Chapter I General Principles
Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on the Safety of Special Equipment and other laws and regulations, combined with the actual situation of this province, in order to strengthen the use safety of elevators, prevent and reduce accidents, and ensure personal and property safety.
Article 2 These Measures shall apply to activities related to elevator safety and its supervision and management within the administrative region of this province.
The elevators mentioned in these Measures include manned (cargo) elevators, escalators and moving sidewalks. , the specific scope is determined according to the national special equipment catalogue.
Article 3 People's governments at or above the county level shall strengthen their leadership over elevator safety, determine the elevator safety supervision responsibilities of relevant departments according to law, urge and support them to perform their duties according to law, coordinate and solve major problems in elevator safety in a timely manner, establish an emergency handling mechanism for elevator accidents and major failures, and guide and standardize elevator maintenance units to establish regional elevator emergency rescue networks.
The people's governments at or above the county level shall incorporate elevator safety into the grid system of comprehensive management of social management, give play to the functions of social management grid management information platform and grid members' publicity and education, information collection, hidden danger investigation and so on, and realize the global coverage of elevator safety supervision and management. Make overall plans to promote the comprehensive management of elevators without responsible subjects, special maintenance funds and maintenance units, and establish a rescue mechanism for residents to decide independently through consultation, grassroots organizations to help promote and government subsidies.
Township People's governments and sub-district offices shall urge elevator users to investigate elevator safety hazards, coordinate and solve contradictions and disputes in elevator safety, and assist relevant departments to do a good job in elevator safety accident investigation and handling, hidden dangers rectification, daily supervision and inspection and other safety supervision and management work.
Community, neighborhood (village) committees shall actively cooperate with the government and its relevant departments to perform the duties of supervision and management of elevator safety, and assist in handling contradictions and disputes caused by elevator safety.
Fourth people's governments at or above the county level shall be responsible for the supervision and administration of elevator safety within their respective administrative areas. The safety production supervision and management department of the people's government at or above the county level shall be responsible for comprehensively guiding the safety supervision and management of elevator use.
The construction administrative department shall be responsible for the supervision and management of elevator shaft and machine room, elevator selection and quantity allocation in the building, and supervise the construction unit to perform elevator safety management duties.
The real estate management department is responsible for guiding and supervising the owners and property service enterprises to perform their duties of residential elevator safety management, and rationally regulating the special maintenance funds for residential elevators for overhaul, renovation and renewal.
The public security department is responsible for participating in the emergency rescue of elevator failures and accidents.
Planning, letter, industry and commerce, education, commerce, tourism and other relevant departments shall, according to their respective responsibilities, do a good job in the supervision and management of elevator safety.
Article 5 The owner of the elevator shall bear the corresponding obligations for the safe use of the elevator according to law and be responsible for the losses caused by the elevator accident.
Elevator users shall establish and improve the elevator use safety management system with post responsibility system as the core, and be responsible for the elevator use safety.
Elevator production, operation and maintenance units are responsible for the safety performance of elevators produced, operated and maintained by them.
Sixth elevator safety liability insurance system, improve the ability of accident compensation. The elevators in public gathering places shall be insured with elevator safety liability insurance according to law.
Article 7 Social organizations such as special equipment industry associations are encouraged to participate in the supervision and management of elevator use safety, establish industry self-discipline mechanism, promote the construction of industry credit system, regularly carry out elevator production, maintenance and service quality evaluation activities, and promote orderly competition and standardized operation of the industry.
Eighth organs, organizations, enterprises, schools and other units should carry out publicity and popularization of elevator safety laws and regulations and safety knowledge, advocate civilized elevator ride, and enhance public safety awareness and self-protection ability.
The news media shall publicize the elevator safety laws and regulations and related safety knowledge for public welfare, and supervise the acts in violation of elevator safety management regulations by public opinion.
Chapter II Safety of Elevator Use
Article 9 The elevator owner may entrust a realty service enterprise or other managers to manage the elevator, and the trustee shall fulfill the obligations of the legal user of the elevator and bear corresponding responsibilities.
