Measures of Chengdu Municipality on the Administration of Enterprise Credit Information

Chapter I General Provisions Article 1 (Purpose Basis)

In order to improve the enterprise credit management system, create an enterprise credit environment, and promote the construction of social credit system, these measures are formulated in accordance with relevant laws, regulations and rules such as the Regulations of People's Republic of China (PRC) Municipality on the Openness of Government Information, the Administrative Measures of Sichuan Province on the Collection and Openness of Enterprise Credit Information, and combined with the actual situation in Chengdu. Article 2 (Scope of Application)

These Measures shall apply to the collection, publication, use and management of enterprise credit information within the administrative area of this Municipality. Article 3 (Meaning of Terms)

The term "enterprise credit information" as mentioned in these Measures refers to the information generated by information providers in the process of performing their duties according to law and formed by enterprises in their business activities and social activities, which can be used to analyze and judge the credit status of enterprises.

The enterprises mentioned in these Measures include market entities and other organizations engaged in business activities and social activities within the administrative area of this Municipality.

The term "information providers" as mentioned in these Measures refers to relevant administrative organs, judicial organs, organizations exercising public management functions, social organizations, industry organizations and other units. Article 4 (Information Management)

The Municipal People's Government establishes the Chengdu enterprise credit information system, collects and enjoys enterprise credit information through the unified data exchange platform of the whole city, and publishes it to the society through the portal website Chengdu Credit Network.

The information provider shall establish and improve the enterprise credit information management and evaluation system of this system or this industry. Article 5 (Management Organization)

The Municipal Administration for Industry and Commerce is entrusted by the Municipal People's Government to manage the Municipal Enterprise Credit Information Management Center. City enterprise credit information management center is responsible for the construction, maintenance and management of enterprise credit information system in this Municipality, and collects, publishes and uses enterprise credit information in accordance with the provisions of these Measures.

The people's governments of all districts (cities) and counties shall establish and improve the management mechanism of enterprise credit information collection and provide job security. Article 6 (Coordinating Body)

City and district (city) county people's government to establish a joint meeting system of enterprise credit information system. The joint meeting consists of information providers and relevant units, and is entrusted by the people's government at the same level to organize, coordinate, study and solve major problems in the construction, management and application of enterprise credit system.

The enterprise credit information management institutions determined by the municipal enterprise credit information management center and the district (city) and county people's governments shall undertake the daily work of the joint meeting office. Article 7 (Working Principles)

The collection and release of enterprise credit information should follow the principles of legality, impartiality, objectivity, independence, accuracy and timeliness, safeguard national interests, social interests and legitimate rights and interests of enterprises, and protect state secrets, business secrets and personal privacy. Article 8 (Credit Investigation)

Encourage enterprises to actively participate in relevant activities of enterprise credit information collection.

Encourage project development, enterprise investment, enterprise procurement, enterprise decision-making and other activities to use enterprise credit information. Chapter II Collection Article 9 (Information Collection)

The collection of enterprise credit information refers to the activities of collecting, receiving, sorting and storing enterprise credit information. Article 10 (Sources of Information)

The sources of enterprise credit information are mainly submitted by information providers, collected by the municipal enterprise credit information management center, and declared by enterprises independently.

The information providing unit shall establish and improve the enterprise credit information files of its own system or industry, and determine the specialized agencies and personnel to provide credit information. Article 11 (Information Content)

Information providers and municipal enterprise credit information management center shall determine the data collection catalogue of Chengdu enterprise credit information system according to national standards, industry management norms and relevant regulations. The information providing unit shall provide enterprise credit information to the municipal enterprise credit information management center according to the data collection catalogue within ten working days before each month; When records or updates are urgently needed under special circumstances, they should be submitted or updated immediately.

City enterprise credit information management center can independently collect information that can be used to analyze and judge the credit status of enterprises.

Enterprises can independently declare other credit information that can be used to analyze and judge their own credit status. Article 12 (Information Classification)

Enterprise credit information is divided into basic information, performance information, prompt information, early warning information and warning information. Article 13 (Basic Information)

Enterprise basic information includes the following information:

(a) the basic situation of enterprise registration;

(2) The administrative license obtained by the enterprise;

(3) the qualification grade of the enterprise;

(four) the basic situation of the enterprise's tax payment, social insurance premium payment and provident fund deposit;

(five) the results of special or regular inspections of enterprises by administrative organs according to law;

(6) Intellectual property information such as enterprise trademarks and patents;

(7) Other basic information.

The information specified in the preceding paragraph includes registration, alteration, cancellation or revocation, etc. Article 14 (Performance Information)

Enterprise performance information includes the following information:

(a) enterprises by the district (city) people's governments at or above the county level and administrative organs at or above the municipal level in recognition of awards, the legal representative of the enterprise and the main person in charge by the district (city) people's governments at or above the county level and administrative organs at or above the municipal level in recognition of awards;

(2) The enterprise is rated as a tax credit rating by the tax authorities;

(3) Being recognized as a well-known trademark, a famous trademark, a well-known trademark in China or a famous trademark in Sichuan;

(4) The enterprise has passed the quality standard certification;

(five) the enterprise won the title of "abiding by contracts and valuing credit";

(six) the enterprise is commended by the industry association;

(7) Other achievements.
