit entrusted by it shall put forward a maintenance plan, and after the approval of all the owners, organize the construction unit to carry out maintenance;

(four) if the original sales unit does not exist, the real estate administrative department where the house is located shall organize the implementation in accordance with the procedures specified in the preceding paragraph;

(5) After the completion of the maintenance project, if it is qualified by the relevant professional institutions, the maintenance fund handling agency and the owners' committee will entrust the relevant professional institutions to settle the project, and then go to the maintenance fund account bank with the relevant formalities and settlement book for settlement. Eleventh the use of maintenance funds shall be subject to the supervision and inquiry of the owners. The owners' committee or the maintenance fund escrow unit shall regularly publish the balance sheet of the maintenance fund to all owners.