Elevator use units are determined in accordance with the following provisions:
(a) the implementation of the early property management of residential buildings, has not yet been handed over to the owners' committee, housing developers (or their entrusted property services companies) to use the elevator;
(2) If the owners' committee entrusts the realty service enterprise to manage the elevator, the entrusted realty service enterprise is the elevator user;
(three) the elevator that is not entrusted to the property service enterprise belongs to a single owner, and the owner is the elevator user; If it belongs to multiple property owners, it shall be clear through consultation that one of the property owners is the elevator user;
(four) the lease of places equipped with elevators, the lease contract shall stipulate the elevator users; If there is no agreement, the owner of the elevator is the elevator user;
(5) If the elevator user cannot be determined, the subdistrict office (Township People's Government) where the elevator is located shall urge the owner to designate or designate the user, and the community and neighborhood committee shall assist in the implementation of management responsibilities.
Elevator use unit is not clear, can not implement the responsibility of safety management, the elevator shall not be used.
Tenth elevator users should use elevators that have obtained production licenses and passed the inspection, and perform the following safety management obligations:
(a) to formulate elevator safety management system (including financial guarantee, daily inspection, regular inspection, safety training, hidden danger investigation and disposal, emergency plan management and drills, assessment, rewards and punishments, etc.), and to implement safety management responsibilities;
(2) Put up the signs and signs specified by safety precautions, effective use registration signs and inspection qualified signs in the prominent position of the elevator, so that the elevator emergency alarm device can keep effective contact with the safety management personnel on duty at any time;
(three) when the elevator is trapped, take timely measures to appease the passengers, and organize the elevator maintenance unit to carry out rescue;
(4) In the event of an elevator accident, organize emergency rescue, risk elimination and rescue according to the emergency rescue plan, protect the scene of the accident, and immediately report to the safety supervision and management department of special equipment and other relevant departments where the accident is located;
(five) to register the use of the elevator within the specified time, declare and accept the inspection, and go through the formalities of change in the original registration authority in time after the change of the elevator registration information;
(six) entrust a unit with corresponding license to carry out elevator renovation, repair and maintenance, supervise the quality of elevator maintenance, and confirm the maintenance records. When choosing an elevator maintenance unit, it shall listen to the opinions of the owners' committee or consult the opinions of the owners' representatives;
(seven) signed a maintenance contract with the elevator maintenance unit. The maintenance contract shall include the maintenance items, requirements and implementation standards, the start and end date and time frequency of maintenance, the arrival time of emergency repair and emergency rescue, and the rights, obligations and responsibilities of both the maintenance unit and the user;
(eight) carrying building materials, construction waste and large furniture, household appliances and other items that are easy to damage the elevator, taking effective safety protection technical measures or arranging personnel for on-site management;
(nine) to strengthen the daily safety inspection, found hidden dangers timely rectification;
(ten) the establishment and long-term preservation of elevator safety technical files;
(eleven) other elevator safety management obligations stipulated by laws, regulations, rules or safety technical specifications.
Eleventh elevator users shall be equipped with safety management personnel to meet the needs, and the safety management personnel shall be responsible for the supervision of the safety management and maintenance of elevator use. According to the number of elevators, the safety management personnel shall provide 1 for every 50 elevators, and at least 1 for those less than 50 elevators. An elevator without elevator safety management personnel shall not be put into use.
Hospitals should provide patients with elevators, passenger elevators with a speed of more than 2.5m/s directly used for sightseeing and elevators operated by drivers, and should be equipped with certified elevator drivers; Escalators and moving sidewalks in public gathering places should be attended by special personnel during peak passenger flow hours.
Twelfth elevator car decoration should meet the requirements of safe use, are not allowed to use flammable materials. After the transformation, the elevator user shall organize the maintenance unit to test the relevant safety performance of the elevator, and it can be put into use only after it meets the requirements of the relevant national safety technical specifications.
Thirteenth elevator renovation, renewal, maintenance, daily operation and maintenance costs borne by the elevator owner. If the realty service enterprise is a residential elevator user, the elevator operation and maintenance costs shall be agreed by the elevator owner and the realty service enterprise in the realty service contract. The realty service enterprise shall set up a separate account for elevator operation and maintenance expenses, which shall be used for special purposes, and announce the balance of elevator operation and maintenance expenses to the owners every six months.
