Article 2 The term "existing multi-storey houses" as mentioned in these Measures refers to multi-owner houses with more than four floors without elevators that have been built and put into use on the state-owned land in Kuiwen District, Weicheng District, Fangzi District, Hanting District and Comprehensive Bonded Zone in the downtown area of Weifang. If the residential special maintenance fund is not deposited, it shall be paid by the elevator owner according to 35 yuan /m2, which shall be used for elevator maintenance and elevator equipment renovation.

Article 3 Adding elevators to existing multi-storey houses shall follow the principles of voluntary participation of owners, full consultation, independent implementation, government guidance and ensuring safety.

Article 4 The district governments and municipal administrative committees of relevant development zones shall be responsible for the overall coordination of adding elevators to existing multi-storey residential buildings within their respective jurisdictions, and the sub-district offices shall be specifically responsible for the consultation of owners' opinions on adding elevators and the coordination of objections.

The municipal housing and urban-rural construction department is responsible for the guidance and policy propaganda of installing elevators in existing multi-storey houses, and takes the lead in formulating technical guidelines for installing elevators. Planning, fire protection, special equipment safety supervision and management departments and water supply, power supply, heating, gas, communications, cable television and other operating units actively cooperate according to their respective functions.

Article 5 The funds needed for adding elevators shall be raised by the owners themselves, and shall be jointly funded by the owners according to a certain proportion, and shall be decided by the owners through consultation. If there is a housing provident fund, you can apply for the housing provident fund of yourself and your spouse with the relevant proof that you have paid extra elevator construction funds. The existing multi-storey residential buildings in the central city are added with elevators. The government will give appropriate subsidies to the owners of elevators according to the standard that each elevator is not higher than 654.38+0.5 million yuan, and the elevators will be built first and then supplemented. Specific subsidy standards, urban sharing ratio, etc. , by the municipal finance department in conjunction with the housing and urban and rural construction departments to study and formulate.

Article 6 The addition of elevators to existing multi-storey residential buildings cannot change the main structural form of the original building, which meets the requirements of planning, structural safety, fire fighting distance and safe evacuation, and the location of adding elevators should be within the boundaries of the original building project. Organize the implementation in units of buildings or units.

The applicant shall, in accordance with the provisions of Article 76 of the Property Law, fully negotiate the intention and specific scheme of adding elevators, and solicit the opinions of all the owners of this unit, and obtain the consent of the owners whose exclusive parts account for more than two-thirds of the total construction area and more than two-thirds of the total number of people.

On the basis of self-consultation by the owners and consultation organized by the industry committee, a consultation platform will be set up with the participation of neighborhood committees, and democratic consultation and hearing will be conducted to guide all stakeholders to rationally express their opinions and demands, seek the greatest common denominator of the wishes of all parties, and properly solve problems and contradictions. Involving party and government organs, enterprises and institutions, villages and other relatively concentrated residential areas, the above units should make consultations with the streets and neighborhood committees.

On the basis of self-consultation, street community consultation and unit consultation of the owners, if no agreement can be reached on matters such as the balance of interests between the owners, the parties may bring a lawsuit to the people's court according to law.

Article 7 All owners who use elevators in this unit are project applicants, and as the construction unit, they undertake the obligations stipulated by laws and regulations.

The applicant may entrust 1 to 3 owners' representatives as agents to undertake the related work of adding elevators, or entrust owners' committees, neighborhood committees, original property management units, elevator installation enterprises and related intermediary service agencies as the main bodies to organize the related work of adding elevators and handle the relevant examination and approval procedures such as planning, construction and quality inspection.

Article 8 The implementer shall organize elevator users to reach the following written agreement on adding elevators:

Authorize the owner's representative or relevant units to handle the relevant examination and approval procedures for new elevator projects and sign the entrustment agreement;

Cost budget and financing plan for adding elevators;

Clear elevator users, elevator maintenance plan and operating cost budget, as well as related cost sharing plan;

Fund-raising plan and compensation plan for owners whose interests have been damaged.

