Is there a right to fine for renovating illegal properties?

Legal analysis: property has no right to fine. According to the law, administrative punishment can only be exercised by administrative organs with the power of administrative punishment within the scope prescribed by law. Property companies are not administrative organs, and the relationship between property and decoration companies is equal. The property can only collect liquidated damages from the defaulting decoration company according to the contents of the contract signed by both parties, and the liquidated damages shall be subject to the actual losses.

Legal basis: Article 9 of the Administrative Punishment Law of the People's Republic of China: (1) Warning, informed criticism; (two) fines, confiscation of illegal income and confiscation of illegal property; (three) the license is temporarily withheld, the qualification level is lowered, and the license is revoked; (4) Restricting production and business activities, ordering production and business suspension, ordering closure and restricting employment; (5) Administrative detention; (6) Other administrative penalties as prescribed by laws and administrative regulations.

Article 585 of the General Principles of the Civil Law of People's Republic of China (PRC) * * * The parties may agree that if one party breaches the contract, it shall pay a certain amount of liquidated damages to the other party, or they may agree on the calculation method of damages for breach of contract. If the agreed liquidated damages are lower than the losses caused, the people's court or arbitration institution may increase the liquidated damages at the request of the parties; If the agreed liquidated damages are excessively higher than the losses caused, the people's court or arbitration institution may appropriately reduce them at the request of the parties. If the parties concerned pay liquidated damages for delayed performance, the breaching party shall also perform the debt after paying the liquidated damages.