If the elevators in residential areas need to be repaired, modified or updated, the elevator users and the owners' committee shall timely organize the implementation of the required funds, and the owners shall fulfill the obligation of raising funds. The required funds are raised in the following ways:
(a) the establishment of residential special maintenance funds, in accordance with the prescribed procedures in the residential special maintenance funds charged;
(two) the relevant owners have agreed to bear the costs, in accordance with the agreement; If there is no agreement or the agreement is not clear, it shall be settled by the relevant owners through consultation in accordance with relevant regulations. Township people's governments and sub-district offices can help organize relevant owners to raise and implement funds.
Residential elevator failure endangers personal safety, and it is difficult to eliminate hidden dangers without overhaul, transformation or renewal. Elevator users should take emergency measures first, and have established special funds for residential maintenance. At the same time, they should submit a fund application report to the local real estate administrative department, and the real estate administrative department should approve it in time, and the maintenance and renovation funds should be charged to the special maintenance funds. If the special maintenance fund for residential buildings has not been established or the balance of the special maintenance fund for residential buildings is insufficient, the local sub-district office (Township People's Government) shall organize elevator users, owners' representatives and relevant government departments to jointly determine the elevator maintenance, renovation or renewal scheme and cost raising scheme.
Fourteenth elevator users shall apply to the elevator inspection agency for regular inspection one month before the expiration of the elevator safety inspection.
Elevator users shall promptly rectify the unqualified items found in the regular inspection of elevators. Do not use elevators that have not been inspected regularly or are unqualified.
Fifteenth elevator stop service, elevator users should set up stop service signs in a prominent position, implement necessary protective measures, cut off the main power supply of the elevator, and publicize the reasons, duration and related treatment measures of the elevator stop service; After the reasons for stopping use are eliminated, the normal use of the elevator will be resumed in time.
An elevator that has been out of service for more than 1 year or beyond the date of the next regular inspection shall be re-used only after passing the inspection by the elevator inspection agency. The elevator that has not been stopped beyond the next inspection date shall be fully maintained by the elevator maintenance unit, and can be reused only after passing the self-inspection.
Article 16 If there are serious hidden dangers in the elevator, there is no value for renovation or repair, or other scrapping conditions stipulated in safety technical specifications and relevant standards are met, the elevator user shall scrap it in time, and go through cancellation procedures with the original registration authority within 30 days after scrapping.
Scrap elevators shall not be transferred, sold or reused.
Seventeenth elevator fault frequency affects the normal use of the elevator, elevator users can entrust the elevator inspection or type test qualification institutions to carry out safety assessment, and take corresponding measures according to the assessment results.
After the elevator safety assessment in residential areas is completed, elevator users shall post the assessment conclusions in the elevator car or at the entrance and exit. The evaluation conclusion can be used as the basis for applying for the use of residential special maintenance funds.
Eighteenth passengers in the use of the elevator shall not have the following acts:
(a) operating the elevator in violation of the elevator safety warning signs;
(2) Taking an elevator that is obviously in an abnormal state;
(3) Use abnormal means such as prying to open the elevator landing door and car door;
(4) Dismantling or destroying the safety warning signs, inspection signs, alarm devices, safety components and other ancillary facilities of elevators;
(five) more than the rated load to take the elevator;
(six) other acts that endanger the safe operation of elevators and the safety of others.
The guardian shall perform the obligation of guardianship and ensure the safe and civilized use of the elevator by the ward.
Chapter III Responsibilities of Producers and Operators
Article 19 The elevator manufacturing unit shall, in accordance with the requirements of safety technical specifications, provide elevator quality certificate, installation and maintenance instructions, type test certificate and other relevant technical data and factory documents, and set up product nameplates, safety warning signs and their descriptions in a prominent position of the elevator.
The elevator manufacturing unit shall be responsible for the safety performance of the manufactured elevators and undertake the following obligations:
(a) clear elevator and traction machine, brake and other important parts of the design life or use times, quality guarantee period;
(2) After the elevator is put into use, track, investigate, understand and record the safe operation of the elevator manufactured by it, put forward improvement suggestions for the problems existing in the maintenance and safe operation of elevator maintenance units and users, provide necessary technical assistance, and ensure the supply of elevator accessories;
(three) found that there are serious accidents in the elevator, promptly inform the elevator users, and report to the special equipment safety supervision and management department.
