Regulations on the administration of agency affairs

Chapter I General Principles

Article 1 These Regulations are formulated in order to strengthen the administration of government affairs, standardize government affairs, ensure the normal operation of government agencies, reduce the operating costs of government agencies and build an economical government. Article 2 These Regulations shall apply to people's governments at all levels and their departments. Third people's governments at or above the county level shall promote the unified management of government affairs at the corresponding level, establish and improve management systems and standards, and make overall plans for resources. Government departments should implement centralized management of their office affairs and implement the system and standards of office affairs management. Article 4 The administrative department of government affairs in the State Council shall be responsible for formulating the rules and regulations for the administration of government affairs, guiding the official vehicles, official receptions and energy-saving work of public institutions at lower levels, and being in charge of the affairs of central state organs. The administrative departments of local people's governments at or above the county level shall guide the work of relevant organs of lower-level governments and be in charge of the work of government organs at the same level. Fifth people's governments at or above the county level shall strengthen the supervision and inspection of government affairs of government departments at the same level and governments at lower levels, and promptly correct violations of laws and regulations. The departments of development and reform, finance, auditing and supervision of the people's governments at or above the county level and the competent departments of government affairs shall, in accordance with the division of responsibilities and in accordance with the provisions of relevant laws and regulations, strengthen supervision and inspection of the management of government operating funds, assets and services; After receiving a report on violation of the management system and standards of the organ, it shall promptly investigate and deal with it according to law. Article 6 Government affairs shall follow the principles of safeguarding official duties, practicing economy, being pragmatic and efficient, and being open and transparent. Article 7 People's governments at all levels shall, in accordance with the provisions of the state on the disclosure of government information, establish and improve an open system for operating funds of government agencies, and regularly publish the budgets and final accounts of operating funds of government agencies such as official reception fees, purchase and operation fees of official vehicles, and expenses for going abroad (in the country) on business. Article 8 The people's governments at all levels shall promote the socialized reform of the logistics services of government organs, official vehicles and official reception services, and establish and improve relevant management systems.

Chapter II Fund Management

Ninth people's governments at all levels and their departments should strengthen the management of the operating funds of the organs and improve the efficiency of the use of funds. The term "operating expenses of organs" as mentioned in these Regulations refers to the funds used to purchase goods and services to ensure the operation of organs. Tenth people's governments at or above the county level shall, according to the basic needs of the operation of the organs, and in combination with the actual management of the affairs of the organs, formulate the physical quota and service standards. The financial department of the people's government at or above the county level shall, according to the physical quota and service standards, refer to the market prices of related commodities and services, and organize the formulation of the quota standards and related expenditure standards for the operating expenses of the organs. Article 11 The financial department of the people's government at or above the county level shall, according to the budget expenditure quota standard, combined with the work responsibilities, nature and characteristics of various government departments at the corresponding level, and in accordance with the principle of total control and strictness, adopt the quota method to prepare the operating budget of the government. Article 12 People's governments at or above the county level shall include official reception fees, official vehicle purchase and operation fees, and expenses for going abroad (border) on business into budget management, and strictly control the scale and proportion of official reception fees, official vehicle purchase and operation fees, and expenses for going abroad (border) in the total government operating budget. Government departments shall, according to the needs of the work and the budget for the operation of the organs, formulate expenditure plans for official reception fees, official vehicle purchase and operation fees, and expenses for going abroad (territory) on business, and shall not misappropriate other budgetary funds for official reception, official vehicle purchase and operation or going abroad (territory) on business. Article 13 Where the administrative department of the people's government at or above the county level organizes and implements the construction and maintenance of office buildings, the renewal of official vehicles, logistics services and other affairs of the government organs at the corresponding level in accordance with the regulations and the actual situation of the affairs management of the government organs at the corresponding level, the fund management shall be implemented in accordance with the provisions of the state budget management. Fourteenth government departments should purchase the goods and services needed for the operation of the organs in accordance with the laws, regulations and provisions of government procurement; If bidding is needed, the laws, regulations and provisions on bidding shall be observed. Government departments should purchase affordable goods, not luxury goods, super-standard services and luxurious office buildings. Fifteenth government departments to purchase projects listed in the centralized procurement catalog and purchased by government centralized procurement agencies, shall not violate the provisions of their own procurement or to avoid centralized government procurement in a piecemeal manner. Government centralized procurement institutions should establish and improve the management system, shorten the procurement cycle, improve procurement efficiency, reduce procurement costs and ensure procurement quality. The prices of goods and services purchased by the government should be lower than the average market prices of similar goods and services. Sixteenth people's governments at or above the county level shall establish and improve the statistical report and performance evaluation system of the operating expenses of the organs, and organize the statistics, analysis and evaluation of the operating expenses of the organs.

