Measures of Yantai Municipality on Classified Management of Municipal Domestic Waste

Chapter I General Provisions Article 1 In order to strengthen the classified management of domestic garbage, improve the level of reduction, recycling and harmless disposal of domestic garbage, and promote the construction of ecological civilization, these Measures shall be applicable in accordance with Article 2 of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Law of the People's Republic of China on the Promotion of Circular Economy, and the Regulations on the Administration of City Appearance and Environmental Sanitation (the State Council OrderNo.1KLOC-0/).

Kitchen waste, decoration waste, greening waste and waste electrical and electronic products shall be managed in accordance with laws, regulations and other relevant provisions of this Municipality. Article 3 The term "domestic waste" as mentioned in these Measures refers to the solid waste generated by units and individuals in their daily life or activities providing services for their daily life, and the solid waste regarded as domestic waste according to laws and administrative regulations.

Harmful waste, kitchen waste, recyclables and other wastes are the basic classification standards of municipal solid waste. Article 4 The classification management of domestic waste shall follow the principles of government promotion, national participation, market operation, whole-process classification, systematic promotion and gradual progress. Article 5 The municipal and district people's governments shall strengthen the unified leadership over the classified management of domestic garbage, incorporate the classified management of domestic garbage into the national economic and social development plan, determine the target of source reduction and classified management of domestic garbage, establish a comprehensive coordination mechanism for classified management of domestic garbage, and make overall plans for classified management of domestic garbage. The funds required for the classified management of domestic waste shall be included in the fiscal budget at the corresponding level.

Street offices are responsible for the daily management of domestic waste classification within their respective jurisdictions. Article 6 The municipal administrative department of city appearance and environmental sanitation shall exercise unified supervision and management over the classified delivery, collection, transportation and disposal of municipal solid waste. The district urban environmental sanitation administrative department is responsible for the specific work of classified management of urban domestic waste within its jurisdiction.

The development and reform department is responsible for studying and improving the charging mechanism for domestic garbage disposal.

The education department is responsible for incorporating the knowledge of domestic waste classification into the educational content of kindergartens, primary and secondary schools and institutions of higher learning, and organizing activities such as domestic waste classification education practice. The natural resources and planning department is responsible for the implementation of the land guarantee for the facilities for classified collection, transportation and disposal of domestic waste as determined in the special plan for domestic waste treatment.

The ecological environment department is responsible for the supervision and management of the utilization and disposal of hazardous wastes.

The housing and urban-rural construction department is responsible for guiding the property administrative departments of all districts and urging the property service enterprises within their respective jurisdictions to do a good job in the classification of domestic waste according to the division of responsibilities.

The commercial department is responsible for guiding the development of renewable resources industry and improving the construction of renewable resources recovery system.

The administrative department of government affairs is responsible for guiding, inspecting and evaluating the implementation of domestic waste classification in public institutions.

Urban management law enforcement departments are responsible for supervising and investigating violations of the measures for the classification and management of domestic waste.

Industry and information technology, civil affairs, transportation, culture and tourism, health, state-owned assets management, market supervision, sports and other competent departments are responsible for supervising and guiding their subordinate organs, enterprises, institutions and social organizations, and doing a good job in reducing and classifying the source of domestic waste. Seventh residents' committees shall cooperate with the street offices to organize, mobilize, publicize and guide the classification of domestic waste.

The owners' committee and the realty service enterprise shall mobilize and urge the residents in residential areas to put domestic garbage in a classified way and do a good job in the classified collection of domestic garbage. Eighth units and individuals that produce domestic garbage shall pay the domestic garbage disposal fee in accordance with the provisions.

The charging standard shall be determined by the municipal development and reform department according to the relevant provisions of the state and province and the principle of compensation for disposal expenses, and shall be implemented after being approved by the Municipal People's government. Article 9 Units and individuals shall fulfill the obligations of source classification and classified delivery of domestic garbage, reduce the use or non-use of disposable articles, and reduce the generation of domestic garbage. Article 10 The municipal and district people's governments shall support the research and development and application of new technologies, new processes, new materials and new equipment in source reduction, classified delivery, on-site disposal, resource utilization, management and operation of domestic garbage. Chapter II Planning and Construction Article 11 The municipal administrative department of city appearance and environmental sanitation shall, jointly with the departments of development and reform, natural resources and planning, and ecological environment, organize the preparation of a special plan for the treatment of municipal solid waste and submit it to the Municipal People's Government for approval.

The special plan for the treatment of domestic waste should define the classified treatment system of domestic waste, coordinate the overall layout of urban domestic waste treatment facilities, and link up with the utilization and treatment planning of solid waste and the construction of centralized disposal facilities for hazardous waste, and explore the establishment of a cooperative disposal and utilization base for domestic waste. Article 12 The District People's Government shall, according to the special plan for urban domestic garbage disposal, formulate the special plan for domestic garbage disposal in each district, organize the construction of domestic garbage collection stations and transfer stations in this region, and set up places for transporting, sorting and dismantling large-sized garbage and decoration garbage, so as to improve the efficiency of collection, transportation and disposal of all kinds of garbage. Article 13 When building, rebuilding or expanding residential buildings, public buildings, public facilities and other construction projects, collection facilities that meet the requirements of domestic waste classification shall be built in accordance with national and municipal standards, and shall be designed, constructed, accepted and used synchronously with the main project, and the required funds shall be included in the budgetary estimate of the construction project.

If the existing residential areas are not equipped with facilities for classified collection of domestic waste, or the related facilities do not meet the requirements for classified delivery of domestic waste, the District People's Government shall organize the renewal of supporting facilities in accordance with relevant regulations.