Article 20 The design unit of a construction project shall, according to the purpose, use demand and functional requirements of the building, and in accordance with the relevant national regulations and standards, reasonably design the building structures such as hoistway, pit and machine room involved in elevator installation and operation, and put forward opinions on elevator selection.
The selection and configuration of elevators purchased by the construction unit shall meet the requirements of building structure and use, and meet the requirements of fire fighting, first aid and barrier-free access. The manned elevator shall have the function of automatic floor leveling in case of power failure, and be equipped with a one-button emergency alarm device.
The construction drawing review institution shall review the quantity, layout and function of elevators in accordance with relevant national and provincial regulations and standards to ensure the safe use of elevators.
The elevator car, machine room and shaft shall not be equipped with and installed with equipment and facilities unrelated to the elevator.
Encourage new residential buildings to install elevators with double circuit power supply or standby power supply.
Twenty-first elevators in public gathering places should be equipped with elevator safety operation monitoring system to meet the needs of recording accidents, failures, maintenance and emergency rescue. The elevator manufacturing unit shall provide technical support for the configuration and installation of the elevator safety operation monitoring system. Elevator users should ensure the effective operation of the monitoring system.
Encourage elevators used in other places to install elevator safety operation monitoring system.
The elevators in public gathering places put into use before the implementation of these Measures shall be installed before the next regular inspection if the safety operation monitoring system is not installed.
Twenty-second elevator sales units shall establish an acceptance and sales record system, verify the elevator manufacturing license, product quality certificate and other supporting documents, and shall not sell elevators manufactured by units that have not obtained manufacturing licenses.
The elevator sales unit shall sign an elevator sales contract with the construction unit or the elevator user, and specify the quality guarantee period and service content of the elevator. During the quality guarantee period, if there are quality problems with elevator safety protection devices and other electrical components, they shall be responsible for free maintenance or replacement.
Twenty-third elevator installation, renovation and maintenance shall be carried out by the elevator manufacturing unit or its entrusted unit that has obtained the corresponding license according to law. Before elevator installation, renovation and maintenance, the construction unit shall inform the special equipment safety supervision and management department in writing of the information such as unit name, license number, list of construction personnel and their qualification certificate number, construction site, number of elevators under construction, main parameters and manufacturing unit, and apply to the special equipment inspection agency for supervision and inspection.
If the original elevator manufacturing unit has been cancelled or no longer has the corresponding elevator manufacturing license qualification, with the consent of the elevator owner, the user may entrust a unit with corresponding qualifications for renovation or maintenance; Where the transformation is implemented, the elevator transformation unit shall replace the product nameplate of elevator transformation in time, and indicate its unit name, transformation date and license number on the product nameplate and transformation quality certificate. The transformation unit is responsible for the quality problems involved in the quality and safe operation of the elevator after transformation, and fulfills the obligations of the corresponding elevator manufacturing unit.
The installation, modification and maintenance of elevators shall not be subcontracted.
Twenty-fourth construction units shall, within 30 days after the elevator installation, renovation and major maintenance projects are completed and passed the supervision and inspection, hand over the safety technical data to the construction unit or the elevator user; The construction unit shall hand over the safety technical data at the same time when handing over the elevator to the elevator user.
Chapter IV Responsibilities of Maintenance Units
Twenty-fifth elevator maintenance units shall maintain elevators in accordance with national laws and regulations, relevant safety technical specifications, relevant standards and maintenance contracts, and shall not subcontract or subcontract in any form.
Twenty-sixth elevator maintenance units shall perform the following obligations:
(a) elevator maintenance, do the following work:
1. Conduct safety education and training for maintenance personnel;
2. Set up a 24-hour telephone on duty to ensure the timely implementation of emergency rescue;
3. Post elevator maintenance signs in the elevator car or in prominent positions such as entrances and exits, and the information should at least include maintenance personnel, maintenance time, next maintenance time and maintenance situation;
4. Do safety warning and safety protection measures at the maintenance site to prevent accidents;
5. Record the maintenance process and results, which shall be confirmed and signed by the safety management personnel of the user unit, and the maintenance results shall be publicized in the car;
6. Establish safety technical files such as elevator maintenance records, with a retention period of at least 4 years;
7. Before the elevator is regularly inspected, it shall conduct annual self-inspection, issue self-inspection records or reports, and cooperate with elevator users to do a good job in elevator regular inspection.
