The illegal building itself is still a thing, and the builder of the illegal building still enjoys the relevant legal rights until the relevant administrative departments determine that it is required to be demolished according to law.

What are the illegal buildings?

If illegal buildings, structures and facilities need to be demolished by force, the administrative organ shall make an announcement and order the parties to dismantle them themselves within a time limit. If the party concerned does not apply for administrative reconsideration or bring an administrative lawsuit within the statutory time limit and does not dismantle it, the administrative organ may forcibly dismantle it according to law.

Article 42

To implement administrative enforcement, the administrative organ may reach an enforcement agreement with the parties concerned on the premise of not harming public interests and the legitimate rights and interests of others. The implementation agreement may stipulate that it shall be performed in stages; If the parties take remedial measures, they may reduce the additional fines or late fees.

The implementation agreement shall be fulfilled. If the parties fail to perform the execution agreement, the administrative organ shall resume compulsory execution.
