Do I have to pay the property fee?

As long as the house has been delivered, the property management fee will be paid regardless of whether the owner moves in, because the property management company has already started to provide services. Property management companies do not serve one or several owners, but provide services for the whole community. The contractual relationship between the property management company and the owners is that of all the owners.

2. Legal basis: Article 938th of the Civil Code of People's Republic of China (PRC).

The contents of the realty service contract generally include service items, service quality, service fee standards and collection methods, use of maintenance funds, management and use of service places, service term, service handover and other terms.

The public service commitment made by the property service provider in favor of the owner is an integral part of the property service contract.

The realty service contract shall be in written form.

Article 4 of the Measures for the Administration of Property Service Charges

The State Council price department in conjunction with the State Council construction administrative department is responsible for the supervision and management of the national property service charges. The price departments of local people's governments at or above the county level shall be responsible for the supervision and management of property service charges within their respective administrative areas jointly with the real estate administrative departments at the same level.

Property service charges should follow the principles of reasonableness, openness and adaptability between charges and service level.

According to the regulations, you can choose one month, one quarter, six months or the whole year. But no matter which way you choose, you must pay in advance, because the property management company serves you with the property fees you pay. If the property service enterprise fails to pay the property fee within the time limit and fails to pay the property fee within the grace period after being urged, it may bring a lawsuit to the people's court regardless of the amount and duration of the property fee owed.
