Regulations of Zhenjiang Municipality on the Prevention and Control of Dust Pollution

Article 1 In order to effectively prevent and control dust pollution, protect and improve the atmospheric environment, safeguard public health, and promote the construction of ecological civilization and beautiful Zhenjiang, these Regulations are formulated in accordance with the People's Republic of China (PRC) Environmental Protection Law, the People's Republic of China (PRC) Air Pollution Prevention Law, the Jiangsu Air Pollution Prevention Regulations and other laws and regulations, and combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to the prevention and control of dust pollution and its supervision and management activities within the administrative area of this Municipality.

The term "dust pollution" as mentioned in these Regulations refers to the pollution to the atmospheric environment caused by building construction, municipal infrastructure construction, building demolition, building decoration, greening construction, water conservancy infrastructure construction, traffic facilities construction, road maintenance and cleaning, material stacking, transportation and processing, and mud exposure in urban built-up areas.

Article 3 The Municipal People's Government shall be responsible for the prevention and control of dust pollution within its administrative area, organize the preparation of the overall plan for dust pollution prevention and control, and incorporate it into the ecological environment protection plan, and establish the overall coordination, information sharing, capital investment guarantee mechanism and target responsibility assessment system for dust pollution prevention and control.

The people's governments at the county level shall be responsible for the prevention and control of dust pollution within their respective administrative areas, formulate specific implementation plans according to the overall plan for the prevention and control of dust pollution, and organize their implementation.

The Town People's Government and the sub-district offices shall, within the scope of their duties, do a good job in the prevention and control of dust pollution.

Organs, organizations, military units, enterprises and institutions shall take measures such as greening and road hardening to prevent and control dust pollution in public areas of their own units.

Article 4 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution within their respective administrative areas, organize regional dust environmental quality monitoring, and be responsible for the supervision and management of dust pollution prevention and control in industrial enterprise yards.

The competent department of housing and urban and rural construction is responsible for the supervision and management of the prevention and control of dust pollution such as housing construction and ancillary facilities construction and decoration projects, municipal infrastructure projects, landscaping projects, house expropriation and demolition projects, and ready-mixed concrete.

The urban management department is responsible for the supervision and management of the prevention and control of dust pollution, such as the disposal of urban construction waste and domestic waste, the cleaning of urban roads, and the maintenance of urban roads and bridges.

The competent department of transportation is responsible for the supervision and management of dust pollution prevention and control, including the traffic construction projects of ports and docks, the construction and maintenance projects of national highways, provincial highways and rural highways in urban planning areas, and the material loading and unloading of ports and road freight stations.

The water administrative department is responsible for the supervision and management of dust pollution prevention and control within the scope of water conservancy project construction and water conservancy project management.

Development and reform, industry and information technology, finance, public security, natural resources and planning, agriculture and rural areas and other departments shall, according to their respective responsibilities, do a good job in the supervision and management of dust pollution prevention and control.

Article 5 The municipal and county-level municipal people's governments and their relevant competent departments shall strengthen the publicity and education of laws and regulations on the prevention and control of dust pollution, and enhance the public's awareness of consciously observing laws and regulations on the prevention and control of dust pollution.

The news media should strengthen the publicity of laws and regulations on the prevention and control of dust pollution and scientific prevention and control knowledge.

Article 6 Any unit or individual has the right to complain and report dust pollution to the competent department of ecological environment, and the right to complain and report to the higher authorities or supervisory organs about the behavior of the people's government, the competent department of ecological environment and their staff who fail to perform their duties according to law.

The competent department of ecological environment shall publish the contact telephone number, e-mail, WeChat WeChat official account and official website, etc. Open to the public, and clearly accept the scope and responsibility.

The competent department of ecological environment shall handle the complaints received within the scope of duties according to law, and inform the complainant of the results within the prescribed time limit; If it is not within the scope of responsibilities of this department, it shall be promptly transferred to the competent department, which shall handle it according to law and inform the complainant of the result within the prescribed time limit.

The relevant competent department shall keep confidential the relevant information of the complainant; If the report is verified, the informant will be rewarded.

Article 7 The construction unit shall specify the responsibility for dust pollution prevention and control of the construction unit in the project contract, urge the construction unit to fulfill the responsibility for dust pollution prevention and control in accordance with the agreement, and include the cost for dust pollution prevention and control in the project cost, and pay it to the construction unit in full and on time.

The construction unit shall, according to the characteristics of the project, formulate and implement the implementation plan for the prevention and control of dust pollution before construction, publicize the information of the responsible subject and person, prevention measures, competent departments and so on in a prominent position at the main entrance and exit of the construction site, and accept public supervision.

The supervision unit shall incorporate the prevention and control of dust pollution into the scope of project supervision. If the construction is not carried out in accordance with the implementation plan of dust pollution prevention and control, the construction unit shall be required to correct it immediately and report to the construction unit in time.

Eighth engineering construction should take the following measures to prevent and control dust pollution:

Fences or fences should be set around the construction site according to regulations.

Effective measures such as covering closed dustproof net or cloth, spraying dust suppressant or sprinkling water should be taken for materials that are easy to generate dust, such as mud, earthwork, sand and gravel, which are exposed on the construction site.

Road hardening on the construction site, and timely cleaning and washing; Install washing facilities at the inner side of the entrance and exit, and vehicles can not leave the construction site until they are cleaned.

When excavating earthwork, partition and subsection operation should be adopted, and the completed operation surface should be backfilled or covered in time.

