Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of all parties involved in property management, improve the living environment and promote social harmony, these Regulations are formulated in accordance with the basic principles of the People's Republic of China (PRC) Property Law, the Property Management Regulations and other laws and administrative regulations, and in combination with the actual situation of Shantou Special Economic Zone (hereinafter referred to as the Special Zone). Article 2 These Regulations shall apply to property management and its supervision and management activities in the Special Zone. Article 3 Property management should adhere to the people-oriented principle and implement the principle of combining owner autonomy with professional services and community management. Article 4 The municipal, district (county) people's governments and relevant departments shall formulate supporting policies and take measures to promote the socialization, specialization and marketization of property services and promote the healthy development of the property services industry. Fifth city real estate administrative departments responsible for the supervision and management of property management activities, organize the implementation of these regulations.

District (county) real estate administrative departments shall be responsible for the supervision and management of property management within their respective administrative areas. The district (county) people's government has not set up a real estate administrative department, and the municipal real estate administrative department shall uniformly implement the supervision and management of property management activities.

Housing and urban and rural construction, civil affairs, urban and rural planning, comprehensive urban management, water supply, health, price, environmental protection, public security, industrial and commercial administration, civil air defense and other administrative departments. Responsible for the supervision and management of property management activities according to their respective responsibilities. Article 6 Sub-district offices and town people's governments shall be responsible for coordinating the relationship between property management and community construction, organizing and guiding the establishment of the owners' meeting and the election of the owners' committee, and assisting the real estate administrative departments in mediating and handling property management disputes.

Community residents' committees and villagers' committees are responsible for guiding and supervising the owners' congress and the owners' committee to carry out owners' autonomous management according to law, and assisting neighborhood offices and town people's governments to carry out work related to property management in community management and community service. The joint meeting shall be convened by the neighborhood offices and the Town People's Government where the property management area is located, and shall be composed of representatives of the real estate administrative departments, community residents' committees, villagers' committees, public security police stations, property service enterprises, owners' committees and relevant administrative departments.

The joint meeting of property management mainly coordinates and solves the following main problems:

(a) the owners' committee fails to perform its duties according to law;

(two) there are problems in the process of establishing the owners' committee;

(three) there are major problems in the performance of the property service contract;

(four) the realty service enterprise has problems in the process of change and handover;

(five) other property management contradictions and disputes that need to be resolved through coordination. Article 8 Property management industry associations shall strengthen industry self-discipline according to law, standardize industry behaviors, establish integrity files of property service enterprises and their employees and an expert database for bidding and evaluation of property service projects, urge property service enterprises to operate and serve in good faith according to law, assist real estate administrative departments to implement specialization and marketization of property services, mediate internal disputes in the industry, safeguard the legitimate rights and interests of members, train employees and promote the healthy development of the industry. Chapter II Property Management Areas and Supporting Facilities Article 9 In dividing property management areas, factors such as property facilities and equipment, building scale and community construction should be considered, and the principle of relative concentration and easy management should be followed. The specific division method is as follows:

(a) the property management area is demarcated in accordance with the scope of the red line map determined by the construction land planning permit. If it has naturally formed an independent property management area and is uncontroversial, it will not be demarcated again;

(two) the property developed by stages or by two or more construction units, and its supporting facilities and related sites shall be designated as a property management area; Supporting facilities and related sites can be used independently and can be divided into different property management areas;

(three) different adjacent property management areas that have implemented property management, which are small in scale, can be merged into one property management area with the consent of their respective owners' meetings;

(four) the old city, the village in the city and other residential areas that have not implemented property management need to implement property management, and the street offices and the Town People's Government shall determine the property management area after soliciting the opinions of the relevant owners.

In case of disputes over the demarcation of the property management area, the real estate administrative department shall solicit the opinions of the neighborhood offices, the town people's government, the relevant owners, the community residents' committees and the villagers' committees where the property is located.

The delineation of property management areas shall be filed with the real estate administrative department in accordance with the relevant provisions of provinces and cities. Article 10 If it is necessary to separate or merge the property management area after the demarcation of the property management area, the owners' congress or the owners shall apply to the subdistrict office and the town people's government, and submit a plan for separation or merger, which shall be reviewed and confirmed by the subdistrict office and the town people's government in conjunction with the real estate administrative department and announced.

The division or merger plan of the property management area shall be approved by the owners' meeting of the relevant property management area; If the owners' meeting has not been established, it shall be decided by the owners' meeting. Eleventh new residential property, the construction unit should be in the property management area in accordance with the proportion of not less than two thousandths of the total construction area of the property management area, the allocation of property services, the construction area of not less than 80 square meters, the maximum not more than 300 square meters; Among them, the office space of the realty service enterprise shall not be less than 60 square meters, and the office space of the owners' committee shall not be less than 20 square meters.

For residential properties developed and built by stages, the construction unit shall allocate property service rooms in the pre-developed areas according to the proportion of not less than two thousandths of the pre-developed housing construction area.
