The separation and transfer of water supply, power supply, heat supply (gas supply) and property management (collectively referred to as "three supplies and one industry") in the family areas of employees of state-owned enterprises is an important content to divest the social functions of state-owned enterprises. Stripping the social function of enterprises is the premise and important content of deepening the reform of state-owned enterprises, an important measure of supply-side structural reform and a major livelihood project. Stripping off the social functions of enterprises not only reduces the burden on enterprises, but also innovates the system and mechanism. State-owned enterprises are required to take responsibility bravely, overcome difficulties and make up their minds to fundamentally solve social burdens and problems left over from history.

Guiding opinions on the separation and transfer of "three supplies and one industry" in the family area of state-owned enterprises; The separation and transfer of water supply, power supply, heating (gas supply) and property management (collectively referred to as "three supplies and one industry") in the family area of state-owned enterprises is an important content of stripping off the social functions of state-owned enterprises, which is conducive to reducing the burden on state-owned enterprises, concentrating on developing their main businesses, integrating resources, upgrading infrastructure and further improving the living environment of employees. Since 20 12, the state-owned assets supervision and administration commission of the State Council and the Ministry of Finance have successively carried out the pilot work of separation and transfer of central enterprises in Heilongjiang, Henan, Hunan, Chongqing, Liaoning, Jilin, Guangdong, Hainan, Sichuan, Guizhou and other provinces (cities) 10, and achieved positive results, accumulating experience for comprehensively carrying out the separation and transfer work. In order to implement the relevant decision-making arrangements of the CPC Central Committee and the State Council, and promote the separation and transfer of "three supplies and one industry" in the family areas of employees of state-owned enterprises, we hereby put forward the following opinions:

I. General requirements

(1) Work objectives. Starting from 20 16, we will comprehensively promote the separation and transfer of "three supplies and one industry" in the employee's family areas of state-owned enterprises (including central enterprises and local state-owned enterprises), carry out necessary maintenance and transformation of related equipment and facilities, reach the average level of urban infrastructure, set up meters and charge by households, and hand them over to specialized enterprises or institutions for social management, which will be basically completed by the end of 20 18. From 20 19, state-owned enterprises will no longer bear the expenses related to "three supplies and one industry" in the employee's family area in any way.

(2) Job requirements. Adhere to the combination of policy guidance and enterprise autonomy, promote the professional operation of public services, improve service quality and operational efficiency, and state-owned enterprises will no longer undertake public services that are inconsistent with the development direction of their main business. State-owned enterprises are not allowed to subsidize the "three supplies and one industry" in the employee's family area in addition to wages and benefits, effectively reduce the burden on enterprises, and ensure that state-owned enterprises go into battle lightly and participate in market competition fairly. In principle, the handover shall be completed first, and then the maintenance and transformation shall be carried out. In accordance with the requirements of reasonable technology, economical application and reliable operation, we will give priority to maintenance and supplement transformation to promote the optimal integration of urban infrastructure. The separation and transfer work shall implement the relevant standards and policies promulgated by the local people's governments at or above the prefecture level, and ensure that the equipment and facilities meet the basic standards and operate normally after separation and transfer.

Second, the main task

(3) Clear the subject of responsibility. The main body responsible for the separation and handover work is the enterprise. The transfer enterprise and the receiving unit shall sign a separation and transfer agreement according to the present situation of "three supplies and one industry" equipment and facilities, negotiate the maintenance and transformation standards and organize the implementation plan. , clear the responsibilities of both parties, to ensure the effective convergence of work.

(four) standardize the audit procedures. If the receiving unit is a state-owned enterprise or a government agency, the assets involved shall be transferred free of charge in accordance with the provisions of the Notice of the Ministry of Finance on Financial Management Issues Concerning Social Functions of Enterprises (No.62 [2005] of Caiqi), which shall be examined and approved by the enterprise group company and reported to the competent financial department at the same level and the state-owned assets supervision and administration institution for the record.

(5) Strict handover procedures. Transfer enterprises should do a good job in the transfer of assets inventory, financial cleaning, audit evaluation, property rights change registration and other work, and carry out financial treatment in accordance with the provisions of document No.62 [2005] of Caiqi. Enterprises with multiple shareholders, with the consent of the board of directors or the shareholders' meeting, reduce their state-owned rights and interests in proportion to their shareholding.