If dust is generated in the construction process, effective dustproof measures such as spraying, sprinkling water, external closed dustproof net or dustproof cloth should be taken; If there is mud, mud pits and mud ditches should be set up and removed by sealed tank trucks.

Construction waste shall be piled up and covered in a centralized way, and sealed and removed in time.

Construction sites with a construction area exceeding a certain scale shall be equipped with video monitoring equipment for dust and online monitoring equipment for particulate matter in accordance with relevant requirements, and shall be networked with the competent departments of housing, urban and rural construction and urban management. To ensure their normal operation and real-time, effective and real-time data transmission.

Other dust prevention measures stipulated by laws and regulations.

Encourage the promotion of dust prevention measures for new technologies, new processes and new equipment.

Article 9 _ In addition to complying with the provisions of Article 8, the following dust pollution prevention measures shall be taken for the following projects:

A closed dustproof net or cloth should be set on the outside of the external scaffold for building construction and decoration, and effective dustproof measures such as cleaning up residual ash should be taken before dismantling the scaffold.

After the completion of the pipeline laying project in the municipal road or green space, the original appearance will be restored within three days. If the original appearance cannot be restored temporarily, effective coverage measures should be taken.

In the process of greening project construction, the abandoned soil should be cleaned up in time, and effective dust-proof measures such as covering and watering should be taken for planting soil and tree holes. The edge of backfill soil in road central isolation belt, vehicle isolation belt and roadside green belt should be less than 5 cm above the kerb edge, and the exposed land under green belt and roadside trees should be covered or afforested in time.

Building materials such as silt, garbage, dam reinforcement and slope protection removed from urban rivers should be covered and removed in time after the construction.

Tenth _ urban roads and other public places should be cleaned regularly to keep the green space clean and tidy. Urban road cleaning shall take the following measures to prevent dust pollution:

Mechanized wet low-dust cleaning is carried out on the main roads in urban areas, and other roads are gradually mechanized;

Under the meteorological conditions such as high temperature, dryness and static stability, which are easy to produce dust pollution, we should increase the number of sprinkling and washing and strengthen road cleaning.

Eleventh _ easy to produce dust pollution in building materials, chemical industry, thermal power and other industrial enterprises, ports, docks, stations, parking lots and other places, concrete mixing stations, ready-mixed mortar stations, water-stabilized mixing stations and other material storage yards and loading and unloading operations, should take the following dust pollution prevention measures:

Divide the boundary between the material stacking area and the road, remove the scattered materials in time, and keep the material stacking area and the road clean and tidy;

Materials should be stacked with closed storage equipment, or with effective dust-proof measures such as closed enclosure, covering, spraying, wind and dust suppression nets not lower than the stacking height;

Take effective dustproof measures such as sealing, spraying and watering when loading and unloading materials;

If closed conveying equipment is used for operation, a dust removal device shall be installed at the loading and unloading place to ensure its normal use;

The site and road surface should be hardened and equipped with vehicle washing facilities to keep the vehicles leaving the site clean.

Article 12 _ Vehicles transporting granular and fluid materials such as coal, fine-grained building materials and construction waste shall meet the prescribed conditions, keep the license plate clear, take measures such as sealing to prevent dust pollution caused by spilled materials, and install and use satellite positioning and traffic safety information equipment that meets national standards.

Thirteenth _ construction waste disposal sites shall be operated in units and layers, covered, solidified, afforested, hardened roads or other effective dust-proof measures, equipped with washing facilities and clean vehicles.

Fourteenth _ bare mud in urban built-up areas should be afforested; Do not have the green conditions, should take permeable paving or covering and other dust-proof measures.

The main body responsible for the prevention and control of dust pollution in exposed mud in urban built-up areas shall be determined in accordance with the following provisions:

Within the scope of the land use unit, the unit is responsible for it.

In the residential area, the property service enterprise shall be responsible for it; If there is no property service enterprise, the town people's government and the sub-district office shall be responsible for it.

Municipal roads, public green spaces and rivers within the scope of management shall be the responsibility of the management unit.

Land purchasing and storage is the responsibility of the land purchasing and storage management institution.

Idle land is the responsibility of land use rights holders and managers.

Other areas, by the local town people's government, street offices.

Fifteenth _ city, county-level city people's government shall formulate emergency plans for heavy pollution weather, start emergency plans in time according to the early warning level, and take dust-proof emergency measures such as ordering relevant construction units to stop on-site earthwork operations and demolishing buildings.

Article 16 _ In violation of the provisions of Article 7, paragraph 2, Article 8, Article 9, Article 11 and Article 13 of these regulations, the relevant departments shall, according to their respective duties, order them to make corrections and impose a fine of 1 10,000 yuan or more and110,000 yuan or less; Refuses to correct, shall be ordered to suspend production or business.

Seventeenth _ in violation of the provisions of article twelfth of this Ordinance, the vehicles that are easy to produce dust materials on urban roads are not sealed, and the urban management department shall order them to make corrections and impose a fine of more than two thousand yuan and less than twenty thousand yuan; Refuses to correct, vehicles are not allowed to drive on the road.

Eighteenth _ responsible for dust pollution prevention and control supervision and management departments and their staff abuse their powers, neglect their duties, engage in malpractices for selfish ends, fraud, by the superior competent department, the supervisory organ or the unit shall be ordered to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Nineteenth _ These Regulations shall come into force on July 65438, 2002/KLOC-0.