Article 9 When elevators are added to existing multi-storey residential buildings, design units with corresponding qualifications shall refer to the building construction drawings, structural construction drawings, geological exploration reports and other materials of the residential buildings with elevators, and issue design schemes that meet the relevant norms and standards of building structural safety, fire safety and special equipment. The design scheme shall be publicized in a prominent position in the property area where the elevator is to be added and the main entrance and exit of this unit, and the publicity period shall not be less than 7 days. If objections are received during the publicity period, the design unit shall explain and reply to the objections, incorporate the rationalization suggestions into the design scheme, optimize the design scheme, and reduce the adverse impact on the adjacent owners.

Article 10 The applicant shall go to the local natural resources and planning department to handle the examination opinions on adding elevators, and provide the following materials:

Declaration form of elevator planning and design scheme for existing multi-storey residential buildings in the central city;

The applicant's identity card, power of attorney and letter of commitment;

2 sets of additional elevator construction scheme design documents issued by a design unit with corresponding qualifications, and provide electronic format documents of the design documents at the same time;

Other materials as prescribed by laws and regulations.

Eleventh the applicant shall go to the local housing and urban-rural construction department to handle the construction filing procedures, and provide the following materials:

Increase the application form for elevator construction record;

Add elevator planning review opinions;

Construction contract, scheme and qualification certificate;

Supervision contract, scheme and qualification certificate;

The design unit shall issue the construction drawing design documents reviewed by the drawing review organization, including the construction drawing design documents and calculation data related to the addition of elevators;

Other materials as prescribed by laws and regulations.

Article 12 The applicant shall take overall responsibility for the safety production in the whole construction process of new elevator projects, and the design, construction and supervision units and elevator enterprises shall bear corresponding responsibilities in accordance with relevant laws and regulations. The housing and urban-rural construction department of the project area should strengthen the supervision of safety production on the construction site of adding elevators and supervise the quality of construction projects involved in elevator installation and operation. When adding elevators to the construction site, obvious signs must be set up, indicating the name of the project, the name and contact number of the project leader of the construction unit, design unit, construction unit and supervision unit, the opening and completion date, planning review opinions, construction filing procedures, etc. Consciously accept the supervision of the masses.

Thirteenth of the existing multi-storey residential planning review and construction filing procedures, the relevant owners should provide the necessary construction convenience, and shall not obstruct or destroy the construction. Those who obstruct the construction and cause economic losses to other owners shall be liable for compensation according to law. Intentionally obstructing or destroying the construction in violation of the "People's Republic of China (PRC) Public Security Administration Punishment Law" shall be dealt with by the public security organs according to law.

Fourteenth before the elevator installation, the elevator installation unit shall inform the special equipment safety supervision and management department in writing. The elevator installation process shall be subject to the supervision and inspection of special equipment inspection institutions.

Fifteenth after the completion of the elevator installation, the implementation of the main body shall organize the design, construction and supervision units to participate in the completion acceptance, and go through the completion acceptance procedures with the housing and urban-rural construction departments.

Article 16 Before the elevator is put into use, the applicant shall specify the elevator user and maintenance unit. The elevator user shall register the use of the elevator within 30 days before the elevator is put into use, and receive and post the elevator use sign. Units using special equipment shall establish safety technical files and store the data in the files.

Seventeenth new elevator property belongs to the investor, and it is no longer necessary to change the pool area of each owner and other related procedures. If the owner or user of the relevant house changes, the transferor shall inform the transferee of the addition of the elevator and hand over the relevant information.

Eighteenth these Measures shall come into force as of May 6, 2020, and shall be valid until April 30, 2023. Counties and cities, Binhai Development Zone and Xiashan Development Zone shall be implemented with reference. The Interim Measures for the Administration of Adding Elevators to Existing Multi-storey Residential Buildings in Weifang City Center shall be abolished at the same time.