8. After receiving the elevator fault notice, eliminate it in time. After receiving the elevator fault report, the maintenance personnel arrived at the scene in time to carry out rescue. It takes no more than 30 minutes to arrive at the site in urban areas, and no more than 1 hour in other areas.
(2) Inform the elevator users in writing to stop using the elevator in time when there are hidden dangers or faults in the elevator, and cooperate with the elevator users to take effective safety measures;
(three) found that the elevator users have one of the following circumstances, timely report to the special equipment safety supervision and management department:
1. Use elevators that have not been inspected or failed to pass the inspection;
2. Use elevators that have potential accidents or have been stopped or scrapped;
3. Illegal maintenance and renovation of elevators;
4. Other acts that seriously endanger the safety of elevator use.
Twenty-seventh elevator maintenance units and their operators shall not dismantle the elevator safety protection device and short circuit the safety circuit without authorization.
Twenty-eighth elevator maintenance units shall, in accordance with the requirements of the relevant national safety technical specifications, be equipped with personnel who have obtained the corresponding special equipment operation qualifications to engage in elevator maintenance work. Maintenance personnel shall not engage in elevator maintenance work in more than 2 elevator maintenance units.
Chapter V Duties of Inspection and Testing Institutions
Twenty-ninth elevator inspection and testing institutions and their employees shall obtain corresponding qualifications according to law.
Inspection and testing institutions and their employees shall carry out inspection and testing work in accordance with relevant standards and norms, issue reports objectively and promptly, and be responsible for inspection and testing results and appraisal conclusions.
Thirtieth elevator installation, renovation, maintenance units or users to apply for elevator inspection, the inspection agency shall, within 2 working days from the date of receipt of the application materials, review, review and meet the inspection requirements, it shall conduct inspection in accordance with the following provisions:
(1) Arrange the supervision and inspection of elevator installation, renovation and major maintenance within 3 working days;
(2) Arrange regular inspection of elevators within 5 working days;
(3) If the applicant has special requirements on the inspection date, the inspection shall be conducted according to the inspection date agreed by both parties;
(four) the elevator inspection, inspection report shall be issued within 7 working days from the date of inspection.
After completing the on-site inspection, the inspection institution shall issue an inspection opinion on whether to allow the elevator to continue to use.
If the inspection does not meet the requirements of safety technical specifications, the inspection institution shall issue a notice of inspection opinions, and put forward the rectification requirements and rectification period; If the rectification fails within the time limit, an unqualified inspection report shall be issued within 7 working days from the date of the expiration of the rectification, and a written report shall be made to the local special equipment safety supervision and management department of the county-level people's government, which shall take necessary measures in time to deal with it.
The elevator inspection agency shall, within 5 days from the date of issuance of the inspection report, submit the updated elevator inspection information to the special equipment safety supervision and management department responsible for registration.
Thirty-first elevator inspection shall be carried out on the basis of qualified self-inspection by the construction unit or maintenance unit.
In the process of inspection, if the inspection agency finds that the elevator construction unit or maintenance unit has any illegal acts such as fraud, or there are serious hidden dangers in the elevator due to inadequate construction and maintenance, it shall report to the special equipment safety supervision and management department.
Chapter VI Supervision and Administration
Thirty-second city (state) people's government special equipment safety supervision and management department shall formulate an annual supervision and inspection plan, submitted to the people's government at the same level for approval, and organize the implementation at different levels. Suitable for elevators in schools, kindergartens, parks, hospitals, shopping malls, gymnasiums, exhibition halls, airports, stations, passenger terminals and other public gathering places. Key safety supervision and inspection shall be carried out in accordance with the Rules for Site Safety Supervision and Inspection of Special Equipment.
