Regulations of Wuhan Municipality on the Administration of Housing Safety

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this Municipality in order to strengthen the management of housing safety and ensure the safety of housing residence and use. Article 2 These Regulations shall apply to the safety management of houses built and put into use according to law within the administrative area of this Municipality.

The city's housing fire safety, equipment and facilities use safety management and illegal building disposal, the army, religious groups, cultural relics protection units and outstanding historical buildings, historical and cultural blocks of housing safety management, in accordance with the provisions of relevant laws, regulations and rules. Article 3 The municipal and district people's governments (including the administrative committees of development zones, scenic spots and chemical zones, the same below) shall strengthen their leadership in the management of housing safety, establish a housing safety supervision and management network composed of housing management departments, relevant administrative departments, neighborhood offices and township (town) people's governments, and organize and coordinate relevant departments to do a good job in the supervision and management of housing safety. The District Housing Authority is responsible for formulating the implementation plan for emergency rescue of housing safety, organizing the safety inspection of dangerous houses, handling emergencies of housing safety, and investigating and dealing with acts endangering housing safety.

City and district housing authorities may entrust their affiliated housing safety management institutions to be specifically responsible for the daily supervision and management of housing safety. Article 5 The competent department of construction shall be responsible for supervising and managing the construction units and construction enterprises to implement the safety protection measures for houses around the construction area, the safety maintenance of existing building curtain walls, and the investigation and punishment of illegal decoration.

Urban management law enforcement departments are responsible for investigating and dealing with illegal construction in the use of houses.

Other relevant departments of the Municipal People's Government shall, in accordance with their respective responsibilities, do a good job in housing safety management. Sixth street offices, township (town) people's government with the housing authorities to do a good job in the area of housing safety management. Seventh people's governments at all levels should include special funds for housing safety supervision and management in the financial budget to ensure the needs of housing safety supervision and management. Article 8 This Municipality implements a housing safety management assistance system. The municipal and district people's governments set up special funds for housing security assistance to provide appropriate subsidies for housing security appraisal, dangerous housing management and termite control of families with special difficulties.

Measures for the management and use of special funds for housing security assistance shall be formulated separately by the Municipal People's Government. Ninth city housing authorities should strengthen the guidance and supervision of housing safety appraisal, termite control industry associations, support industry associations to carry out their work according to law, and give play to the role of industry associations in housing safety management.

Housing safety appraisal and termite control industry associations shall formulate industry norms and announce them to the public, strengthen industry self-discipline and accept social supervision. Tenth housing authorities should strengthen the publicity and education of housing safety knowledge and improve the public's awareness of housing safety.

Any unit or individual has the right to dissuade, report and complain about acts that endanger the safety of houses. Housing management departments, relevant administrative departments, sub-district offices and township (town) people's governments shall promptly accept and investigate according to law in accordance with their statutory duties. Chapter II Safety Management of House Use Article 11 The owner of a house is the person in charge of house safety. Houses are directly managed public houses, and the management unit is the person responsible for housing safety.

The lessee, borrower and other users of the house shall use the house reasonably in accordance with the provisions of laws and regulations and the contract, and bear the responsibility for the safety of the house. Twelfth development and construction units shall, in accordance with the provisions of laws and regulations and the contract, bear the responsibility for the warranty and handling of housing quality defects during the warranty period.

Before the new house is delivered for use, the development and construction unit shall submit the housing quality guarantee, housing instruction manual and other relevant documents to the transferee, and clearly inform the transferee of the basic situation, design service life, performance indicators, use and maintenance requirements, warranty scope and duration.

Housing survey, design, construction, supervision and other units shall bear the responsibility for housing safety in accordance with the provisions of the contract signed with the development and construction unit and relevant laws and regulations. Article 13 Where some houses are subject to daily management and property management, the property service enterprise shall undertake daily management responsibilities such as house safety inspection, repair and maintenance in accordance with the agreement, and inform the person in charge of house safety in writing of matters needing attention and prohibited acts. If illegal acts are found, they should be discouraged. If dissuasion fails, they should report to the relevant departments in a timely manner; If autonomous management is implemented, the person responsible for housing safety shall bear the daily management responsibilities such as safety inspection, repair and maintenance according to law.

The daily management responsibility of the exclusive part of the house shall be borne by the person responsible for housing safety according to law. Article fourteenth the person in charge of housing safety shall bear the following responsibilities for the safety of housing use:

(a) the rational use of the house according to the design purpose, the nature of the use of the building and the purpose of the house recorded in the house ownership certificate;

(two) inspection and maintenance of houses, timely management of housing security risks;

(three) the decoration of the house shall not affect the use of the house, and shall not endanger the safety of the use of the house and the safety of the adjacent houses;

(4) controlling termites;

(five) commissioned by the housing safety appraisal;

(six) take other necessary measures to ensure the safety of the house.
