Regulations of Qingdao Municipality on Property Management
The term "property management" as mentioned in these Regulations refers to the professional management of property by property management enterprises and the comprehensive services provided for owners and non-owners in accordance with the contract.
The term "owner" as mentioned in these Regulations refers to the owner of the property.
The term "non-owner users" as mentioned in these Regulations refers to the lessee of the property and other people who actually use the property. Article 3 These Regulations shall apply to the property management within the administrative area of this Municipality. Fourth Qingdao property management administrative departments (hereinafter referred to as the municipal property administrative departments) in charge of the city's property management.
Qingdao property management department and the department determined by the district (city) people's government (hereinafter referred to as the property administrative department) shall, in accordance with the provisions of these regulations, be responsible for the property management within their respective jurisdictions.
Other relevant departments shall, in accordance with their respective responsibilities, cooperate in the relevant administrative work of property management.
Sub-district offices shall supervise and inspect the property management work involving urban management, and coordinate the relationship between property management and the work of neighborhood committees and community services. Chapter II Owners' Congress and Owners' Committee Article 5 The owners' congress is composed of all owners in the property management area; If there are a large number of owners, the owners' representatives shall be elected in proportion to form the owners' meeting.
The owners' committee is an organization elected by the owners' congress or the owners' congress and registered by the property administrative department, which represents all the owners in the property management area to implement autonomous management of the property.
A property management area establishes an owners' committee. The scope of the property management area shall be defined by the property administrative department according to the actual situation. (two) to listen to and consider the work report of the owners' committee and supervise the work of the owners' committee;
(three) to adopt and amend the owners' convention and approve the articles of association of the owners' committee;
(four) to change and cancel the inappropriate decisions of the owners' committee;
(5) Deciding to hire or dismiss the property management enterprise;
(six) to decide other related matters of property management. Eleventh owners' committee shall perform the following duties:
(a) to convene a meeting of the owners' congress or the owners' congress and report on its work;
(two) responsible for the specific work of hiring property management companies, and conclude, modify or terminate the employment contract with property management companies;
(three) to consider the annual property management work plan put forward by the property management enterprise, and to supervise and evaluate the work of the property management enterprise;
(four) to consider the plans for raising and using various funds related to property management, and to supervise the property management enterprises to publish their income and expenditure on an annual basis;
(five) to listen to the opinions and suggestions of the owners, non-owners and property management enterprises on property management;
(six) to cooperate with the property management enterprises to implement various management measures and assist the property management enterprises to pay the arrears;
(seven) other duties entrusted by the owners' congress or the owners' congress. Article 12 The owners' committee shall hold regular meetings. The decision made by the owners' committee shall be adopted by more than half of all members. Thirteenth the implementation of property management, the owners' convention shall be formulated. The owners' convention shall come into effect after being discussed and approved by the owners' congress meeting or the owners' congress meeting. Fourteenth owners' convention and the decisions made by the owners' congress, owners' congress and owners' committee are binding on all owners and non-owners in the property management area.
The owners' convention and the decisions made by the owners' congress, the owners' congress and the owners' committee shall not contravene laws and regulations.
