Measures of Wuhan Municipality on the Administration of Construction Waste (202 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the management of construction waste and maintain the city appearance and environment, these measures are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations of Wuhan Municipality on the Administration of City Appearance and Environmental Sanitation, and the Regulations on the Administration of Urban Construction Waste (Order No.2001of Wuhan Municipal Government). The Ministry of Construction 139) and other relevant laws, regulations and rules, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the disposal activities such as reduction, collection, transportation, consumption and utilization of construction waste within the administrative area of this Municipality and their supervision and management.

The term "construction waste" as mentioned in these Measures refers to the waste soil, materials and other wastes generated by the new construction, renovation, expansion and demolition of various buildings, structures, pipe networks, road facilities and renovated houses. Article 3 The disposal of construction waste shall follow the principles of reduction, recycling, innocuity, and whoever produces and bears the responsibility for disposal. Article 4 The municipal and district people's governments (including Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, and East Lake Eco-tourism Scenic Area Management Committee, the same below) shall strengthen their leadership over the management of construction waste, establish a supervision and coordination mechanism for the disposal of construction waste, make overall plans to solve major problems in the management of construction waste, and incorporate the construction and comprehensive utilization of construction waste disposal sites into the development plan of circular economy. Fifth city urban management law enforcement department is the competent department of construction waste management in this city, responsible for organizing, coordinating, supervising and assessing the management of construction waste in this city, and investigating major illegal acts in construction waste disposal activities. The urban management law enforcement departments of all districts are responsible for the daily supervision and management of construction waste disposal within their respective jurisdictions.

The competent department of urban and rural construction shall supervise and manage the construction waste on the construction site in accordance with the requirements of civilized construction, and be responsible for the utilization and management of construction waste recycled building materials and products in construction projects.

The traffic administrative department of the public security organ shall be responsible for the road traffic management of construction waste transport vehicles, supervise the implementation of traffic time and routes, and investigate and deal with relevant road traffic safety violations.

Transportation, development and reform, natural resources and planning, finance, water affairs, market supervision, housing security and housing management, ecological environment, civil defense, emergency management and other departments are responsible for the related work of construction waste management according to their respective responsibilities. Article 6 The District People's Government is the main body responsible for the treatment and management of construction waste in this area. Township people's governments and sub-district offices shall organize daily inspections, timely discover and discourage illegal acts of construction waste disposal, and report to the urban management law enforcement departments in their respective jurisdictions.

Land, mines, woodland, green belts, rivers, lakes, dams, railways, highways, bridges and other ownership units or management units shall strengthen daily inspections, promptly deal with illegal acts related to construction waste disposal, and report to the urban management and law enforcement departments under their jurisdiction.

Construction waste transport industry associations should strengthen industry self-discipline and cooperate with urban management law enforcement departments to do a good job in construction waste disposal. This Municipality encourages and supports the construction waste transportation industry associations to formulate group standards and regulate the related work of construction waste transportation and disposal. Chapter II General Provisions Article 7 The municipal urban management and law enforcement department shall establish an information platform for the supervision and management of construction waste, so as to realize information sharing in the aspects of classified treatment, reduction and emission reduction, collection, transportation, transit, sorting, consumption and utilization of construction waste. The relevant departments shall provide the following relevant information to the construction waste supervision and management information platform and update it in time:

(a) urban management law enforcement departments to provide construction waste disposal and investigate and deal with illegal cases of construction waste disposal and other related information;

(two) natural resources and planning departments to provide construction waste disposal sites and other related information;

(three) the urban and rural construction departments to provide construction sites and other relevant information for the construction permit;

(four) the traffic department to provide road transport permits, drivers' qualifications and other related information;

(five) the traffic management department of the public security organ provides the traffic time and route of construction waste transport vehicles, as well as traffic violations, surveillance videos and other related information;

(six) the ecological environment department to provide relevant information, investigate and deal with illegal acts of environmental pollution caused by construction waste according to law;

(seven) the garden and forestry departments provide relevant information such as waste soil required for the backfilling and utilization of construction waste;

(eight) the District People's government to provide relevant information on the construction waste generated by the demolition site;

(nine) other information required by the relevant departments. Eighth construction waste disposal supervision system to ensure the production, transportation and consumption of construction waste. Construction waste disposal supervision begins when the transport vehicle leaves the construction site and ends when the transport vehicle arrives at the designated disposal site. Relevant information shall be confirmed by the construction unit, transportation unit and disposal site management unit respectively.

The construction site and the consumptive place shall establish a consumptive management accounting system; Urban management law enforcement departments should strengthen the supervision of consumption management accounting, regularly check the operation of consumption management accounting, and promptly investigate and deal with illegal acts of consumption management accounting. Ninth construction units or construction waste generating units shall be fully responsible for the disposal of construction waste.

The construction unit shall fully allocate the construction waste disposal expenses when preparing the budgetary estimate and budget of the construction project.

When the construction unit directly contracts, it shall specify in the contract that the construction unit is the construction waste disposal management unit at the construction site, and specify the specific requirements and relevant measures for the construction waste management at the construction site; If the responsibility of the construction unit is not specified in the contract, the construction unit shall be the construction waste disposal management unit on the construction site.

In the process of construction waste transportation, the construction unit shall urge the transportation enterprises to transport construction waste according to the specified time and route, so as to ensure that the transportation volume of construction waste is consistent with the output.

When the construction waste is transported to the disposal site, the construction unit and the disposal site shall check and confirm the source, type, quantity and other information of the construction waste to ensure that the consumption and output of the construction waste are consistent.