Chapter III Asset Management

Seventeenth people's governments at or above the county level shall, in accordance with the division of responsibilities, formulate and organize the implementation of specific asset management systems, and accept the guidance and supervision of the relevant departments such as finance. Article 18 The people's governments at or above the county level shall, in accordance with the regulations on asset management of relevant organs, the level of economic and social development, the requirements for energy conservation and environmental protection and the basic requirements for the operation of organs, and in combination with the actual management of organs' affairs, classify and formulate the standards for asset allocation of organs, and determine the quantity, price, performance and minimum service life of assets. Government departments shall, according to the asset allocation standards of government agencies, prepare their own asset allocation plans. Nineteenth government departments should improve the management system for the use of government assets, establish and improve asset account cards and use files, and conduct regular inventory to ensure the safety and integrity of assets and improve the efficiency of use. Idle assets of government departments shall be uniformly allocated and used by the government at the same level or disposed of by public auction, and the proceeds from disposal shall be turned over to the state treasury. Twentieth people's governments at or above the county level shall implement unified management of the land used by government agencies at the same level. The overall urban planning and detailed planning should take into account the needs of land layout and spatial arrangement of government agencies. The administrative departments of the people's governments at or above the county level shall make overall arrangements for the use of land by organs and save intensive land. The competent departments of land and resources of the people's governments at or above the county level shall strictly examine the demand for new land for government agencies, and go through the formalities for land use in accordance with the laws, regulations and provisions on land management. Twenty-first people's governments at or above the county level shall establish and improve the management system of office buildings, and implement unified deployment and unified ownership registration for office buildings of government organs at the same level; Conditional, can be unified construction of government offices at the same level. The construction and maintenance of office buildings of government departments shall strictly implement the Standards for the Construction and Maintenance of Office Buildings of Government Organs, which meet the requirements of simplicity, practicality, energy conservation, environmental protection, security and confidentiality; The use and maintenance of office buildings should strictly implement the property service standards of government agencies. Twenty-second due to the new office space, adjustment and cancellation of institutions and other reasons to vacate the office space of government departments exceeding the approved area, the government at the same level shall recover it in time and use it uniformly. Where the staff of the people's governments at all levels and their departments retire or transfer, the office space shall be recovered and handed over to the original unit in time. Twenty-third government departments shall not lease, lend or change the use function of office space; Without the approval of the people's government at the same level, no office space may be rented. Twenty-fourth the State Council city authorities shall, jointly with relevant departments, formulate measures for the administration of the allocation and use of official vehicles, regularly publish the catalogue of vehicles selected for government official vehicles, and be responsible for the administration of official vehicles of central state organs. The specific provisions on the use and management of official vehicles for law enforcement duty shall be formulated by the finance department of the State Council jointly with relevant departments. The competent department of official vehicles of the local people's governments at or above the county level shall be responsible for the management of official vehicles of the governments at the corresponding levels, and guide and supervise the management of official vehicles of the governments at lower levels. Article 25 All government departments shall strictly implement the standards for the preparation and allocation of official vehicles, establish and improve the management system for the updating and allocation of official vehicles, and shall not over-prepare, over-allocate or over-rent official vehicles, increase high-grade configuration or luxurious interior for official vehicles, borrow or occupy vehicles from subordinate units and other units, or accept vehicles donated by enterprises, institutions and individuals. Twenty-sixth government departments should implement centralized management and unified dispatch of official vehicles, and establish and improve the registration and statistical reporting system of official vehicles. Government departments should implement bicycle accounting for fuel consumption and maintenance costs of official vehicles.

Chapter IV Service Management

Article 27 The department in charge of organ affairs of the people's government at or above the county level shall formulate a unified management system for organ logistics services, determine the items and standards of organ logistics services, strengthen the guidance and supervision of the logistics services of various government departments at the same level, and rationally allocate and economize the use of logistics service resources. Government departments should establish and improve their own logistics service management system, and shall not provide logistics services beyond the prescribed items and standards. Twenty-eighth people's governments at all levels shall, in accordance with the principles of simplifying etiquette, being pragmatic and frugal, manage and standardize official reception. The administrative department of government affairs in the State Council is responsible for formulating the relevant systems of official reception of government organs and the official reception standards of central state organs. Local people's governments at or above the county level shall, in light of local conditions, determine the scope and standards of official reception. Government departments and official reception management institutions shall strictly implement the official reception system and standards. The official reception management institutions of local people's governments at or above the county level shall be responsible for managing the official reception of the governments at the corresponding levels and guiding the official reception of the governments at lower levels. Twenty-ninth people's governments at all levels and their departments should strengthen the management of meetings, control the number, scale and duration of meetings, make full use of the internal places of organs, and hold meetings by means of television, telephone and online video to save meeting funds. Article 30 All government departments shall implement the regulations on going abroad on business, review the reasons, contents, necessity and schedule of their own staff going abroad on business, control the number of delegations and personnel going abroad on business and the time of staying abroad, and shall not arrange inspection and training unrelated to their business work.

Chapter V Legal Liability

Thirty-first in violation of the provisions of this Ordinance, received a report on the violation of the management system and norms of this organ, and did not promptly investigate and deal with it according to law, and the higher authorities shall order it to make corrections; If the circumstances are serious, the appointment and removal organ or the supervisory organ shall punish the responsible person according to law. Thirty-second in violation of the provisions of this Ordinance, under any of the following circumstances, the higher authorities shall order it to make corrections, and the appointment and removal organ or the supervisory organ shall give a warning to the responsible personnel; If the circumstances are serious, demerit or gross demerit shall be given; If the circumstances are serious, demotion or dismissal shall be given: (1) Spending official reception fees, purchasing and operating official vehicles, going abroad on business, or misappropriating other budgetary funds for official reception, purchasing and operating official vehicles, and going abroad on business; (two) the purchase of luxury goods, super standard services or the purchase of luxury office space; (3) Renting or lending the office space, changing the use function of the office space, or renting the office space without authorization; (4) Allocating official vehicles or renting vehicles beyond the establishment and standard, or adding high-grade configuration and luxurious interior for official vehicles, or borrowing or occupying vehicles from subordinate units or other units, or accepting vehicles as gifts from enterprises, institutions and individuals; (five) to provide logistics services beyond the prescribed items or standards; (six) to arrange overseas (border) inspection or training unrelated to the business work of the department. Thirty-third administrative personnel who abuse their powers, neglect their duties, engage in malpractices for selfish ends or accept bribes in administrative activities shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VI Supplementary Provisions

Thirty-fourth management activities of other state organs and relevant people's organizations shall be implemented with reference to these regulations. Article 35 These Regulations shall come into force as of 20 12 10 1.
