First, what is the right of property management?
Property management right refers to the right exercised by property management companies in management activities. Property management right is a right derived from real right. In this sense, the person who exercises the right of management should be the owner and owner of the building and its appendages.
2. Who will exercise the right of property management in residential areas?
The property management right of residential areas shall be exercised by the owners. Owners generally refer to the owners and users of real estate in residential areas, or owners of commercial buildings, industrial areas and other properties. Owners' exercise of property management rights is generally realized through the owners' meeting and the property management Committee.
The owners' assembly consists of the owners of residential areas or properties. When the residential area is delivered and the occupancy rate reaches more than 50%, the district real estate management department shall, in conjunction with the development and construction unit, convene the first owners' meeting in time. Only the owners who hold more than half of the voting rights can hold the owners' meeting (the voting right is one room, one vote for the house; /kloc-one vote per 100 square meter of construction area for non-residential houses over 0/00 square meter, and one vote per certificate for non-residential houses with real estate ownership certificate under 0/00 square meter). The owner may entrust an agent to attend the owners' meeting, and the owner under the age of 18 shall be represented by his legal representative.
Three, the owners' congress has the following powers:
1 Elect and remove members of the property management committee;
2. Supervise the work of the Management Committee;
3 to listen to and consider the work report of the CMC;
4. Decide on major issues concerning the interests of the owners of residential areas (or other properties);
5. Amend the owners' convention;
6. Changing and revoking inappropriate decisions of the Central Military Commission;
7. Approve the articles of association of the management committee.
