Article 4 Responsibilities and Obligations of Party A

Within two months of operation, ensure the normal operation of the swimming pool and attached rooms.

Actively encourage and coordinate swimming classes in primary and secondary schools, and build the swimming pool into an educational activity base for XXX primary and secondary school students.

Upon expiration or termination of this contract, within one month after all rents, fees and possible late fees, liquidated damages and compensation are settled.

Article 5 Responsibilities and Obligations of Party B

In the process of contracted operation, we must abide by the relevant national laws and regulations, operate according to law, consciously accept the supervision and management of relevant functional departments, and maintain the external image of the swimming pool. In the process of contracting operation, the sports functions of swimming pools and ancillary buildings shall not be subcontracted or changed.

All economic, legal and safety responsibilities for contracting the operation of swimming pools and ancillary buildings shall be borne by Party B, and the taxes involved shall also be paid by Party B. ..

During the contract operation of the swimming pool and its affiliated rooms, there must be clear responsibility measures such as life-saving safety, and take full responsibility for the safety of swimming pool staff and customers.

During the contracted operation of swimming pools and ancillary buildings, bear all expenses for the maintenance, repair, management and operation of swimming pools and ancillary buildings and pay them in time according to regulations.

We should provide all kinds of services to students according to the class, and the fees should be preferential. The specific charging standard shall be negotiated separately by both parties and reported to the county price bureau for approval. The elderly and the disabled should be given preferential treatment according to regulations.

After the expiration or termination of this contract, the leased swimming pool and ancillary buildings shall be returned to Party A in good condition according to the operating conditions (the real estate invested by Party B shall be owned by Party A and the movable property shall be disposed of by Party B).

Article 6 Liability for breach of contract:

Where Party A interferes with Party B's normal business for no reason and causes heavy losses to Party B, it shall be deemed as Party A's breach of contract, and Party B has the right to terminate this contract, and may pursue Party A's economic responsibilities according to the Contract Law.

In any of the following circumstances, Party B shall be deemed to be in breach of contract, and Party B shall bear corresponding liabilities for breach of contract. Party A has the right to terminate this contract and confiscate the performance bond.

Party B fails to pay the rent or delays in paying the rent for more than 30 days;

Party B's accumulated arrears exceed 50,000 yuan;

Party B arbitrarily changes the use or building structure of the swimming pool and ancillary buildings;

Party B engages in illegal activities or harms public interests during the contracted operation.

Article 7 This contract may be terminated under the following circumstances:

If one party breaches the contract, the other party may terminate the contract according to the provisions of this contract;

Both parties agree to terminate the contract through consultation;

Due to legal force majeure;

Due to the reasons stipulated by laws, regulations and policies, this contract cannot be continued.

Except for the above terms, neither Party A nor Party B shall be liable for the termination of the contract.

Article 8 On the date of signing this contract, both parties shall issue a detailed list of assets.

Article 9 Party B shall return the swimming pool and its attached rooms within one month after the expiration of this contract.

Article 10 Any dispute arising from the performance of this contract shall be settled by both parties through consultation. If negotiation fails, a lawsuit may be brought to the local people's court according to law.

Article 11 For matters not covered in this contract, both parties shall sign a supplementary contract after consultation, and the supplementary contract shall have the same legal effect as this contract.
