Article 1 In order to promote the energy conservation of public institutions, improve the energy utilization efficiency of public institutions, and give full play to the exemplary role of public institutions in the energy conservation of the whole society, these Regulations are formulated in accordance with the Energy Conservation Law of People's Republic of China (PRC).
Article 2 The term "public institutions" as mentioned in these Regulations refers to state organs, institutions and organizations that use financial funds in whole or in part.
Article 3 Public institutions should strengthen energy management, adopt technically feasible and economically reasonable measures, reduce energy consumption, reduce and stop energy waste, and use energy effectively and reasonably.
Article 4 The competent department of energy conservation in the State Council shall be in charge of energy conservation supervision and management of public institutions nationwide. Under the guidance of the department in charge of energy conservation in the State Council, the institutions in charge of administrative affairs in the State Council are responsible for promoting, guiding, coordinating and supervising the energy conservation work of public institutions throughout the country. The State Council and the local people's governments at or above the county level shall be responsible for the supervision and management of energy conservation of public institutions at the same level under the guidance of the energy conservation departments at the same level. Article 5 the State Council and local people's governments at or above the county level shall, jointly with relevant departments at the same level, carry out publicity, education and training on energy conservation in public institutions, and popularize scientific knowledge on energy conservation.
Article 6 The person in charge of a public institution shall be fully responsible for the energy-saving work of the unit. Article 8 The energy conservation work of public institutions shall be subject to social supervision. Any unit or individual has the right to report the waste of energy by public institutions, and the relevant departments shall promptly investigate and deal with it.
Article 9 Units and individuals that have made remarkable achievements in energy conservation in public institutions shall be commended and rewarded in accordance with the provisions of the state.

Tenth the State Council and the local people's governments at or above the county level shall, jointly with the relevant departments at the same level, formulate energy-saving plans for public institutions at the same level according to the medium-and long-term special plans of the people's governments at the same level. Article 22 Public institutions shall conduct energy audits in accordance with regulations, make technical and economic evaluations on the operation and energy utilization of energy-using systems and equipment, and take measures to improve energy utilization efficiency according to the audit results. The specific measures shall be formulated by the department in charge of energy conservation in the State Council in conjunction with the relevant departments in the State Council.
Twenty-third energy audit contents include:

(two) check the electricity, gas, coal, oil, municipal heating and other energy consumption measurement records and financial bills, and evaluate the total energy consumption, per capita energy consumption and energy consumption per unit construction area;

Thirty-fourth public institutions should be equipped with official vehicles according to standards, giving priority to vehicles with low energy consumption, low pollution and clean energy, and strictly implementing the vehicle scrapping system. Public institutions shall use official vehicles in accordance with the prescribed purposes, formulate energy-saving driving norms, and implement a bicycle energy consumption accounting system. (2) Measurement, monitoring and statistics of energy consumption;
(three) the implementation of energy consumption quota;
(four) the establishment of energy-saving management rules and regulations;
(five) the establishment of energy management posts and the implementation of the responsibility system for energy management posts;
(six) the energy-saving operation of energy-using systems and equipment;
(seven) to carry out energy audit;

Thirty-sixth public institutions should cooperate with energy conservation supervision and inspection, truthfully explain the relevant situation, provide relevant information and data, and shall not refuse or hinder.
Thirty-seventh public institutions have one of the following acts, by the people's government at the same level in conjunction with the relevant departments shall be ordered to make corrections within a time limit; If no correction is made within the time limit, it shall be notified, and the person in charge of the institution shall be punished according to law by the relevant authorities:
(a) the energy-saving targets and implementation plans have not been formulated, or the energy-saving targets and implementation plans have not been filed in accordance with the provisions;
(two) the energy consumption measurement system is not implemented, or the types of energy consumption are not distinguished, and the energy consumption system implements household, classification and itemized measurement of energy consumption to monitor the energy consumption situation in real time.
(three) did not designate a person responsible for energy consumption statistics, or did not truthfully record the original data of energy consumption measurement and establish a statistical ledger;
(4) Failing to submit the energy consumption report of the previous period as required;
(five) the use of energy in excess of the energy consumption quota, without making an explanation to the administrative organ of the people's government at the corresponding level;
(six) no energy management posts, or key energy systems, equipment operation posts are not equipped with professional and technical personnel; Regulations on energy conservation of public institutions
(seven) failing to conduct energy audits in accordance with the provisions, or failing to take measures to improve energy efficiency according to the audit results;
(eight) refusing or obstructing the supervision and inspection of energy conservation.
Article 38 A public aircraft may implement the government procurement catalogue of energy-saving products and equipment, but if it fails to purchase the products and equipment listed in the government procurement catalogue of energy-saving products and equipment in accordance with the relevant provisions of the state on compulsory procurement or priority procurement, or purchases energy-using products and equipment explicitly eliminated by the state, the government procurement supervision and administration department shall give it a warning and may concurrently impose a fine; The directly responsible person in charge and other directly responsible personnel shall be punished according to law and notified.
Article 39 If the department that examines and approves fixed assets investment projects approves or approves public institution construction projects that have not passed the energy-saving assessment and energy-saving review, the directly responsible person in charge and other directly responsible personnel shall be punished according to law. If the construction projects started by public institutions fail to pass the energy-saving assessment and review, the relevant competent departments shall order rectification within a time limit according to law; The directly responsible person in charge and other directly responsible personnel shall be punished according to law.
Article 40 If a public institution, in violation of regulations, exceeds the standard, purchases official vehicles or refuses to scrap vehicles with high energy consumption and high pollution, the directly responsible person in charge and other directly responsible personnel shall be punished according to law, and the administrative organ of the people's government at the corresponding level shall take measures such as taking back, auctioning and ordering the vehicles to be returned.
Forty-first public institutions in violation of the provisions of the use of energy to cause energy waste, by the people's government at the same level to manage the affairs of the agency in conjunction with the relevant departments to issue energy-saving rectification opinions, public institutions should be implemented in a timely manner.
Article 42. If the staff of an institution that manages the affairs of an organ abuses their powers, neglects their duties or engages in malpractices for selfish ends in the supervision and management of energy conservation in public institutions, which constitutes a crime, they shall be investigated for criminal responsibility according to law; If it does not constitute a crime, it shall be punished according to law.
The State Council energy conservation department is responsible for the supervision and management of energy conservation of public institutions. The person in charge of a public institution shall be fully responsible for the energy-saving work of the unit. The energy-saving work of public institutions should accept social supervision, and anyone has the right to report the waste behavior of public institutions.
