Measures of Wuxi Municipality on the Administration of House Lease (202 1)

Article 1 In order to strengthen the management of house leasing, standardize the behavior of house leasing, safeguard the legitimate rights and interests of the parties and ensure public safety, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the lease and management of houses within the administrative area of this Municipality.

The term "house lease" as mentioned in these Measures refers to the behavior that the lessor rents the house to the lessee for use and the lessee pays the rent to the lessor.

If there are other provisions in laws and regulations on the structural safety management of public rental housing, public houses directly under the jurisdiction and leased housing, those provisions shall prevail. Article 3 Housing lease management shall adhere to the principles of combining territorial management with line management, combining lease management with safety management, and combining source prevention with comprehensive management. Article 4 The municipal, city (county) and district people's governments shall improve the housing lease management system, improve the housing lease management mechanism, establish a joint meeting system of housing and urban and rural construction, public security organs and other departments, coordinate and solve major problems in housing lease management, and incorporate housing lease management funds into the fiscal budget.

Group rental safety professional committee and its office are responsible for the planning, organization, implementation, supervision and inspection of the city's group rental safety management, and coordinate and solve the outstanding problems of group rental safety management. Fifth city housing and urban-rural construction department is responsible for the guidance and supervision of the city's housing lease, through the city's unified housing lease registration platform to achieve information sharing. City (county), district housing and urban and rural construction departments are specifically responsible for the management of housing rental within their respective jurisdictions.

The public security organs are responsible for the public security management of rental houses, residence registration and other work, guiding neighborhood (village) committees, social security assistance and other forces to assist in the public security management of rental houses and floating population.

Fire rescue agencies are responsible for the fire safety management of rental houses, organize and guide the town people's government, street offices and public security police stations to carry out fire propaganda, supervision and inspection, implement fire safety responsibilities, and rectify fire safety hazards.

The natural resources and planning department is responsible for investigating and dealing with the illegal occupation of rental housing.

The market supervision and management department is responsible for investigating illegal housing intermediary behavior.

The urban management department is responsible for investigating and dealing with illegal construction activities involved in renting houses.

Municipal and garden departments are responsible for guiding gas supply enterprises to do a good job in gas safety management of rental houses.

Local financial supervision and management departments are responsible for coordinating relevant departments to investigate and deal with illegal financial activities in the housing rental market and crack down on illegal financial activities in the housing rental market.

Power supply enterprises are responsible for the safety inspection and hidden trouble management of electricity facilities involved in house leasing, and provide relevant data and technical support.

Other government departments shall, in accordance with their respective responsibilities, do a good job in the safety management of house leasing. Article 6 The town people's government and sub-district offices are responsible subjects for the safety management of rental houses within their respective administrative areas. Based on grid-based social governance, they establish a daily inspection and reporting mechanism for rental houses, organize the collection of information on security risks such as public security and fire fighting in rental houses, and organize the implementation of rectification of security risks in rental houses.

The town people's government, neighborhood offices responsible for community affairs institutions (hereinafter referred to as community affairs institutions) accept the city (county), district housing and urban and rural construction departments entrusted to handle the housing lease registration. Seventh neighborhood (village) committees may, according to the actual situation of the community (village), organize the formulation of housing lease management conventions or incorporate relevant contents into community conventions and village rules and regulations. The owners' committee may incorporate the relevant provisions on housing lease management into the management convention, and entrust the realty service enterprise to implement it.

Neighborhood (village) committees and property service enterprises shall assist the town people's government and neighborhood offices to carry out daily inspections of housing rental management, and if there are potential safety hazards and illegal and criminal acts in the rented houses, they shall report to the local town people's government and neighborhood offices in a timely manner to help eliminate potential safety hazards. Eighth houses under any of the following circumstances shall not be rented:

(a) illegal construction;

(two) in violation of the provisions to change the nature of housing use;

(three) does not meet the mandatory standards for safety, disaster prevention and other engineering construction;

(four) other circumstances in which laws and regulations prohibit rental. Ninth rental housing, should take a room originally designed for residential use as the minimum rental unit, and may not build another house and rent it for living.

Article 10 The lessor and the lessee shall follow the principles of voluntariness, fairness, honesty and credibility, establish a lease relationship according to law, sign a written lease contract, and clarify the rights and obligations of both parties in accordance with regulations.

The municipal housing and urban-rural construction department shall, jointly with the municipal market supervision and management department, formulate and publish the model text of the housing lease contract containing the content of safety responsibility, and guide the real estate brokerage institutions and the parties to the housing lease to use it.