Thirty-third special equipment safety supervision and management departments shall, when handling elevator manufacturing, installation, renovation, maintenance license and registration matters, review related matters in accordance with the provisions of the national safety technical specifications. Do not meet the requirements of safety technical specifications, shall not be licensed or registered; Units and individuals that have obtained the license and registration according to law shall revoke the original license and registration according to law if they find that they no longer meet the corresponding conditions.
Article 34 In the process of supervision and management, the safety supervision and management department of special equipment shall issue a safety supervision instruction for special equipment if it finds violations of laws, regulations and safety technical specifications or potential safety hazards in elevators in use, and order relevant units to make timely rectification to eliminate potential accidents. For the elevator production, use management, maintenance units and inspection institutions that have not been rectified within the time limit, they can interview their main responsible persons and be punished according to law; The elevators with serious accidents shall be ordered to stop using and sealed up according to law.
Article 35 After receiving the elevator accident report, the special equipment safety supervision and management department shall immediately rush to the scene, verify the situation, report it in accordance with the regulations, and investigate and deal with it in conjunction with the safety supervision, public security, supervision, trade unions and other departments according to law.
Article 36 The provincial special equipment safety supervision and management department shall gradually establish and improve the province-wide unified elevator safety information dynamic management system, record and timely analyze and process elevator manufacturing, installation, renovation, maintenance, maintenance, safety assessment, inspection, supervision and spot check and other information, and provide inquiry services to the society.
Special equipment safety supervision and management departments and other relevant departments should establish elevator safety credit management system, give full play to the role of elevator manufacturing units, installation, renovation and maintenance construction units, maintenance units, users, inspection and testing institutions, industry associations and news media, and build a social evaluation system for elevator safety credit.
Chapter VII Legal Liability
Thirty-seventh in violation of the provisions of these measures, laws and regulations have provisions on administrative punishment, from its provisions.
Thirty-eighth elevator users in violation of the provisions of these measures, one of the following acts, the special equipment safety supervision and management department of the people's government at or above the county level shall be ordered to make corrections within a time limit. If no correction is made within the time limit, a fine of more than 3,000 yuan 1 0,000 yuan shall be imposed:
(a) did not develop a sound elevator safety management system;
(two) the elevator emergency alarm device can not be used normally;
(3) Failing to take timely measures to organize rescue when passengers are trapped due to elevator failure, resulting in passengers staying in the car for more than 1 hour;
(four) after the change of the elevator maintenance unit, the change procedures are not handled in time according to the regulations;
(five) the interior decoration of the elevator car is not carried out according to the regulations;
(6) Stop using elevators that fail to set stop signs, protective measures and publicize relevant information as required, or fail to cut off the main power supply of elevators.
Thirty-ninth in violation of the provisions of these measures, under any of the following circumstances, the special equipment safety supervision and management department of the people's government at or above the county level shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 1 10,000 yuan but not more than 30,000 yuan shall be imposed:
(1) The elevator manufacturer fails to indicate the design service life or times and quality guarantee period of important components such as elevators, traction machines and brakes;
(two) the elevator transformation unit failed to replace the product nameplate of elevator transformation in time, and indicated its unit name, transformation date and license number on the product nameplate and transformation quality certificate;
(three) the entrusted unit subcontracts the elevator installation, renovation and maintenance business;
(four) the elevator in the public gathering place is not equipped with the elevator safety operation monitoring system according to the regulations.
Fortieth in violation of the provisions of these measures, the elevator maintenance unit has one of the following circumstances, and the special equipment safety supervision and management department of the people's government at or above the county level shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 1000 yuan and 5,000 yuan shall be imposed:
(a) the elevator maintenance sign is not posted or the maintenance record is not confirmed and signed by the safety management personnel of the user unit;
(two) to employ the operators of other elevator maintenance units to carry out elevator maintenance.
Forty-first in violation of the provisions of these measures, the elevator maintenance unit has one of the following circumstances, and the special equipment safety supervision and management department of the people's government at or above the county level shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 6.5438+0 million yuan and 30,000 yuan shall be imposed.
(1) Subcontracting or subcontracting the maintenance business;
(2) Dismantle the elevator safety protection device and short-circuit the safety circuit.
