Regulations of Shenzhen Municipality on Gas (revised in 2020)

Chapter I General Provisions Article 1 In order to strengthen gas management, ensure gas supply and safety, and standardize the gas market order, these Regulations are formulated in accordance with the Regulations on Urban Gas Management, the Regulations on Guangdong Gas Management and other relevant laws and regulations, and in combination with the actual situation in Shenzhen. Article 2 These Regulations shall apply to the construction, operation, use and management of gas and the sales, installation and maintenance of gas appliances in this Municipality. Article 3 The construction, operation, use and management of fuel gas shall follow the principles of overall planning, supporting construction, safety, convenience, energy saving and high efficiency, and ensuring supply. Article 4 The municipal housing and construction department (hereinafter referred to as the municipal competent department) is in charge of the city's gas management.

The district housing construction department (hereinafter referred to as the district competent department) is responsible for the gas management within its jurisdiction according to the provisions of these regulations, and accepts the business guidance of the municipal competent department.

Other relevant departments of the city and district shall be responsible for the relevant gas management according to law within the scope of their respective duties.

The Municipal People's Government may, according to the actual situation, adjust the division of responsibilities of the relevant competent departments as stipulated in these Regulations. Article 5 Shenzhen Gas Industry Association shall, in accordance with laws, regulations and articles of association, formulate industry codes of conduct and service standards, and establish industry self-discipline mechanism. Chapter II Planning and Construction Article 6 The municipal energy administrative department shall, jointly with the municipal competent department, formulate the development plan of the gas industry according to the national economic and social development plan of Shenzhen.

The municipal competent department shall, jointly with relevant departments, prepare a special plan for gas construction in Shenzhen according to the urban planning and the development plan of the gas industry.

Gas engineering construction projects shall conform to the special plan for gas construction. Seventh gas engineering construction shall abide by the laws, regulations, rules and mandatory standards and norms related to engineering construction.

The construction of gas stations shall carry out safety assessment and environmental impact assessment in accordance with relevant regulations. Article 8 The municipal competent department may, according to the requirements of safety, environmental protection and energy conservation and the actual situation of the gas industry, formulate technical specifications for gas engineering construction, production and operation, gas facilities and appliances in accordance with relevant regulations, and send them to the municipal market supervision department for promulgation and implementation.

The municipal competent department may publish the catalogue of restricted and prohibited gas technologies, processes, equipment and products. Ninth gas pipelines and facilities within the red line of construction projects, the construction unit is responsible for investment and construction; Municipal gas pipelines and facilities shall be invested and built by the government or pipeline gas enterprises in accordance with the franchise contract. Tenth gas engineering construction drawing design documents shall be reviewed by the construction drawing design document review institutions with corresponding qualifications; Without examination or examination unqualified, shall not be used.

The examination institution of construction drawing design documents shall conduct examination in accordance with the provisions.

The construction drawing design documents shall indicate the reasonable service life of the project.

The reasonable service life of the above-ground gas pipeline is not less than fifteen years, and the reasonable service life of the underground steel and polyethylene gas pipelines is not less than twenty years and fifty years respectively. Eleventh new residential buildings and other construction projects that need to use fuel should support the construction of gas pipelines and facilities.

Encourage the transformation of pipeline gas supply in completed residential areas without supporting the construction of pipeline gas supply facilities. The specific measures shall be formulated separately by the municipal government.

In areas not covered by municipal gas pipelines, gas can be supplied by bottle groups; After the municipal gas pipeline covers the area, the gas supply of the bottle group shall be stopped. Twelfth after the completion of the gas project, it shall be accepted and put on record in accordance with legal procedures. Not in accordance with the provisions of the acceptance or unqualified acceptance, shall not be put into use.

The construction unit shall, in accordance with the provisions of the archives management, collect and sort out the archives of gas projects, and hand them over to the urban construction archives management institution and relevant departments in a timely manner. Thirteenth pipeline gas project acceptance, the construction unit shall hand over the pipeline and facilities, project completion data to the pipeline gas enterprise. Without justifiable reasons, pipeline gas enterprises shall not refuse or delay the acceptance.

Before the handover is completed, the construction unit shall be responsible for the maintenance and management of pipelines and facilities; If it is damaged, it should be repaired or updated. Fourteenth pipeline gas enterprises shall complete the connection of engineering gas pipelines and municipal gas pipelines within five working days after the construction unit handles the gas supply procedures. Fifteenth pipeline gas facilities have been completed and put into use, such as connection, emergency rescue, maintenance, etc., should be undertaken by the pipeline gas enterprises themselves or entrusted by enterprises with corresponding qualifications. Sixteenth pipeline gas project warranty period of not less than two years, counting from the date of completion and acceptance of the project.

During the warranty period, the original construction enterprise is responsible for handling the engineering quality problems. Seventeenth users * * * daily maintenance of gas pipelines and facilities shall be the responsibility of the pipeline gas enterprises, and the relevant expenses shall be borne by the pipeline gas enterprises; Users * * * gas pipeline and facilities maintenance, renovation and renovation costs paid from the housing special maintenance funds; The maintenance, renewal and renovation costs of gas pipelines and facilities for users' own use shall be borne by the users themselves.

When a pipeline gas enterprise maintains the gas pipelines and facilities used by users, the property management unit and users shall cooperate.

When maintaining, updating and transforming the gas meter, it shall inform the pipeline gas enterprise to register the measurement.

Maintenance, renewal and transformation of user gas pipelines and facilities shall be entrusted to units with corresponding qualifications.
