Regulations of Guangzhou Municipality on the Administration of Urban Rail Transit Chapter II Construction Management
The municipal development and reform administrative department shall, in accordance with the basic construction procedures stipulated by the state, handle the project examination and approval and issue the urban rail transit investment plan. The municipal planning administrative department is responsible for organizing the preparation of urban rail transit planning.
Urban rail transit planning should be linked with other public transport planning, and necessary space should be reserved to ensure safe and convenient transfer conditions and sufficient evacuation capacity.
When examining and approving other construction projects connected with rail transit entrances, ventilation kiosks and other facilities, the municipal urban planning administrative department shall put forward the planning and design requirements for reserving the necessary space connected with rail transit. When underground space is used in urban rail transit construction, the owners and users of the buildings (structures) and land above it shall provide necessary convenience.
Urban rail transit business units shall take measures to prevent and reduce the impact on buildings (structures) and other facilities above and around. If losses are caused, they shall bear legal responsibilities according to law.
During the construction of urban rail transit projects, urban rail transit business units shall conduct necessary investigations, records and dynamic monitoring of existing buildings along urban rail transit. The establishment of urban rail transit control protection zones along the urban rail transit, including:
(a) within fifty meters of the periphery of the underground station and tunnel structure;
(2) Within 30m of the outside of the ground, elevated station and track structure;
(3) Outside of buildings (structures) such as entrances and exits, ventilation kiosks, rolling stock depots, control centers, substations and centralized cooling stations 10 meter;
(4) Within the range of 100 meters on both sides of the river-crossing tunnel of urban rail transit.
The specific scope of protected areas shall be controlled, and the planning shall be put forward by the urban rail transit business unit, and shall be approved and promulgated by the Municipal People's Government after being audited by the planning administrative department. To carry out the following activities in the urban rail transit control protection zone, the relevant administrative departments shall solicit the opinions of the urban rail transit business units in writing when implementing the administrative license according to laws and regulations. Urban rail transit business units shall give a written reply within the time limit prescribed by the relevant administrative departments:
(a) the construction and demolition of buildings (structures);
(two) soil, soil, foundation pit excavation, blasting, pile foundation construction, jacking, grouting and anchoring operations;
(three) building ponds, digging canals, quarrying and dredging, and drilling wells to get water;
(4) Overhead operations such as laying pipelines or erecting crossing lines;
(5) Dredging the river in the river-crossing tunnel section;
(six) other operations that may endanger urban rail transit facilities.
If the activities listed in the first paragraph of this article do not require the administrative license of the administrative department in the urban rail transit control and protection zone, the operating unit shall inform the urban rail transit operating unit in writing before the construction. Where an operating unit conducts the activities listed in the first paragraph of Article 13 in the urban rail transit control and protection zone, it shall formulate a protection plan for urban rail transit facilities in conjunction with the urban rail transit operating unit.
Urban rail transit business units can enter the construction site of the operating unit for inspection. If it is found that the construction activities of the operating unit endanger or may endanger the safety of urban rail transit facilities, they can ask the operating unit to stop operations and take corresponding safety measures. If the operating unit refuses to adopt it, the urban rail transit operating unit shall report to the municipal construction administrative department.
The municipal construction administrative department shall verify the situation reported by the urban rail transit business unit and deal with it according to law. Urban rail transit business units shall establish and improve the management system, do a good job in the inspection and maintenance of urban rail transit facilities, and ensure their normal operation and use.
Electric power, water supply, communication and other units shall assist urban rail transit business units to ensure the normal operation of urban rail transit and ensure the demand of urban rail transit for electricity, water and communication. Urban rail transit business units shall formulate urban rail transit operation service standards to provide safe and convenient passenger service for passengers.
Urban rail transit business units should keep the entrances and exits unblocked, and set up various guiding signs such as safety, fire fighting and evacuation in accordance with the requirements of relevant national standards.
The guiding signs of urban rail transit entrances and exits are uniformly set by urban rail transit business units. Urban rail transit business units shall set up guiding signs in the surrounding properties jointly built with entrances and exits, and the owners and users of the surrounding properties shall cooperate.
Urban rail transit business units shall announce the travel time of the first and last buses, train operation status tips and transfer instructions in a prominent position at the station. If the train delays or adjusts the running time of the first and last bus for any reason, it shall notify the passengers in time. Urban rail transit business units shall establish a public health management system, improve health records, implement health management measures, keep stations and carriages clean and tidy, and ensure that the air quality and sanitary conditions in public places such as stations and carriages meet national health standards.
