Is it reliable to buy a house and send an area? Look how big this pit is, cheat people.

On the surface, the gift area of buying a house can make buyers enjoy a lot of benefits, but because the source of the gift area is doubtful, the official does not recognize this form, which hides many risks and requires buyers to think twice before acting.

The gift area is suspected of illegal construction.

Originally thought to enjoy the benefits given by developers, but in the end it became "illegal construction", and the huge gap before and after made many owners call it "incredible".

More than a month ago, about 300 owners of a residential area in Minhang District, Shanghai received registered letters one after another, with certificates of illegal buildings attached, indicating that these houses had been found to have illegal buildings, so they were "noticed" by the real estate registration department and their transactions were frozen. Mr. Liu, the owner of the third phase of the community, confirmed to reporters that this was true, but it was mainly because some houses in the first and second phases of the community were found to be illegally built.

The reporter consulted a nearby real estate agent as a property buyer, and the answer was that sales were at a standstill recently because some houses were found to be illegally built. Although an intermediary strongly invited reporters to look at the house in the past, and said that the developer is working on solving this matter, it is not known when to restart the transaction.

According to the situation posted by the relevant urban management law enforcement squadron in Minhang District, illegal construction mainly exists in the balcony on the second floor of residential overlapping villas, townhouses and small high-rise townhouses. When handing over the house, there is a frame and a fence, but there is no floor. According to the owner, the developer explained that once the floor is poured, the balcony must be counted as half of the construction area. And hollowed out, the balcony area can be given to the owner as a whole. This is not difficult to understand, because at that time, buying more rooms was quite popular. Therefore, in the process of owner's decoration, some owners use reinforced concrete to fill the balcony floor. Because of this, some houses are considered to be illegal buildings.

The reporter found that a similar situation happened not only in Shanghai but also in Nanjing. It is understood that the 88-square-meter "2+ 1" room in a building in the north of Nanjing, the small room presented in the north, is actually a light well renovation, and now it is listed as illegal by the urban management department of Qixia District and needs to be demolished. According to the survey, there are about 400 households in this situation. The owner disagreed, and the rights developer demanded compensation.

The gift area is popular.

Buying a house and giving away an area once became a very common means of promotion in the market.

"Buy one floor and get one free", "N+ 1 apartment type" and "give it to home garden" ... I believe these sales rhetoric are no longer unfamiliar to many buyers, and some buyers also take a fancy to the gift area of the property before finally "deciding". In the interview, the reporter also found that wherever there is a gift area, it will be used as the main selling point to focus on publicity without exception.

There are several reasons why developers "try their best" in the gift area. The first is to avoid policy regulation. In 2006, the "90/70 Policy" was introduced. On the one hand, in order to meet the market demand for large-area housing, developers have to consider policy norms, and on the other hand, they can only seek breakthroughs in apartment layout for products below 90 square meters, so the way of "sending area" came into being and became popular everywhere. The second is that the land price is getting higher and higher, but in order to let buyers enter the market at a higher price, developers try their best to increase the added value, such as giving away the area, which has become the "trump card" of most developers.

It is understood that there are various ways to give away the area. For example, it is normal to buy a LOFT apartment and give it a floor, and buy a villa and give it a garden, basement and terrace. The gift area is getting bigger and bigger, and even various unconventional ways have appeared, such as detachable bay windows, terrace roofs, family gardens, patios and so on.

At first glance, through the area gift, it did bring some benefits to property buyers. Some residential projects can have at least one more room through the extensive use of "gift area". For the villa project, the basement and terrace are donated, and the proportion of the donated area can reach 100% or even higher. Although the sales unit price is high, according to the actual area, the actual unit price is low. Take an apartment project in Shanghai as an example, the price is 50,000 yuan/square meter. If you buy a compact three-bedroom apartment with an area of 100 square meter and get a room with a gift area of 10 square meter, the unit price will be "reduced" to 45,500 yuan/square meter.

Although the gift area can make property buyers get some benefits, some people in the industry do not agree with this form. Some insiders pointed out that the rooms obtained by closing balconies and balconies should be demolished, resulting in waste. In addition, through the internal structure, it also reduces the height of the story and produces a sense of oppression. The reporter also saw a LOFT apartment with an area of about 50 square meters and a height of 5 meters in Songjiang. Through internal construction, it became a duplex room with a living area of over 90 square meters. However, because the floor in the middle is relatively thin, it is easy to vibrate and accompanied by loud noise when walking. At the same time, because the height of the second-floor bedroom is only 2.2 meters, the living comfort is greatly reduced. In addition, some people think that the gift area is far less than the reality of direct price reduction, so to some extent, the gift area of buying a house is essentially a marketing gimmick.

Be careful with the gift area.

Buying a house to send an area, on the surface, allows buyers to enjoy some benefits, but in fact it also hides risks and needs to be more careful.

The first is whether the gift area is all legal, and no developer can guarantee it. Where does the donated area come from? According to insiders, there are three main aspects: first, making a fuss about the "calculation method of building area", and the more common practice is to reduce the interior area; Secondly, the area owned by the owner, such as the top terrace and basement space, belongs to all owners of the building according to the property law. The third is that developers arbitrarily change the planning and design of illegal construction. The premise of the real "gift area" should be that the gift area is legal and the donor has legal property rights, but it is difficult to do this for some gift areas. From this perspective, it is still difficult to draw a conclusion whether the gift area really brings benefits to property buyers.

Secondly, the official does not recognize the form of the hair zone, and it is easy to "step on the red line" and be banned. In addition to Shanghai, other cities have also taken measures to ban such illegal construction. For example, in view of the fact that the measured area of a construction project exceeds the planning permission, Chengdu Planning Bureau put forward three innovative measures to implement "reasonable error management", confiscate all the income of development enterprises, make illegal construction unprofitable, and take the lead in curbing the phenomenon of "over-area" in the country. In addition, the original bay windows, double-deck balconies and basements that can be given in the 20 14 edition of Code for Calculation of Building Area of Building Engineering should be counted as areas, which also set obstacles for the behavior of "stealing area" to some extent.

In addition, the gift area cannot be reflected in the property certificate, which also lays a hidden danger for future rights protection and mortgage. I don't know if it's intentional. Most purchase contracts don't specify the gift area, so once the gift area shrinks or there are quality hazards, buyers often can't defend their rights. In addition, this kind of property also has certain legal obstacles when it comes to demolition, sale, inheritance, evaluation and mortgage. In view of this, in order to protect his own rights and interests, the legal person said that the protection of relevant rights and interests depends on the contract signed by the buyer and the seller, and disputes can be handled according to the contract. Therefore, property buyers should insist that developers write the gift area into the contract.
