However, in recent years, the contradiction between property and owners has never stopped. The property thinks that the service it provides according to the charging standard is very good, while most owners think that the speed and ability of property to solve problems are very general. Property charges are high, but it can't provide high-quality services. Such a vicious circle, many owners even proposed to cancel the property. Property and owners, two closely linked groups, why are there such big contradictions?

The contradiction between property and owners is often reflected in three aspects:

1. Only the property fee is charged, and the owner's claim cannot be properly handled.

2. The income and expenditure of property fees are opaque, and the income of the community is not shared by the owners, and there are many repeated charges.

3. The poor quality of property service and troublesome replacement not only affect the living experience, but also affect the house price.

Some people think that the property should be completely cancelled. 1. If the owner is not satisfied, he has the right to replace it.

Article 284 of the Civil Code stipulates that the owner can manage the house and its ancillary facilities by himself, or entrust the property service enterprise or other managers to manage the house. Owners have the right to change the realty service enterprise or other management personnel employed by the construction unit according to law. However, Article 278 also stipulates that general decisions such as the election of owners' committees, the hiring and dismissal of property management companies, etc. only need the consent of more than half of the owners and exclusive areas. However, if more than one third of the owners or exclusive areas do not participate in the voting, even if more than half of the owners and exclusive areas agree, the owners' meeting still cannot form an effective resolution.

2. The owner has the right to get extra income.

According to the new property management regulations issued by Shenzhen, Beijing, Shandong and other provinces in 2020, it is pointed out that "the income of the public area of the community belongs to all owners." Although only the above-mentioned cities explicitly put forward this point this year, according to Article 45 of the General Provisions of Property Regulations, the management right and income right of the public area of the community belong to all owners. The revenue activities of public * * * areas and public * * * facilities shall be approved by the owners' meeting. The public * * * area income belongs to all owners, and the owners decide to use it.

These three property fees are not required to be paid.

1. If the house is delivered late, there is no need to pay the property fee. The new house is vacant for one year, and the property fee should be reduced.

According to the new regulations, if an ordinary house is vacant for more than one year after delivery, the public service fee of the previous property shall be appropriately reduced or exempted according to the actual operating cost. In addition, if the developer fails to pay within the time limit, the owner does not have to pay any fees. If the property has a request, you can refuse it completely.

2. Unreasonable charges for the property.

Not long ago, Shaanxi Province explicitly requested in the newly revised Measures for the Administration of Property Service Charges in Shaanxi Province that the maintenance costs of public parts and facilities in residential areas after the expiration of the maintenance period should be included in the public maintenance fund, and should not be included in the property cost, and resolutely cancel the unreasonable self-determined fees such as energy sharing, wall smashing fees, garbage cleaning fees, and paid service fees. The property company imposed charges on the owners. If you still need to charge, it is a repeated charge and you can report it.

3. If the supporting facilities are not up to standard, the property fee shall be reduced or exempted.

Chongqing's new regulations came into effect on May 1 day, stipulating that the property shall not violate the contract, lower the service standard or raise the charging standard. If due to the developer's own reasons, its supporting facilities and green environment do not meet the standards agreed in the housing sales contract. In the early stage of ordinary residence, the public service fee for property shall be appropriately reduced, and the difference shall be compensated by the construction unit to the property service enterprise. In addition, if the property charges falsely, the owner can refuse. At the same time, a representative committee can be set up to re-formulate the charging standards and charging items of property management, and report the charging standards to the Price Bureau to avoid arbitrary charges.

It can be seen from these new regulations that the dispute between the owner and the property has been solved to the greatest extent, which is really good news. As more local real estate is regulated, owners will have more good news. Of course, in the long run, it is unrealistic to completely cancel the property.