Urban rail transit business units shall implement pollution prevention measures in accordance with relevant national standards to reduce noise pollution during the operation of ground line trains. Urban rail transit business units shall perform the following obligations to maintain the public safety and fire control of urban rail transit:
(a) the organization of public security and fire safety inspection, timely detection and elimination of security risks;
(two) to stop acts that endanger public safety and disrupt the public order of rail transit;
(three) to stop the illegal and criminal acts of public security within the scope of urban rail transit, and report to the public security department in a timely manner;
(four) other public security and fire control obligations that should be fulfilled according to law. Urban rail transit fares are subject to government pricing according to law.
Urban rail transit fares should be coordinated with other public transport fares in this Municipality.
Urban rail transit business units shall implement the fares determined by the government and shall not adjust them without authorization. Passengers should hold valid tickets. If there is no ticket, invalid ticket or evasion ticket, the urban rail transit business unit will charge the fare according to the highest one-way fare of the gate station network.
If the urban rail transit cannot operate normally due to failure, passengers have the right to request the urban rail transit business unit to refund the fare according to the amount of tickets purchased at that time with valid tickets. Passengers taking urban rail transit shall abide by the rules of taking urban rail transit.
The norms for urban rail transit rides shall be formulated and promulgated by the municipal construction administrative department. The following acts that affect the operation order of urban rail transit are prohibited:
(1) illegally intercepting a train and obstructing transportation;
(two) unauthorized access to the track, tunnel or other areas with warning signs;
(3) Climbing or crossing fences, railings, gates, locomotives, etc. ;
(4) getting on or off the bus by force;
(5) Failing to purchase tickets by bus as required, and refusing to make up the tickets after recourse by the urban rail transit business unit;
(six) other acts that affect the operation order of urban rail transit. Prohibit the following acts that affect the appearance and environmental sanitation of urban rail transit public places:
(1) Parking vehicles, piling up sundries, setting up stalls or distributing printed materials at stations, platforms or other urban rail transit facilities without authorization;
(two) spitting, urinating, chewing gum, littering, scraps of paper and other wastes in stations, platforms, trains or other urban rail transit facilities;
(3) scribbling, portraying, portraying, posting or hanging articles on carriages or other urban rail transit facilities;
(four) carrying pets, poultry and other animals by car;
(5) Smoking in the no-smoking area;
(six) begging, performing arts and picking up garbage in stations, platforms or other urban rail transit facilities;
(seven) other acts that affect the appearance and environmental sanitation of public places in urban rail transit. Urban rail transit business units shall establish a complaint acceptance system to accept complaints from passengers in violation of operational service standards.
The urban rail transit business unit shall make a reply within ten days from the date of accepting the complaint. Passengers who have objections to the reply may complain to the municipal construction administrative department. The municipal construction administrative department shall make a reply within ten days from the date of accepting the passenger's complaint.
Urban rail transit business units shall summarize passenger complaints and handling, and regularly report to the municipal construction administrative department. It is forbidden to bring inflammable, explosive, toxic, radioactive and corrosive dangerous goods into urban rail transit facilities.
Urban rail transit business units should express the catalogue of common dangerous goods in a way that is convenient for passengers to understand.
Urban rail transit business units can carry out transportation safety inspection on the articles carried by passengers. The following acts endangering the safety of urban rail transit are prohibited:
(1) Operating buttons and switch devices with warning signs without authorization, and using emergency or safety devices in non-emergency situations;
(two) unauthorized movement, cover fire warning signs, evacuation signs, measuring facilities and safety protection equipment;
(three) placing and discarding obstacles on the track, throwing items at urban rail transit trains, locomotives, maintenance engineering vehicles and other facilities;
(4) Laying sidewalks in grade crossing and grade crossing on the ground track of urban rail transit without authorization;
(five) damage to tracks, tunnels, stations, vehicles, cables, mechanical and electrical equipment, subgrade, slope protection, drainage ditch and other facilities;
(six) anchored or towed in the waters of the river-crossing tunnel control protection zone of urban rail transit;
(7) Building buildings (structures) or planting trees on both sides of ground lines or overhead lines of urban rail transit (Editor's note: the left side of this word is used, and the right side is next to the word "opening");
(eight) deliberately interfere with the special communication frequency of urban rail transit;
(nine) other acts that endanger the safety of urban rail transit. Due to holidays, large-scale mass activities and other reasons resulting in an increase in passenger traffic, urban rail transit business units should increase capacity in a timely manner to ease passengers.
