The payment of property fees without signing a property contract is as follows:

1. If you enjoy the property service without signing a property service contract with the property management company, you need to pay the property fee:

(1) Under normal circumstances, the owners' committee and the realty service enterprise selected by the owners' congress conclude a written realty service contract, which is binding on all owners after the owners' committee signs a realty management contract with the realty company;

(2) If the owners' committee has not signed a written property service contract with the property company, but the owners have actually accepted the property service, the owners should pay the corresponding fees to the property company according to the actual service price as a reward for providing services;

2. If the property contract is not signed or the property company fails to provide qualification certificate, the owner may not pay the property fee;

3. If it is a completed property that has not been sold or handed over to the property buyer, the property service fee shall be paid by the construction unit.

Legal basis: Article 490 of the Civil Code of People's Republic of China (PRC).

If the parties enter into a contract in the form of a contract, the contract shall be established when the parties sign, seal or press their fingerprints.
