The use of property management fees
There are many items of property management fees, including the maintenance fees of public properties and supporting facilities, including external walls, stairs, pedestrian corridors, elevators (escalators), air conditioning systems, fire fighting systems, security systems, television audio systems, telephone systems, power distribution systems, water supply and drainage systems and other machines, equipment and mechanical facilities.
If the owner fails to pay the property fee for a long time, it will cause other owners to follow suit. If most owners do not pay property fees for a long time, it will affect the normal operation of the community. If many people don't pay the property fee for a long time, the property will sue the owners who don't pay the property fee. The result of the prosecution is to pay the property fee, because the owner who does not pay the property fee is an unreasonable party. If he is prosecuted, he will lose the lawsuit.
If the owner does not pay the property fee and enters the judicial process, the court will ask the owner to fulfill his obligation to pay the property fee. After the judgment of the court, it will not be executed, and the court will incorporate this behavior into the credit information system.
According to Article 40 of the Property Management Regulations (implemented on 10/2007):
Property service charges should follow the principles of rationality, openness and adaptability between fees and service levels, and distinguish the nature and characteristics of different properties. The owners and the realty service enterprise shall, according to the charging standards for realty service formulated by the competent price department of the State Council in conjunction with the administrative department of construction of the State Council, stipulate in the realty service contract.
The Regulations on Property Management was revised according to the decision of the State Council on revision, which is a law and regulation to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, and improve people's living and working environment.