In the case that the passenger flow of urban rail transit increases sharply, which seriously affects the operation order and may endanger the operation safety, the urban rail transit business unit may take temporary measures to limit the passenger flow. The Municipal People's Government shall formulate an emergency plan for rail transit operation.
Urban rail transit business units shall formulate early emergency plans for operational emergencies, establish emergency rescue organizations, equip them with rescue equipment, and organize regular drills. The early emergency plan for operational emergencies formulated by the urban rail transit business unit shall be reported to the Municipal People's Government for the record.
When natural disasters, safety accidents or other emergencies occur in the operation of rail transit, the urban rail transit business unit of the city shall organize forces to quickly carry out emergency rescue according to the pre-emergency plan, evacuate passengers, prevent the accident from expanding, reduce casualties and property losses, and report to the relevant government departments. Passengers should obey the command of the staff of the urban rail transit business unit.
The relevant departments of the Municipal People's Government, as well as electric power, communication, water supply, public transportation and other units shall carry out emergency rescue and emergency support in accordance with the provisions of the emergency plan, and assist the urban rail transit business units to resume operations as soon as possible. Urban rail transit business units in violation of the provisions of this Ordinance, one of the following acts, "People's Republic of China (PRC) production safety law", "People's Republic of China (PRC) fire law" and other relevant laws and administrative regulations, shall be dealt with according to law; If there are no provisions in relevant laws and administrative regulations, the municipal construction administrative department shall order it to make corrections, give it a warning, and may impose a fine of not less than 1,000 yuan but not more than 10,000 yuan, and punish the relevant responsible persons. If the case constitutes a crime, legal responsibility shall be investigated according to law:
(a) in violation of the provisions of article seventeenth, did not do a good job in the inspection and maintenance of urban rail transit facilities, to ensure its normal operation and use;
(two) in violation of the provisions of article eighteenth, failed to keep the entrance and exit channels open, all kinds of guiding signs, tips and instructions are complete, clear and eye-catching, do not meet the requirements of relevant national standards or fail to make an announcement according to law;
(three) in violation of the provisions of article twentieth, the staff of the relevant positions have not been trained and assessed;
(four) in violation of the provisions of article twenty-seventh, failing to handle passenger complaints according to law;
(five) in violation of the provisions of article twenty-ninth, no safety management organization has been established;
(six) in violation of the provisions of article thirtieth, failed to keep fire, alarm, rescue, evacuation lighting, escape, explosion-proof, anti-virus, protective monitoring and other equipment and equipment in good condition and effective;
(seven) in violation of the provisions of article thirty-first, did not take relevant measures or related assessment, inspection and evaluation;
(eight) in violation of the provisions of article thirty-fourth, article thirty-fifth, not timely troubleshooting, as soon as possible to resume operations or take corresponding measures to organize evacuation, transfer, restrict passenger flow;
(nine) in violation of the provisions of article thirty-sixth, the emergency plan has not been formulated or the drills have not been organized regularly. In violation of the provisions of Article 26 (1), (2), (3) and (4), which hinder the appearance and environmental sanitation of public places of urban rail transit, the urban rail transit business unit shall order it to correct the illegal act, take remedial measures, give a warning according to the seriousness of the case, and may impose a fine in accordance with the following provisions:
(a) in violation of the provisions of item (1) of this article, stacking sundries, setting up stalls, or in violation of the provisions of item (3), scribbling, portraying, posting or hanging articles, a fine of more than 50 yuan and less than 200 yuan shall be imposed;
(2) Whoever, in violation of the provisions of Item (2) of this Article, spits, urinates, spits chewing gum, litters, scraps of paper and other wastes shall be fined from 20 yuan to 50 yuan;
(three) in violation of the provisions of item (four) of this article, carrying pets, poultry and other animals by car, and imposing a fine of fifty yuan. Administrative departments and urban rail transit business units who neglect their duties, abuse their powers or engage in malpractices for selfish ends according to the authorized law enforcement staff shall be given administrative sanctions by their departments or administrative supervision departments according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
