Whoever steals public or private property in a relatively large amount or repeatedly shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also, or shall only, be fined.

First, the filing standard:

1, committing multiple thefts, burglary and pickpocketing is a crime of theft;

2. Theft of public or private property with a value of 1 10,000 yuan but less than 30,000 yuan, less than 300,000 yuan and more than 300,000 yuan, respectively, is considered as large, huge and especially huge;

If the amount of theft is less than 2,000 yuan, which is not harmful to society and has one of the following circumstances, it may not be treated as a crime:

(a) the first offense;

(two) voluntarily surrender, return all stolen goods, restitution;

Second, sentencing standards.

1. Whoever steals public or private property in a relatively large amount, or repeatedly steals, enters a house, carries a weapon or pickpockets, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also, or shall only, be fined;

2. If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined;

3. If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
