Without the property maintenance fund, is the roof leakage owned by property management or borne by individuals?

Legal analysis: Property is called property management, and it is a property service enterprise hired by the owner. The property shall maintain and manage the housing-related facilities. The roof belongs to the public area of the community, which is shared by all owners, and does not belong to the category of private responsibility, so the water leakage problem belongs to the maintenance of public facilities. Therefore, when the roof leaks, we should actively reflect the problem to the residential property, and when the residential property shirks, we should be clear about our responsibilities.

Article 2 The term "property management" as mentioned in these Regulations refers to the activities in which the owner selects a property service enterprise, and the owner and the property service enterprise carry out maintenance, conservation and management of the house, supporting facilities, equipment and related sites in accordance with the provisions of the property service contract, so as to maintain the environmental sanitation and related order in the property management area.

Article 53 The owners of residential properties, non-residential properties in residential quarters or non-residential properties connected with the single structure of residential buildings shall pay special maintenance funds in accordance with relevant state regulations. Special maintenance funds shall be owned by the owners, and shall be used exclusively for the maintenance, renewal and transformation of property parts and facilities after the expiration of the property warranty period, and shall not be used for other purposes. Measures for the collection, use and management of special maintenance funds shall be formulated by the construction administrative department of the State Council in conjunction with the finance department of the State Council.
