Interim Measures of Shijiazhuang Municipality on Property Management of Urban Residential Quarters

Chapter I General Provisions Article 1 In order to standardize the property management of urban residential quarters, create and maintain a clean, comfortable and safe living environment, and safeguard the legitimate rights and interests of owners, users and property management enterprises, these measures are formulated in accordance with the Interim Provisions on Property Management of Urban Residential Quarters in Hebei Province and relevant regulations, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management of residential quarters in the urban areas of this Municipality (excluding mining areas). Article 3 The term "residential quarters" as mentioned in these Measures refers to residential quarters and non-residential houses with public facilities formed by unified planning, comprehensive development and supporting construction in urban planning areas. Property refers to all kinds of houses and their public facilities, equipment and venues in residential areas. The owner refers to the owner of the property. Property management refers to the residential area management committee (hereinafter referred to as the CMC) entrusts the property management enterprise to implement unified professional management and services for houses and public facilities, equipment and sites in accordance with the provisions of the property management service contract. Article 4 The municipal real estate management department is the administrative department in charge of real estate management in this Municipality and is responsible for the implementation of these Measures. Urban construction and city appearance management departments shall, in accordance with these measures, manage and supervise the property management of residential quarters within their respective jurisdictions.

Construction, planning, price, public security, industry and commerce departments shall supervise and inspect the property management of residential quarters in accordance with the division of responsibilities.

Municipal utilities, city appearance and environmental sanitation, gardens, power supply, gas supply, telecommunications and other departments shall carry out their work in accordance with their duties, and maintain and manage the property within the property rights of residential quarters. Fifth new residential areas must implement property management. Property management must be implemented in residential quarters that have been delivered before the implementation of these measures. Before the implementation of these measures, the residential quarters and living quarters of government agencies and institutions that have been delivered for use shall gradually implement property management. The specific scope and scheme shall be determined by the municipal property management administrative department in conjunction with relevant departments.

The property management of residential quarters shall follow the principles of autonomous management of owners and users, professional management of property management enterprises and supervision and guidance of administrative departments.

Property management in residential quarters should follow the principles of scientific management, financial openness and democratic supervision. Sixth owners and users have the right to rational use of housing and public facilities, maintain public order in residential areas, and abide by the rights and obligations agreed in the property management of residential areas. Seventh property management administrative departments should establish a complaint acceptance system, accept complaints from the CMC, property management companies, owners and users, and give a written reply to the complainant within 30 days from the date of accepting the complaint. Eighth complaints are under the jurisdiction of other administrative departments, the property management administrative department shall, within two days from the date of receiving the complaint, transfer it to the relevant administrative department for handling, and inform the complainant in writing. Chapter II Property Management Institutions Article 9 Within two months from the date when the occupancy rate of newly-built residential quarters reaches 30%, the people's government under the jurisdiction shall organize sub-district offices, neighborhood committees, development and construction units and representatives elected by all owners and users to form a management committee.

Conditional residential areas, you can set up the owners' committee. Tenth before the establishment of the new residential area management committee, the development and construction units shall conduct property management of residential areas by themselves or by entrusting property management enterprises;

Within one month from the date of the establishment of the CMC, the development and construction unit shall hand over the property management work, the plan of residential quarters, the completed general plan, the completed plan of single building, structure and equipment, the completed plan of underground pipe network and other necessary information to the CMC.

Planning and construction of public facilities and commercial and business premises in residential areas shall be handed over to the people's government of the jurisdiction for escrow after comprehensive acceptance by the municipal construction administrative department and relevant departments. The people's government of the jurisdiction shall, in accordance with the relevant provisions of the Municipal People's Government, transfer it to the Administrative Committee and relevant departments for management, use and maintenance.

The development and construction unit shall allocate the property management space according to the proportion of the residential area11000 to 1.5. Eleventh CMC is composed of street offices, neighborhood cadres and representatives of owners and users, and the director is concurrently led by the office. The CMC consists of five to fifteen members, who are part-time. A person who has been sentenced to criminal punishment or deprived of political rights for less than five years may not serve as a member of the Central Military Commission.

According to the needs of the work, the CMC can hire full-time staff (one to two for residential quarters of more than 500,000 square meters and two to three for residential quarters of more than 100,000 square meters) to be responsible for the daily work of the CMC. Twelfth CMC shall, within ten days from the date of composition, handle the registration formalities with the municipal property management administrative department with the following documents:

(1) Application for registration;

(2) List of members;

(3) Articles of association.

The municipal property management administrative department shall, within ten days from the date of receiving the application for registration, complete the registration formalities for those who meet the registration conditions; If it does not meet the registration conditions, it shall notify the applicant in writing and put forward suggestions for improvement, and order it to re-apply for registration.

The CMC shall be established as of the date of registration.

Before the implementation of these measures, the CMC shall go through the registration formalities within two months after the promulgation and implementation of these measures. Thirteenth CMC must safeguard the legitimate rights and interests of owners and users under the guidance of the administrative department of property management, and perform the following duties:

(a) to convene and preside over the meeting of owners and users, and report on property management;

(two) to formulate the articles of association of the management committee and the owners' convention;

(3) Hiring or dismissing a property management enterprise and signing a property management service contract with the property management enterprise;

(four) to supervise and inspect the implementation of the annual plan of property management and the financial budget and final accounts of the property management enterprise reviewed and approved by the owners and cooperative users;

(five) to listen to the opinions and suggestions of the owners and users, and to guide the property management enterprises to improve the property management services;

(six) supervision and inspection of residential property use and property management services revenue and expenditure;

(seven) to consider and decide other matters of property management.
