According to the Measures for Housing Registration, applicants can apply for the transfer registration of houses on collective land, which does not mean that houses on collective land can be transferred freely. At present, national policies, laws and regulations have strict restrictions on the transfer of houses on collective land. The restriction on the transfer of house ownership on collective land is mainly determined by the nature that the homestead belongs to collective ownership. The right to use homestead is a kind of property right with identity, which is linked to the membership of rural collective economic organizations. The transferee of the house on the collective land must be a member of the collective economic organization. The Notice of General Office of the State Council on Strengthening Land Transfer Management and Prohibiting Land Speculation (Guo Ban Fa Ren [1999] No.39) and the Decision of the State Council on Deepening Reform and Strict Land Management (Guo Fa [2004]No. 2S) explicitly prohibit rural houses from being transferred to urban residents, farmers' houses from being sold to urban residents, and urban residents from occupying farmers' collective land to build houses for illegal construction.