(six) clear financial rules. An enterprise shall conduct financial treatment and accounting in accordance with the General Principles of Enterprise Finance and the Accounting Standards for Enterprises, and report the basis and methods of accounting treatment as major financial matters to the state-owned assets supervision and administration institution at the same level for the record. The impact of separation and transfer on the financial status and operating results of an enterprise shall be subject to special verification opinions issued by an intermediary institution and reported to the state-owned assets supervision and administration institution at the same level for the record.

(seven) the proper placement of personnel. The employees involved in the transfer of "three supplies and one industry" shall, in principle, receive resettlement according to the policy standards formulated by local people's governments at or above the prefecture level. If they cannot be accepted according to relevant policies, they shall be properly resettled by the transfer enterprise. Enterprise group companies and handed-over enterprises should do a good job in the connection of related work, carry out ideological and political work in depth and in detail, and ensure the normal operation of enterprises and the stability of the workforce.

(eight) explore the transfer mode. Property management in the family areas of employees of state-owned enterprises can be accepted by state-owned property management companies, or by relevant units designated by the local government to support state-owned property management companies with strong strength and good reputation to receive property management functions transferred from enterprises across regions. In the employee's family areas that have undergone housing reform, under the guidance of the local government, the owners' congress will select property management institutions in a market-oriented way, or the owners will manage themselves.

Third, safeguard measures.

(9) The cost of separation and transfer shall be shared by the enterprise and the government. The separation and transfer fees of "three supplies and one industry" include related facilities maintenance fees, feasibility study fees, design fees, old equipment and facilities demolition fees, construction fees, supervision fees, etc. The cost of separation and transfer of central enterprises is subsidized by the central finance (state-owned capital operating budget) by 50%, and the proportion borne by the central enterprise group company and the competent enterprise of the transfer enterprise is not less than 30%, and the rest is borne by the transfer enterprise itself. The cost of separation and transfer of the former policy bankrupt central enterprises shall be fully borne by the central finance (state-owned capital operating budget). The transfer fee for the separation of central enterprises shall be applied, pre-allocated and liquidated in accordance with the relevant requirements, and the specific measures shall be formulated separately by the relevant departments. The local people's government should clearly solve the problem of division and transfer of local state-owned enterprises. Among them, after 1998 65438+ 10/0/,enterprises such as coal, nonferrous metals and military industry (including policy bankrupt enterprises) decentralized by the central government will be appropriately subsidized by the central government, and the specific measures will be formulated separately by the Ministry of Finance. Because the separation and transfer of "three supplies and one industry" has a great influence on the performance appraisal indicators of enterprises, it can be properly considered when conducting performance appraisal.

Fourth, organize and lead.

(10) Play a local role. Local people's governments at all levels should attach great importance to the separation and transfer of "three supplies and one industry" in the family areas of employees of state-owned enterprises, decompose the objectives and tasks in combination with practical work measures, go through relevant procedures in time, establish green channels, simplify procedures, improve efficiency and create a convenient working environment. The people's governments at the provincial level should clarify the division of responsibilities, formulate specific work plans, and coordinate and promote the work of central enterprises and local state-owned enterprises in the region. The municipal people's government shall formulate and improve the working methods, coordinate the implementation of receiving units, study and solve specific problems, and implement the whole process management of separation and transfer. Local state-owned assets supervision and administration institutions and financial departments at all levels should keep abreast of the progress of the work, urge and guide relevant enterprises to do a good job of separation and transfer.

(eleven) the implementation of corporate responsibility. State-owned enterprise group companies should strengthen organization and coordination and actively promote the separation and transfer of "three supplies and one industry" of their subordinate enterprises. State-owned enterprises engaged in the specialized operation of "three supplies and one industry" should establish a sense of the overall situation, take the initiative to assume social responsibilities, and actively participate in the separation and transfer work. Transfer enterprises and receiving units should seriously organize the implementation, strictly follow the relevant provisions, standardize the use of separated transfer funds, and severely deal with unauthorized misappropriation and illegal use in accordance with the relevant provisions of the Regulations on Penalties and Punishment for Financial Violations.
