Yancheng dust pollution prevention and control regulations

Chapter I General Provisions Article 1 In order to effectively prevent and control dust pollution, protect and improve the atmospheric environment, safeguard public health, promote the construction of ecological civilization, and promote sustainable economic and social development, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Air Pollution of People's Republic of China (PRC), the Regulations on Prevention and Control of Air Pollution of Jiangsu Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of dust pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 The term "dust pollution" as mentioned in these Regulations refers to the pollution to the atmospheric environment caused by dust particles generated in construction, decoration, demolition of buildings (structures), greening construction and maintenance, material transportation and stacking, road maintenance and cleaning. Article 4 The prevention and control of dust pollution shall adhere to the principles of government-led, owner-responsible, departmental supervision, public participation, combination of prevention and control, and comprehensive management. Chapter II Responsibility for Prevention and Control Article 5 The people's governments of cities and counties (cities, districts) shall be responsible for the prevention and control of dust pollution within their respective administrative areas and perform the following duties:

(a) according to the air pollution prevention and control planning, formulate special plans for dust pollution prevention and control, organize the delineation of urban dust pollution control areas, and clarify the objectives and measures of urban dust pollution control areas;

(two) the establishment of dust pollution prevention and control coordination, long-term management and capital investment guarantee mechanism;

(three) the establishment of air pollution monitoring and early warning mechanism, organize the formulation of emergency plans;

(four) to supervise and assess the prevention and control of dust pollution in their respective administrative areas, and to commend and reward units and individuals that have made remarkable achievements. Article 6 The administrative departments of urban and rural construction of the people's governments of cities and counties (cities, districts) shall co-ordinate the prevention and control of dust pollution in their respective administrative areas, and be responsible for the supervision and management of the prevention and control of dust pollution in housing construction, municipal public facilities, greening projects and house demolition construction on state-owned land.

The competent administrative department of environmental protection shall be responsible for the supervision and management of the prevention and control of dust pollution in the material stacking places of industrial enterprises, determine and publish key dust pollution sources, and strengthen monitoring and inspection.

The competent department of urban management administration is responsible for the supervision and management of the transportation and disposal of building materials, construction waste and engineering dregs, the cleaning of roads and street facilities, and the prevention and control of dust pollution in outdoor advertising construction.

The traffic administrative department is responsible for the supervision and management of the prevention and control of dust pollution in traffic engineering and road construction.

The water administrative department is responsible for the supervision and management of water conservancy projects and the prevention and control of dust pollution caused by loading and unloading and stacking materials at inland river terminals.

The port administrative department is responsible for the supervision and management of the prevention and control of dust pollution caused by loading and unloading and stacking materials in coastal ports and docks.

The competent department of civil air defense is responsible for the supervision and management of the prevention and control of dust pollution in civil air defense engineering construction.

The real estate administrative department is responsible for the supervision and management of the prevention and control of dust pollution in residential interior decoration projects, and guides the town people's government and sub-district offices to do a good job in the supervision and management of dust pollution prevention and control in old residential areas.

The public security organs shall be responsible for setting up the areas and times where construction waste and engineering muck transport vehicles are prohibited and restricted, and investigating and dealing with road traffic violations according to law.

The administrative departments of planning, land and resources, economy and informatization, finance, price, auditing and forestry shall supervise and manage the prevention and control of dust pollution within their respective functions and duties. Seventh city and county (city, district) people's governments and relevant departments should strengthen the propaganda of dust pollution prevention and control, popularize dust pollution prevention laws and regulations and scientific knowledge, improve public awareness of atmospheric environmental protection, and promote public participation. Article 8 The people's governments of cities and counties (cities, districts) and relevant departments shall encourage and support scientific and technological research on the prevention and control of dust pollution, introduce new technologies, use new equipment and popularize new technologies. Ninth Town People's government and street offices cooperate with relevant administrative departments to carry out dust pollution prevention and control work. Tenth engineering construction units shall perform the following duties:

(a) to undertake the responsibility for the prevention and control of dust pollution in construction projects;

(two) the environmental impact assessment documents of construction projects submitted for approval shall include the contents of dust pollution prevention and control;

(three) the dust pollution prevention and control costs included in the project cost, earmarking;

(4) In the tender documents of the construction unit, the bidder is required to formulate the prevention and control scheme of dust pollution on the construction site, which is included in the bid evaluation content, and the responsibility of dust pollution prevention and control of the construction unit is clearly defined in the project contract. Eleventh construction units and transportation units involved in the project construction shall formulate implementation plans for the prevention and control of dust pollution in construction and transportation, and take effective dust prevention measures. Twelfth construction project supervision units shall include the prevention and control of dust pollution in the scope of project supervision. If the construction is not carried out in accordance with the implementation plan for the prevention and control of dust pollution, the construction unit shall be required to correct it immediately and report to the project construction unit and the relevant administrative departments in a timely manner. Thirteenth urban built-up areas of the bare ground, should organize the implementation of greening or covering. The responsible subject is determined as follows:

(a) within the scope of the unit, the unit is responsible for;
